Sneaking laws into the books

Important update: Per the Maryland General Assembly webpage, the date of presentment was actually fixed as May 3. This means the legislative limbo can run as late as June 2.)

On Tuesday Governor Larry Hogan risked carpal tunnel syndrome by signing hundreds of bills into law. The extraordinarily high output was made necessary by two factors: the events in Baltimore that scuttled a planned bill signing back on April 28, and the desire to enact these laws within the period mandated by the state’s constitution. As a refresher, Article II, Section 17 (c) of the Maryland Constitution states:

Any Bill presented to the Governor within six days (Sundays excepted), prior to adjournment of any session of the General Assembly, or after such adjournment, shall become law without the Governor’s signature unless it is vetoed by the Governor within 30 days after its presentment. (Emphasis mine.)

There are a handful of bills which may make it into the books this way. Since the General Assembly session ended at the stroke of midnight April 14. 30 days hence would be tomorrow, May 14. (Update: presentment doesn’t happen with adjournment, as I have found.) Some of the bills in limbo happen to be those which are part of the monoblogue Accountability Project, so you can bet there are some calculations going on about whether a veto can be sustained.

Many of these bills Hogan has held off on signing establish or extend fees and taxes, with a few being issues local to Calvert, Charles, and Howard counties. Two of them extend or increase fees in state courts; in another case I wrote about the “travel tax” of Senate Bill 190 a few weeks ago. Senate Bill 183 would mandate the adoption of the Geographic Cost of Education Index, which would be a budget-buster. He’s also passed on extending the film production activity tax credit that the producers of “House of Cards” wanted.

Business interests, though, should be happy that Hogan hasn’t signed the de facto two-year fracking ban or the extension of flexible leave.

On the social issue end of the spectrum, we do not yet know the fate of bills which would decriminalize marijuana, allow for same-sex couples to have their IVF procedures covered under insurance, let those who have undergone the treatment to revise their gender to change their birth certificates to reflect this, or allow felons who are out of prison but still on probation or parole to vote.

These are less than 5% of the bills which were passed. Many others have already been vetoed as duplicative, but those above are the ones most likely to get an attempt at overriding the veto – or they can try, try again in the next term knowing that the votes for passage were there the last time. Some bills may be improved with a few minor changes that can be worked out while others should just be put out of our misery.

I’m hoping that Governor Hogan sends a strong message by vetoing the following bills I advised voting against:

If he wishes to let the decriminalization of marijuana become law without his signature, that’s quite all right.

The final hurdle

This is sort of a programming note for those who are interested.

Over the last week on social media I was detailing some of my findings as I went through the votes for the monoblogue Accountability Project. There was a Delegate who was racking up an impressive record of consecutive correct votes; alas, his streak stopped at 15. Anyway, I have completed the tallies and over the next few days will write up the “awards” segment.

However, one thing I cover in my summary is the disposition of bills and that depends on Governor Hogan. On Tuesday he will sign the last batch of bills he plans on making into law and hopefully will present veto statements for others which won’t. You may recall he was supposed to sign a group of them on April 28 but the Baltimore riots forced a postponement. It means come Tuesday Larry might have carpal tunnel from signing so many bills because he’s doubling up the batch. This means I should be ready for release on May 18, since I like to put things like that up to begin a week.

Speaking of veto statements, this also allows me to bring up the idea that MDPetitions.com (the brainchild of Delegate Neil Parrott) is urging people in a last-ditch effort to veto three bills. As it turned out, they were all votes in the monoblogue Accountability Project and for all three the correct vote was against passage – so I join that call to veto the following bills:

  • SB 416/ HB 838 – Insurance Mandate for same-sex wedded couples to get In-Vitro Fertilization (IVF) treatments
  • SB 743/ HB 862 – Modified Birth Certificates for Sex Changes, No Surgical Change Necessary
  • SB 340/ HB 980 – Convicted Felons Voting without Completing Their Sentences

I go into the reasons as part of the mAP, although on the IVF and birth certificate issues Cathy Keim and I have already explained our opposition.

As regards my writing partner Cathy, she is on a little hiatus for family time. So if you miss her pieces – and I’ve noticed she’s made quite a few fans over the short time she’s been associated with this site – don’t fret because she should be back in the saddle over the next couple weeks.

Once I get through that I have a couple more pet projects. And you thought I’d take it easy on the off year.

Opinions wanted

This may be a first. The idea here is to crosspost between my website and my social media page.

It’s likely that you’re aware of the monoblogue Accountability Project. As I bring that to a close in the next week or so, the next long-term goal for me is to begin evaluating the GOP field for President – a field which is seemingly expanding weekly and may include over a dozen serious aspirants by mid-summer.

If you have read monoblogue for the last eight years you’ll recall I have done a thorough and issue-based analysis of the candidates, looking at how their policies stack up against the others on ten to twelve key issues. I plan on doing that again this year, but what I’m looking for is what my readers and social media friends consider to be the top three issues you feel will be important in 2016. It will help me rank issues in importance as I formulate the overall plan.

In the meantime, look for the mAP in the next week or two, depending on how long Governor Hogan takes to clear the backlog of passed legislation off his desk.

So-called expert believes women can only be prostitutes and maids

Okay, now that I have your attention, allow me to add some context. If I did show prep for Rush Limbaugh, this story would be placed in the “lighthearted stack of stuff.” (This explains why I kept it around for a couple weeks.)

Back on April 20 – which somehow seems appropriate – the Washington Times ran the story I allude to in the title. It detailed an April 6 lecture by “a key figure behind New York’s statewide ban on fracking.” Biologist Sandra Steingraber said the following:

“Fracking as an industry serves men. Ninety-five percent of the people employed in the gas fields are men. When we talk about jobs, we’re talking about jobs for men, and we need to say that,” Ms. Steingraber says in a video posted on YouTube by the industry-backed group Energy in Depth.

“The jobs for women are ‘hotel maid’ and ‘prostitute,'” she says. “So when fracking comes into a community, what we see is that women take a big hit, especially single women who have children who depend on rental housing.”

Needless to say, if a conservative said that women were only qualified to be prostitutes and hotel maids, we would have that splashed all over the front pages for months on end. Instead, it took two weeks to leak out to the Washington Times and, aside from that, it’s barely been mentioned. A cursory news search for Ms. Steingraber only found a few articles on smaller outlets about upcoming speeches and minor reaction to this story.

The Times also quotes another anti-fracking activist who compares the procedure to rape:

Ms. Steingraber’s speech, titled “Fracking is a Feminist Issue: Women Confronting Fossil Fuels and Petrochemicals in an Age of Climate Emergency,” comes after Texas anti-drilling activist Sharon Wilson was criticized for comparing fracking to rape in a March 30 post on Twitter and her blog.

“Fracking victims I have worked with describe it as a rape. It is a violation of justice and it is despoiling the land,” Ms. Wilson said in her blog, TXSharon’s BlueDaze. “Victims usually suffer PTSD.”

I tell you, Valerie Richardson’s story could be comedy gold – but these people take this stuff seriously, and that’s a shame.

While the oil and gas industry isn’t female-dominated by any means, it’s often a function of physical strength and skill level – the women who are coming into the field aren’t typically found at the wellhead but in what the industry calls “downstream” jobs. None of them involve prostitution or scullery work, but they’re usually not going to get their hands overly dirty at the jobsite because they are the technicians and engineers as opposed to the guys doing the drilling and extraction. And that’s just fine – they’re making an honest living. So Steingraber may be right in the specific that nearly all wellhead jobs are held by males, but as an industry she’s well off base.

Yet the problem with this line of thinking is that it pervades the brains of liberals who occupy places of power, such as the EPA or, closer to home, the Maryland General Assembly. The Radical Green leftists in the MGA still haven’t received the “war on women” meme, but they don’t have to be as sly about it, either.

As you are likely aware I am currently working on the 2015 monoblogue Accountability Project, and some of my venom is saved for the idiocy which passes for oil and gas industry expertise. Pro-abortion legislators are continually trying to strangle Maryland’s fracking industry before it even makes it to the crib, as you’ll see when I wrap up the mAP in the next few weeks.

One good example is a proposal on the waste products of fracking, which is originally proposed would have made it illegal for a person to “accept, receive, collect, store, treat, transfer, or dispose of, in the state, waste from hydraulic fracturing.” Well, that pretty much covered it: a backhanded ban on the practice. I have at least one other example in the mAP, so be watching.

For America to prosper, we need to create our own energy. And when we have the bountiful resources that we do and can extract them at a reasonable, market-based price, why not do so? You can see the depths opponents have to reach to make their point, which means their argument is a futile one. Drill, baby, drill!

Wicomico’s Fab Five

Tomorrow a unique chapter in Wicomico County history will begin as our five-member delegation to the Maryland House of Delegates will all simultaneously begin their careers in Annapolis as part of an overall freshman class in the House that’s one of the biggest in memory.

While Christopher Adams, Carl Anderton, Jr., Mary Beth Carozza, Johnny Mautz, and Sheree Sample-Hughes took divergent paths to get to that point, they will all meet in the same place. And with the exception of Anderton and his slim 52.2% of the vote, there was a clear mandate from their respective districts for these newcomers – combined Adams and Mautz racked up 78.6% of the Wicomico County vote while Carozza was close behind at 77.6%. (Sample-Hughes was unopposed.)

And while only Sample-Hughes and Anderton have previous experience in elective office – Sample-Hughes with eight years on Wicomico County Council and Anderton with nine years in Delmar as a commissioner and mayor – the life experiences of the others can’t be discounted. Mautz and Carozza have worked in government before on the Congressional and state levels, while Adams has represented a professional association in legislative matters. Naturally Adams and Mautz were placed on the Economic Matters Committee, while Carozza garnered a seat on Appropriations. Anderton was placed on the newly-rechristened Environment and Transportation Committee, and Sample-Hughes will be on Health and Government Operations.

So Wicomico is in very good hands, and there’s a lot of work to do.

While the overriding priority for all of these representatives is that of getting our economy back on the right track, the more pressing local issues will come from the environmental and budgetary fronts. The Phosphorus Management Tool may be placed via the regulatory route – and if so may instead be the target of a repeal effort – but it’s a battle more likely to be fought on the legislative front, despite the assurance of a veto from incoming Governor Larry Hogan.

But the real battle will be to return the state’s highway user funds back to the county, a $7 million transfer that Anderton would like to see returned in order to address the tax differential issue in Wicomico. Most of the $1.4 million is ticketed for the city of Salisbury, but Fruitland and his hometown of Delmar would also benefit. Carl may get the double dip as the PMT legislation would be argued in his committee, while he may also get a say in the highway user funds as well.

Over the next 90 days, these five and all the others will go to work and hopefully begin to turn this ship of state around. And as all that is going on, rest assured I’ll be watching the legislation and considering which votes go onto the monoblogue Accountability Project – one of these five is very interested to see how the scores will come out and has peppered me with questions about how this all works, so I may as well explain.

As the session goes along, I watch the process and try to pick out a total of 25 key votes. 22 of these will be floor votes on bills I find interesting and have votes where there is significant opposition, although I have occasionally used a unanimous (or nearly so) vote on something like the capital budget. For example, I think the operating budget vote has been on every version of the mAP, with the “no” vote always being the correct one. That may change if I see Larry Hogan making significant progress on rightsizing state government – if the budget comes in under $40 billion I may be satisfied with a green light. We will see.

In the few years I have done committee votes, the three votes have actually been 30 between ten committees in the House and Senate. In some committees it’s hard to pick just three votes while in others I have to scrape together three. But they are included in the 25 for each member.

25 votes is the magic number because math is easy: four points for each vote. Since I use a system where points can be deducted (one point for an absence and two points for intentionally not voting) working with even numbers is much easier. I also have a rule for House members who can change their votes after the fact that changing to the right vote is only worth half the credit while flipping to the wrong side is a penalty of 1.5 times the vote.

This year will also have the unique situation of members joining mid-session. Since Larry Hogan has tapped a number of  sitting General Assembly members to serve in his administration, there will be a number of vacancies filled after the session begins. That will affect their score for this year but won’t adversely affect their lifetime score for future sessions. Votes which occur before they are seated won’t be marked as absences.

But that is something to be determined 90 days from now. In the meantime, it will be up to our Fab Five to do what they can do to make life better for residents in their districts.

The rookie class

I tell you, it’s the mundane things I do…

Last night I was setting up the 2015 monoblogue Accountability Project charts, to save me a little work come next spring. (One key change: I’m going to alphabetical order to make it so, so much easier to compile votes since the state legislative chart lists tallies alphabetically.) Something I note on the mAP is the “years of service” and there are a lot of people who will have “1” next to their name.

In the House of Delegates, there will be a whopping 58 rookie legislators, while the Senate will boast three rookies. Out of those 61, which make up almost a third of the General Assembly as 29 are Republicans and 32 are Democrats, it’s worth noting that all three Senate rookies come from the GOP, which has changed over half its 12 members that were elected in 2010 in expanding back to the 14 they had from 2006-10.

While the GOP House caucus is at a modern high of 50 members, over half of them will be new to the General Assembly. Just on a local level, the District 38 delegation has two rookies while District 37 has three. Between the primary and general elections, the three local politicians who have 20 or more years in the General Assembly were whittled to one (newly-minted Senator Addie Eckardt.) Next in seniority is Senator Jim Mathias, who was first appointed to the House in 2006, then Delegate Charles Otto, who won re-election last week for a second term.

The learning curve for all these newbies will be steep, but it will be fascinating to see if they come up with new and better bills than the old veterans have done over the last eight years. Another interesting angle will be the bills sponsored by the Speaker and Senate President – since the governor cannot introduce a bill, it’s normally introduced by the Speaker or President “by request” of the administration – here’s one example. Imagine a tax cut bill being introduced by a Democrat – but that will be the case as Governor-elect Hogan outlines a legislative agenda.

(Another thing to watch is whether Martin O’Malley will leave some sponsored bills as parting gifts walking out the door, since the General Assembly reconvenes a couple weeks before the inauguration of Larry Hogan. Honestly, I doubt it.)

This will be an exciting time to watch the General Assembly.

The truth about ‘Liberal Jim’

For several years I’ve done the monoblogue Accountability Project for this very purpose – disseminating the truth about how members of the Maryland General Assembly really vote when the rubber meets the road. There are few races with as clear-cut of a difference as the 38th District Senate race between incumbent Democrat Jim Mathias, whose mAP score as a Delegate from 2007-10 was a 15 (out of 100) and Senate lifetime score from 2011-14 has been 28 (out of 100) and Republican Delegate Mike McDermott, who replaced Mathias in the General Assembly and has a lifetime rating of 84.5 of 100. But what does this mean in terms of issues? I went back and researched the common votes taken by both men. Since 2012, I have set up the mAP to use bills which received votes in both the House of Delegates and Senate – out of 25 votes, 22 of these would be common. (The other three were committee votes for the respective bodies.) So 66 votes over the last three years’ worth of sessions were placed in front of both men.

In 2011 I hadn’t changed the rules yet, so while I had standardized the number of votes at 25, only 9 were common. Yet of those 9 common votes, Mathias and McDermott only voted the same on two. In total, out of 75 possible votes, Mathias and McDermott differed a total of 45 times while agreeing on 27 occasions. (Mathias was absent for three votes in that time period.)

Eleven of those 45 votes of disagreement were budgetary. Year after year, Mathias has been a rubber stamp for the annual spending and debt increases put in by the state. It’s not just the operating budget but the creation of more and more state debt and all the legerdemain that goes into each year’s BRFA. The only agreement between the two: Mathias voted against the original 2012 BRFA.

But in 2011, Mathias also voted to force home care providers into paying union dues, which created an unearned estimated benefit to Big Labor of over $430,000, the crony socialism of the InvestMaryland Act where the state ate its seed corn of future receipts, state law conformity with Obamacare, and the gerrymandered Congressional districts which took effect for 2012.

Mathias also had a hand in some dreadful 2012 legislation, voting for the state health exchange that’s only enrolled about 1/3 of the expected number of people at a wasted cost of over $125 million. Some guy named Anthony Brown was taking credit for that until it tanked. On a related front, Jim also voted to establish so-called “health enterprise zones,” which was something requested by minority legislators. Wouldn’t it make more sense to lift all boats?

But that’s far from all of it. Remember that “flush tax”? Mathias voted to double it. Jim also voted to burden the nascent state natural gas industry with the presumption of guilt in well contamination, mandate expensive fire sprinkler systems in new homes, adding thousands to the cost, and punished cellular customers with an expansion of the USTF surcharge. And again, Mathias did a favor to unions by expanding their reach among state employees.

And remember the “doomsday budget”? In that 2012 special session, Mathias voted for the measure that transferred teacher pensions to the counties and forced Wicomico County to raise its income tax and maximize its property tax increase to stay eligible for a $14 million lower maintenance of effort payment. Thanks for the higher taxes, Jim.

2013 was the year with the most departure between the two, as they differed on 15 of 22 votes. Several of these were bills dealing with the state’s implementation of Obamacare – including Medicaid expansion which is purportedly covered by federal funds (for now) – but there were other differences. Mathias supported provisions permitting voting by mail and, beginning in 2016, same-day registration during early voting. Both are invitations to voter fraud.

Mathias also voted in favor of the $18 annual surcharge residential customers start paying if offshore wind becomes a reality. (This may be hundreds of dollars annually for commercial customers and thousands annually for industrial users.) Jim also allowed the Maryland Stadium Authority to fund the construction of schools in Baltimore City. I’m not sure what sort of precedent that sets, but is Somerset County any wealthier of an area? Why is Baltimore City getting this new source of debt?

Nor were Jim’s union friends left out. In 2013 he voted to enact so-called “service fees” at five state universities and statewide for public school employees.

But the most interesting vote was on the Transportation Trust Fund “lockbox.” While it’s supposedly in place to prevent the annual raid of the TTF by a governor who can’t suppress his appetite for spending, the key to unlock is laughably weak: a 3/5 majority of both houses of the General Assembly. At this point Democrats by themselves could allow the transfer with 13 House votes and 6 Senate votes to spare. Those lucky Democrats, likely in swing district’s like Jim’s, would have the pass to go against their party while knowing passage is safely in the bag. I sense that Mike McDermott knew this when he properly voted no.

(That Constitutional Amendment is on the 2014 ballot as Issue 1, and I would encourage a vote AGAINST it. Make the General Assembly come up with a real lockbox – either a blanket prohibition or a 3/4 majority, which would require at least some Republicans to buy in – 106 House votes and 36 in the Senate.)

This year’s agenda was somewhat less ambitious, but there were still major differences. Mathias dodged a bullet when the bridge-eligible assistance program he voted for proved to not be too expensive (although there was no final expense tally at the point this was updated) but he also kept adding more Obamacare provisions to state law while paying for a needle exchange program in Baltimore city.

On the educational front, Mathias supported a pre-K expansion which will be of dubious benefit (except to public school unions) and supported a workgroup of yes-men studying how to better implement Common Core, which they don’t call Common Core anymore. And not only did he once again support a bloated budget, he tacked on a $10 additional fee for pesticide registration. Granted, it’s an aggregate of about $130,000 a year but it’s yet another burden for businesses.

Aside from the budget bills, though, the supporters of Jim Mathias would probably point to the bills both voted for as evidence of his moderate stance.

In 2011, both voted against the supplemental 3% alcohol tax and in-state tuition for illegal aliens. 2012 brought several points of agreement: voting against a prohibition of arsenic in livestock feed, enactment of same-sex marriage, the “rain tax,” the Septic Bill (with a caveat as I’ll get to momentarily), and even requiring helmets for moped riders. In the first Special Session that year both voted against the income tax increase.

When I revisited the Septic Bill, though, I noticed there were two Third Reading Senate votes – one for the Senate bill and one including some changes from the House version which passed, which had to be voted on again as amendments to the Senate version. Oddly enough, on the first iteration Jim voted yes but on the final product he was a no vote. Apparently Jim was for tier maps before he was against them?

Anyway, 2013 brought a lot of disagreement but Mathias and McDermott voted alike on some key issues: the gas tax increase, death penalty repeal, driver’s licenses for illegal aliens, and the SB281 gun bill all drew their opposition. Credit Mathias with unsuccessfully trying to place a sunset date on the gun law. This year they both fought the minimum wage increase as well as prevailing wage applicability, helped to decrease the estate tax (a rare win for conservatives) and the “bathroom bill.”

One thing I noticed in my research, though, is that Mathias rarely offers any floor amendments, whereas McDermott has several per term. Obviously that stage seems to me the one point where Republicans get in their say, giving Democrats more opportunities to be on the record as opposing common sense.

So while it’s true that Jim will “stand up to his own party” on some limited instances where tax increases are too obvious, he gives the game away by voting for each budget. I suppose the question is who is really fighting for the district, and in part two of this post I’ll look into where McDermott is fighting the other side.

Crossing the aisle

While it’s at a point in his career where there’s little political fallout, it’s still interesting to note that retiring Democratic Delegate John Wood, Jr. of St. Mary’s County has endorsed GOP standardbearer Larry Hogan for governor over his own party’s Anthony Brown. The story on TheBayNet.com by Dick Myers notes that Wood also endorsed Bob Ehrlich and has endorsed the Republican seeking to replace him in Annapolis.

Wood is one of the few Democrats who would regularly buck his party in Annapolis, and was a six-time winner of what I called the Top (Blue) Dog Award from the monoblogue Accountability Project. That award goes to “the Democrat who ranks the highest in my ratings, showing signs that there is a small but rarely-seen centrist element to the Maryland Democratic Party. It’s the way the aisle should be crossed.” Wood had a lifetime 46 rating on the mAP, by far the best of any Democrat and slightly better than retiring Republican Robert Costa, who finished with a 44 rating.

It proves that the 15% of Democrats who expressed a preference for Hogan in a recent internal Hogan poll are a legitimate part of the electorate, receptive to the fiscally sound message Hogan is trying to put out. Thar number is clear improvement from a July CBS News/New York Times poll where just 8% of Democratic voters favored Hogan. Obviously given the vast gulf of registration numbers between Democrats and Republicans in Maryland it’s essential that some Democrats like Wood cross the aisle to back Hogan. To buttress that fact, there are dozens of “Democrats for Hogan” stickers available at our headquarters.

So welcome aboard, Delegate Wood. And bring a few other thoughtful souls to our side.

That’s the idea, guys!

I don’t often get praise from the quarters of Red Maryland these days, so I was surprised to see their kind words about my monoblogue Accountability Project last week. They cited it in analyzing the Senate District 4 race between David Brinkley and Michael Hough. As it turns out, I used that race as an example of why it’s needed in certain primaries when I wrote my summary for the mAP.

So let me extend those remarks with a little more research I did. While I’ve done the mAP for seven years, I had never established an average score by party – until I decided to figure it out for 2014 the other night. So when you look at a ballot with a Republican and a Democrat on it – particularly if the Democrat has tried his or her best to convince you they have a streak of conservatism in them – remember these numbers.

On the average, Democrats in the Senate score 8.77 on a 100-point scale while their GOP counterparts average 56.75 – and this year was really, really bad for GOP senators.

In the House, Democrats average just 7.40 while Republicans average a more respectable 71.86. In most years, it’s about where the Senate would be.

So on 25 issues, which I score at 4 points apiece, the average Republican will vote the correct way somewhere between 12 and 16 more times. Granted, there are exceptions, and as a percentage of the vote both parties do somewhat better than their numbers because my overall scores deduct for absences and ducking votes. In general, a Republican gets about 18 to 23 of my 25 votes right.

Here’s another example I could have used from southern Maryland. In District 27C, current Delegate Mark Fisher is paired up with former Delegate Sue Kullen. Since my records now go back eight years, I can (and did) add to my scoresheet her lifetime score of 4, compared to Fisher’s lifetime mark of 84. Out of 25 issues, it’s likely Fisher would vote correctly 20 more times than Kullen would and that makes a huge difference.

In my District 38, the Senate race is between Democrat incumbent Jim Mathias (lifetime Senate score of 28) and Delegate Mike McDermott, with a lifetime 85 score in the House. Who would be better to represent a conservative district?

If you look at the mAP, I have several other examples where comparisons can be made. The point is that there can be a significant difference between candidates, even within their own party. For those with primary decisions to make, my guide can be a useful tool in studying the record of incumbents and working out some general election matchups – even if your candidates have no record, the average “generic” Democrat or Republican should provide a good indicator of how they’ll do.

Announcing: the 2014 monoblogue Accountability Project

For the seventh consecutive year, covering sessions since 2007, I have completed my annual guide to the voting record on key issues from the 188 members of the Maryland General Assembly.

There will also be the sidebar link I maintain for future reference.

This guide not only features the General Assembly’s voting records on specific votes in graphical form for easy comparison, but also my take on the bills they voted on this year. Some of the key votes I cover are those on the state’s budget,expanding pre-kindergarten, various fixes required due to Obamacare, and the “bathroom bill.”

I began this project in 2008 as a continuation of the former Maryland Accountability Project, which was a similar attempt to catalogue legislators’ votes that ended with the 2006 session. (Here is a cached version of its website, which is no longer active.) Over the last eight legislative years I have focused on over 200 votes by the General Assembly. Once committee votes became publicly accessible in 2010 I began adding those as well, giving me a total of more than 400 separate tallies over the life of the mAP. This year I looked at 52 separate votes – 22 floor votes and 30 committee votes, or three from each of the ten voting committees in the General Assembly.

So what can you do with the information?

Well, while the mAP is by its nature reactive because it documents events which occurred in the recent past, we can learn from history. While I can count the number of legislators who have attained a perfect 100 percent rating in any given year’s legislative session(s) on one hand, the sad truth is that Maryland has far too many who score 10 percent or less year after year cluttering up the General Assembly. Our job is to learn who they are and educate the voters of that district as to why their legislators are voting against the interests of the people in the district. That’s why the bulk of the mAP is a summary of why I, as someone who favors liberty, would vote in the way I denote in the report.

On the other hand, there is a group I consider the Legislative All-Stars, those who score 90 percent or above or at least lead their legislative body if none reach 90 percent. (Sadly, this happened this year in the Senate, and that leader is among those retiring.) If the Maryland General Assembly had those legislators as a working majority we could vastly improve our state’s lot in life.

Before I conclude, I want to once again thank someone for her work, a task which perfectly complements the idea of this one but occurs during the legislative session. Elizabeth Myers (who I have interviewed before for my old TQT feature) runs Maryland Legislative Watch, which works during session to determine the merits of each bill and works to keep bad ones from ever getting out of committee. With over 2,500 bills introduced last session, dozens of volunteers are needed to keep track of them all, grade them on pro-liberty merits, and keep the heat on legislators in stopping violations of liberty from proceeding.

Moreover, they cover every vote a legislator makes during session and recently updated the site to provide this information for legislators all the way back to 2005 for Delegates and Senators. It may seem like competition but we actually work together in the respect that MLW provides a lot of raw data and I give context on key issues. The Maryland Legislative Watch data is also useful for showing just how many votes are unanimous and how much of the legislature’s time is devoted to local issues; these are the ones which incumbents generally point with pride at bringing home the bacon.

You can judge for yourselves whether legislators vote the correct way on the issues I present. I simply provide this service to Marylanders as a way of being more aware of how the sausage grinding in Annapolis turned out this year. Methinks there was something rotten in the state of Maryland, now known as the “Fee State.”

Winding down

As I begin to write this, we have about an hour and ten minutes remaining in the 90 days of terror that is the annual Maryland General Assembly session. And because of the Maryland Legislative Watch website, the process of completing my annual monoblogue Accountability Project will be a snap – they’re kind enough to align all the votes taken during session by individual legislator.

So the process of weeding out what I’ll be focusing on has been my task over the last couple weeks. Since I cover 25 different votes, with three of them being committee votes for practically all the legislators (there are three exceptions: Speaker of the House Michael Busch, Senate President Mike Miller, and Delegate Don Dwyer, who was stripped of a committee assignment as punishment for his misdemeanor conviction last year) having them already arranged by legislator is a HUGE help.

Sadly to me, out of the hundreds of votes the General Assembly takes each year, the vast majority are unanimous or have very limited opposition. While there have been occasions I’ve used such exercises in futility for the minority, generally I like to find bills which have a significant number of votes on both sides. Unfortunately, this has eliminated a number of good bills I would have used via what I call the “gutless Senate syndrome” – a bill which may be 96-38 in the House passes 46-0 in the Senate. For example, did you know the state was soon to ban “vaportinis”? (Interesting, since they’re decriminalizing pot in the same session.) It would have been a good vote to use, but our gutless Senate passed it with no opposition. The same went for bills designating new wildlands, financial assistance for so-called “food desert” areas (not “desserts,” by the way), mandating balcony inspections, and several others.

All told, I will probably have 25 to 30 candidates to distill into the final 22 votes – there were a few bills which may have received a vote in their opposite chamber tonight. The “automatics” in this term will be the budget bills, the “bathroom bill”, minimum wage, and the “fix” for individuals who were hosed out of health insurance because the state screwed up. Those were always going to make the cut, even though the Senate vote on the capital budget was 46-0. Talk about gutless!

So when can you look for the monoblogue Accountability Report? I figure it could be done by month’s end.

One change I’ve made from previous editions is that legislators will be arranged into groups based on whether they are retiring, running for higher (or different) office, or trying for another term. Of course, I will still have the Legislative All-Stars and my usual rewards and criticism as well.

The process can go full throttle in less than a half-hour.

A monoblogue year in review

Having a holiday schedule based on Wednesday holidays seems to play havoc with the news cycle, as there’s not much going on with Maryland politics right now. By the time the holiday hangover is done, it’s the weekend.

So over the next four days I’m going to provide for you a look back and look forward. As part of that, tonight’s post will be the look back, with some of the highlights of my political coverage – and a couple other items tossed in for fun as well. This is the first time I’ve tried this, so I’ll see how it goes.

The year began, as it always does, in January. As will be the case even moreso this year, political fundraising was in the news as there was a surprise leader in the gubernatorial money race on the GOP side. Another highlight of the month was a spirited and enlightening discussion of state issues at the Wicomico Society of Patriots meeting – something all too infrequent this year, unfortunately.

But the highlight of the month was my two-part coverage of the Turning the Tides conference in Annapolis. which had a plethora of good speakers and discussion. It was so good I had to post separately on the morning and afternoon events.

In February my attention was turned to several topics, particularly providing coverage of the financing and the events surrounding the Salisbury municipal elections, for which the primary was February 26th. A key issue brought up was a state mandate for the city to help pay for cleanup of Chesapeake Bay, to the tune of $19 million a year.

Another state mandate took center stage in February, as the Wicomico County Council held a Tier Map forum to find out citizens weren’t exactly enamored with the idea. As part of that I read from my written testimony on a Tier Map repeal bill, which wasn’t the only testimony I wrote – I also put in my two cents on the gun grab bill.

We also found out that month that the Maryland GOP would get new leadership following the resignation of Chair Alex Mooney.

March found me continuing my coverage of the Salisbury city elections, but only backing one candidate. More important were local developments on the state level, where the Second Amendment was a hot topic for a local townhall meeting and our county’s Lincoln Day Dinner.

But the highlight for me, by far, was my day at CPAC. That turned out to be a two-part set of posts.

As the area began to wake up from a winter slumber in April, so did the political world as it turned from the General Assembly session to the 2014 campaign. The Salisbury city elections went as expected, so I turned my attention to the race for state party chair. Interim Chair Diana Waterman ran a campaign which was at times embroiled in some controversy, but prevailed on enough supporters to make it through the lengthy grind of campaign forums (including one in Cambridge on the eve of the state convention) and win the remainder of Alex Mooney’s unexpired term. But even the convention itself had its share of ups and downs, particularly a chaotic ending and a rebuff to new media.

While that was happening, the 2014 election was beginning to take shape, with familiar names both trying their luck again and trying for a promotion. Others had interesting endorsements as feathers in the cap.

But it wasn’t all political in April. The outdoor season began with two local mainstays: Pork in the Park and the Salisbury Festival. I also found out I was immortalized on video thanks to Peter Ingemi, better known as DaTechGuy.

Those things political slowed down in May, with just a little reactionary cleanup to the state convention to begin the month, along with other reaction to the recently-completed General Assembly session. In its wake we also had turnover in Maryland House of Delegates GOP leadership.

But one prospective candidate for governor announced other intentions, leaving another to confirm what we knew all along.

On the fun side, I enjoyed Salisbury’s Third Friday celebration with some friends and stopped by to see them at another barbecue festival, too.

June began with a visit from gubernatorial candidate David Craig, who stopped by Salisbury and in the process gave me an interview. And while he didn’t make a formal tour, fellow Republican Ron George made sure to fill me in on his announcement and establish tax cutting bonafides. We also picked up a Republican candidate for an important local seat and found out political correctness pays in the Maryland business world.

A local doctor gave us his perspective on Obamacare and our area celebrated the chicken in June, too. I also learned of a special honor only a handful of political websites received.

As is often the case, our wallets became a little lighter in July. In the aftermath, we found out who David Craig picked as a running mate and welcomed both of them to our Wicomico County Republican Club meeting. I also talked about another who was amassing a support base but hadn’t made definite 2014 plans at the time.

On the other side of the coin, we found the Democratic field was pressing farther away from the center, a place the GOP was trying to court with the carrot of primary voting. Meanwhile, the political event of the summer occurred in Crisfield, and I was there.

There were some interesting developments in the new media world as well – a plea for help, a shakeup in local internet radio, and my annual monoblogue Accountability Project all came down in July.

The big news in August was the resignation of State Senator E.J. Pipkin, and the battle to succeed him. And while one gubernatorial candidate dropped out, another made his intentions formal and stopped by our Wicomico County Republican Club meeting as well. Even Ron George stopped by our fair county, although I missed him.

It seemed like the gubernatorial campaign got into full swing in September – Charles Lollar announced in an unusual location, the Brown/Ulman Democratic team came here looking for money, Ron George tangled with Texas governor Rick Perry and showed up to make it three Wicomico County Republican Club meetings in a row with a gubernatorial candidate, and Doug Gansler decided to drop by, too. On the other side, Michael Steele took a pass. I also talked about what Larry Hogan might do to fill out the puzzle.

Those up the Shore made news, too. Steve Hershey was the survivor who was appointed State Senator, and I attended the First District Bull Roast for the first time. I’ve been to many Wicomico County Republican Club Crab Feasts, but this year’s was very successful indeed.

September also brought the close of our local baseball season. As is tradition I reviewed the season, both to select a Shorebird of the Year and hopefully improve the fan experience.

October was a month I began considering my choice in the gubernatorial race. That became more difficult as Larry Hogan took an unusual trip for a businessman and Charles Lollar’s campaign worked on self-immolation, while Doug Gansler needed his own damage control.

I also had the thought of going back to the future in Maryland, but a heavy dose of my political involvement came with the tradtional closing events to our tourist season, the Good Beer Festival and Autumn Wine Festival.

Most of November was spent anticipating the Maryland GOP Fall Convention; in fact, many were sure of an impending announcement. Honestly, both may have fallen into the category of “dud.” But all was not lost, as the month gave me the chance to expound on manufacturing and share some interesting polling data.

Finally we come to December. While the month is a long runup to the Christmas holiday, I got the chance to again expound on manufacturing and come up with another radical idea for change. We also got more proof that our state government is up for sale and those who are running for governor place too much stock in internet polling. My choice is still up in the air, even after compiling an 11-part dossier on the Republicans currently in the race.

Locally, we found a good candidate to unseat a long-time incumbent who has long ago outlived his political usefulness. And the incumbent will need to watch his back because Maryland Legislative Watch will be back again to keep an eye on him and his cohorts. I’ll be volunteering for a second year,

And while I weighed in on the latest national diversion from the dreary record of our President and his party, I maintained two December traditions, remarking on eight years of monoblogue and days later inducting two new players into the Shorebird of the Week Hall of Fame.

You know, it was fun going down memory lane for 2013. But tomorrow it will be time to look forward, beginning with the local level.
