For the tenth year in a row, I have graded all 188 legislators in the Maryland General Assembly based on their voting patterns on a number of key issues. Beginning with sine die back in April, I started looking into both floor and committee votes trying to find those which reflected conservative principles, with an eye on civil liberties as well. The final product, all 27 pages, can be found right here or in its usual sidebar location.
You’ll notice the look is a little different this year, as I decided to scrap the old two-column format and just give it more of a standard form that’s easier to read. I also changed the font to something a little more stylistic. On the charts themselves, I decided to eliminate the committee votes from the main chart and instead added two new pages for those votes so that all of the legislators on the committee can be more directly compared.
As for the votes themselves, the overriding theme to me was fiscal. Democrats don’t like not being in the governor’s chair to spend money, so they are trying to use their legislative majority to force Governor Hogan to spend more. To the majority, there are two advantages to this approach: not only can they give handouts to favored constituencies, but they can prevent Hogan from finding the savings he can use to cut taxes and fees. Their goal seems to be putting our governor in a position where he has to raise taxes, which is music to the ears of people like Mike Miller and Michael Busch.
So you’ll notice quite a few floor votes deal with these sort of mandates. There are also quite a few intended to strip power from the Executive Branch (which wasn’t an issue just two short years ago) and tie the hands of businesses because government needs something to justify its existence.
I note in the conclusion that there were far fewer correct votes this year, and a large part of that was the mix of bills I selected. Last year I had an average House score of 39.82 and Senate count of 41.15. This was because a lot of Democrats got scores in the 20s, and that was based on their support for marijuana and civil liberties legislation I favored. This year, not so much as the averages plummeted to 27.1 in the House and 23.26 in the Senate. Being a more hardline fiscal conservative this year (because they addressed the issues they were with me on last year) changed a lot of Democratic scores from 24 to a big fat zero. On the other hand, I had only seen two perfect scores in nine previous years but got two in one session this year for the first time.
I’ve been warned that the third year of the cycle is always the most ambitious for policy, although liberals are dangerous any year. There are a few things that were stopped this year that we will surely see in 2017, such as paid sick leave. I also expect a bid to extend the fracking moratorium as part of a broad environmental package – the wackos were strangely quiet this year but I think 2017 brings some interim deadlines and reports on Bay cleanup. Add in the trend to mandate more spending and 2017 will be an interesting time.
One final change comes in the sidebar. I’m leaving the 2015 report available as part of a long-term process to show trends for the 2015-18 term. As one example, I think the candidacies of Kathy Szeliga and David Vogt affected their voting patterns – you’ll be able to judge for yourself now.

The fact that Memorial Day occurs on a somewhat rare fifth Monday of the month this year provided the WCRC with an “extra” meeting this year, and they took advantage by scheduling something that’s becoming a tradition: the annual Legislative Wrapup. All six Republican members of our local delegation (from Districts 37 and 38) were invited – but thanks to a number of calendar conflicts, only two of them came. It was ladies’ night for the delegation as Delegate Mary Beth Carozza and Senator Addie Eckardt gave their accounts of the recently completed session. (Delegate Chris Adams made the attempt to stop by, but came just after we wrapped up.)
So once we did our usual Lord’s Prayer, Pledge of Allegiance, and introduction of distinguished guests, Eckardt got the meeting underway by praising the state’s $42 billion budget, which needed no new taxes for balance. The reason for this was that the Hogan cabinet was finding more efficiencies in their respective departments, enabling the state to become more business-friendly. One way they were doing this was through fee reduction, although Eckardt noted that some Democrats were fretting that fees were getting too low. Yet the budget allowed for a reduction in the structural deficit and did not feature a BRFA, the omnibus bill where spending mandates are often buried. This year’s spending had “full transparency,” said Addie.
But the push to reduce taxation was one goal of the Augustine Commission, explained Addie. Sadly, the broader tax reform package could not pass thanks to the question of passing a package mandating expanded paid sick leave - despite the fact changes to the earned income tax credit would have helped thousands of working Maryland families that I thought the majority party deigned to represent.
On the other side of that Augustine coin, Addie continued, was the idea of being responsive to constituents; to “change the tenor of government.” This went with a drive to bring things to the county level, as Addie noted “local control is important to me.”
One complaint Eckardt had about the session was the “crusade to get the Red Line back.” It led to the passage of what’s known as the “Maryland Open Transportation Investment Decision Act of 2016.” (I call it the “Revenge for Not Funding the Red Line in Baltimore” Act.) While the bill overall is terrible, Eckardt noted it was amended somewhat to give local jurisdictions a little more priority.
And while she was pleased Wicomico County would be receiving an additional $8.7 million from the state for various projects, Addie was more passionate about a series of initiatives to bolster mental health and combat addiction around the state. She was also happy to see the Justice Reinvestment Act pass, which was a bipartisan effort at criminal justice reform. The state was also doing more to address mental and behavioral health, particularly since she claimed later in the evening it took someone who was addicted and incarcerated two years to re-integrate fully. This led to a discussion about what the state and local governments were doing to deal with the issue of homelessness, to which Muir Boda revealed the city of Salisbury would be embarking on a Housing First program modeled after one in the state of Utah.
Between Eckardt’s main presentation and the later discussion about mental and behavioral health issues, we heard Delegate Carozza’s perspective. She began by praising the club for being a group of workers and doers when it came to advocacy, with the optimistic view that “this is our time…Governor Hogan is turning the state around.” But that was a process which would take at least eight years, said Mary Beth. As an aside, she also believed that Kathy Szeliga was “the candidate that can win” the U.S. Senate seat, which would also lay the groundwork for Larry Hogan’s re-election campaign.
Both she and Eckardt, added Carozza, were in the position to support the budget thanks to their respective committees. They could succeed making suggestions for “walling off” funds for supplemental budget proposals, of which there were two or three each year. And while this budget allowed for what Carozza termed “a well-rounded tax package,” only a minor tax break for Northrop Grumman made it through. But the “good news” out of that was that it was making Mike Busch and Mike Miller talk about tax relief, making it a stronger possibility we may see some in 2017.
As for some of her priorities, Carozza was happy to see the bomb threat bill she sponsored make it through the General Assembly in its second try. (A similar proposal was introduced by then-Delegate Mike McDermott in 2013, said Mary Beth.) She commented about how the broad community support, combined with the “sense of urgency” provided by a series of bomb threats making the news earlier this year, allowed the bill to pass easily. Another bill she was happy to shepherd through was the ABLE bill, which allows the disabled to save money for dealing with their medical-related expenses without jeopardizing their means-tested benefits.
She also stressed that killing bad bills was a part of the job as well, citing the defeat of the poultry litter and “farmer’s rights” bills where she praised Delegates Carl Anderton and Charles Otto as they “led the charge” against those measures. Mary Beth also took the unusual step of personally testifying against the assisted suicide bill and worked to amend the sick leave bill to exempt more seasonal employees. On that bill, she predicted “we’re going to see it again next session.”
Even after hearing all that information, we had some business to do, like the treasurer’s report and Central Committee report that Dave Parker delivered. He called the recent state convention the “get over it, people” convention, noting the party seemed pretty well unified afterward. Even local radio host Don Rush had difficulty finding disunity among a group of Republicans who were his guests last Friday, Parker added. On the other hand, “Hillary can’t close the deal” on the Democratic side.
I added my two cents about the convention to his report, pointing out the National Committeeman race was perhaps the biggest bone of contention and that was relatively minor. But the Fall Convention may be interesting because we will be electing a new Chair, and the question is whether it will be someone who will work more for Larry Hogan’s re-election or to bolster the GOP numbers in the General Assembly. A Hogan win, I added, would make redistricting the key focus for the second term – personally, I think we should strive for single-member districts and Eckardt agreed based on its impact to minorities.
Shelli Neal updated us on the Greater Wicomico Republican Women, who would be holding their next meeting June 16 at Adam’s Taphouse. They had two tickets to the Tawes Crab and Clam Bake in Crisfield to raffle off as part of a membership meeting for the newly-christened organization.
Another fairly new creation was the Wicomico Teenage Republicans, which had “a great start of a club” according to Nate Sansom. While their next meeting was slated for this coming Friday, they planned on taking a summer break and reconvening in August once school started back up. With a group of “passionate people, happy to be involved,” Sansom believed his group would focus on statewide campaigns like Kathy Szeliga’s as well as the local We Decide Wicomico campaign for an elected school board.
Representing the statewide College Republicans, their Chair Patty Miller was hoping to reach each county Central Committee at one of their meetings over the next few months and “see what they need from us.” Her first stop will be this week in Calvert County.
Jim Jester reminded us the Crab Feast would be September 10, but stressed the need for more volunteers – particularly to handle admissions and the silent auction.
Shawn Jester pointed out the WCRC Scholarship winners had a brief story in the Daily Times. But, since the subject was volunteering, he was also looking for people to help out at Third Friday, which we missed this month because no one was available. On that note, a signup sheet was passed around. (We will also need help for upcoming events such as the Wicomico County Fair, Good Beer Festival, and Autumn Wine Festival.)
After all that discussion, and seeing that we had a legislative update where the topic wasn’t addressed, I added one thing to the conversation. General Assembly Democrats sponsored a large number of bills this year that mandated spending. To me, this is an effort to handcuff Larry Hogan when it comes to budgeting but also leaves less room for tax reform. Many of these bills may become law without Hogan’s signature, but they will be law just the same. It’s an issue that I think needs a strategy to address, perhaps a reverse BRFA to eliminate mandates.
We are going to try and get the guys who didn’t show up this month to come to our June meeting, so stay tuned. It will be June 27.
This time we meant it. After having a last-minute meeting called last month, a little planning made this month’s meeting go a long way. It got off to an unusual beginning as the Jaycees meeting in the next room joined us for the Pledge of Allegiance before we went solo on the Lord’s Prayer. (Usually we do this in reverse – as a former WCRC president once said, God before country. I think that it was the late George Ossman who introduced that tradition.)
The meeting was jam-packed with information because we had two speakers. It was suggested to us that we have Anthony Gutierrez from the Board of Elections in to go over the new paper-ballot voting machines we will be using, so he led off the evening with a pair of short videos explaining how they will work. For early voting there will be one ADA unit (which is slightly enhanced for those who are physically impaired but can be used by anyone) and two optical scanner units. Filling out a paper ballot is like filling out the standardized tests you had in school except you fill the circle in with an ink pen.
There were a few other election notes he passed along, including the fact that over 10,000 Wicomico voters will not be participating in April’s primary because they are unaffiliated. (This is out of about 58,000 total.) Gutierrez noted as well that the last Presidential primary with no incumbent (2008) had 48.9% for a February primary, but he predicted April’s turnout would be more like 35-40%. There will be five separate races on the ballot, he added: President, U.S. Senate, Congressional representative, and delegates/alternate delegates to the national convention. Voters will be sent their specimen ballots the Monday before early voting begins.
Mark McIver of the Central Committee asked whether more election judges were needed, and Gutierrez said they were fine for the primary. But he encouraged those interested to apply anyway for November and to be backups in case they have a need in April. Compensation for the day is $250.
Another question about same-day registration came up, and Anthony replied that it would be effective only for early voting. Some voters who had MVA information in the system would be “precleared,” he added.
I asked if the new machines would result in delays, but Gutierrez noted from the experience he had with observing these machines in other elections that the process was actually faster. They would use the primary to make adjustments for the larger turnout in November, he added.
Once Gutierrez wrapped up, our other featured speaker began. Having served as the co-chair of the Redistricting Reform Commission (RRC), Walter Olson came to speak about Maryland’s gerrymandering and the commission set up to suggest improved voting districts. Legislation to create a non-partisan redistricting body was introduced earlier this session, with hearings next week in both the House and Senate.
“I think we’ve got to end the practice of drawing our congressional districts so that politicians can pick their voters and not the other way around.” Those weren’t the words of Walter Olson; it’s a quote from the most recent State of the Union speech Barack Obama delivered. He also made the point in Illinois during a recent appearance there, said Olson. Moreover, 70 percent of Maryland residents would prefer an independent commission, which is fitting: since North Carolina’s gerrymandering (considered the worst in the country) was struck down in court, the new number one worst was the great state of Maryland.
With the recalcitrant Democrats being placed in an uncomfortable position of being against both their president and the voting public – as Olson pointed out, ”they’re not happy with what we’re doing” - their only response was to complain that five hearings around the state weren’t enough. And “did we ever get an earful” at the hearings, said Walter. Districts were created not to fairly represent, but “to reward and punish” legislators. Olson handed out a chart that clearly showed how the system was exploited: all but 6 Republicans represent districts with larger-than-average population, while Democrats represent all but one of the smallest 25 districts. (The one Republican who represents a small district won election in 2014 over an incumbent Democrat.) Needless to say, Mike Miller and Michael Busch are “not enthusiastic” about this proposed change, even though it’s been debated off and on over the last half-century.
The RRC was an 11-member commission, with seven selected by Governor Hogan (3 from each party, plus one unaffiliated) and two from both the House and Senate, one from each party. Their report of suggestions were based mainly on those adopted by California, with some tweaking to fit our Constitution. The report was adopted by a 9-2 vote, and you can imagine which party had the two and where they came from to serve on the RRC. The legislation introduced on Hogan’s behalf has “most of” the recommendations, Olson added.
What the RRC asked for was stronger criteria for population, with just a 1% variation. Districts had to comply with the Voting Rights Act, of course, but also needed to be congruent, contiguous, and compact. No more “blood splatters at a crime scene,” as Olson described Maryland’s Third Congressional District.
The redistricting body itself was intriguing to me. Applicants would be screened to make sure they weren’t connected to the process as members of the legislature, their families, etc. After that, they would be placed into groups representing each of the two principal parties and unaffiliated/minor party voters, those who hadn’t switched registration recently. Out of 10 applicants in each pool (Republican, Democrat, unaffiliated) selected based on these criteria, three of them would be randomly chosen to serve on the body, with the chair chosen out of the three unaffiliated members.
But the cool part was that anyone could submit a map. Olson said that Pennsylvania’s map, which replaced a gerrymandered original done by the legislature, was done by a piano tuner who submitted a map which best complied with the requirements.
In the question-and-answer period, Olson stressed that the redistricting body would do both Congressional and state legislative districts. But it likely wouldn’t be pressed into service until after the next census because it was unlikely the system in place now would be overturned unless it was found to be a Voting Rights Act violation. A suit by Judicial Watch regarding Maryland’s gerrymandering was “somewhat of a long shot” to succeed, assessed Olson.
Walter also was careful to add that, while he works at the Cato Institute, the Institute is not involved with this. He was doing this as a private citizen.
Finally, we got to club business. The treasurer’s report was given by Muir Boda, who has stepped in to become treasurer since the previous officeholder had to resign to take a job across the Bay. We are working out kinks in the accounts since they were based on her e-mail.
Mark McIver reported for the Central Committee. After a moment of silence for Blan Harcum, we learned his funeral will be Saturday, March 5 at Holloway Funeral Home, with visitation the evening before. He also related that he testified for the elected school board bill, which has now passed the full Senate (with a clean sweep 47-0 vote, by the way.)
Julie Brewington, speaking on behalf of the Ted Cruz presidential campaign as its Lower Shore coordinator, announced she had county chairs in each of her counties and was seeking sign locations along U.S. 50.
I made a motion to clean up some business so we could have our officer elections, and all five officers were nominated and elected by acclamation. I’m going to use Julie Brewington’s photo here. (She posted it on social media last night, so she gets the credit.)

We found out from Jackie Wellfonder that the Ehrlich book-signing was rescheduled for Friday, March 11 and relocated to the lobby of the City Center building, adjacent to Roadie Joe’s. She was hoping to coordinate with the College Republican event that has to be similarly rescheduled, but the date didn’t work with SU.
Woody Willing reminded us the WCRC Scholarship was still available, but the deadline was fast approaching (March 1.) Graduating seniors from any Wicomico County school (public, private, or homeschooled) are eligible provided they complete the application process. I asked if the application could be put online.
Willing also asked if we could make our annual YMCA donation, which was met with the club’s approval.
Julie Brewington returned to announce the Republican Women of Wicomico would next meet March 2, with Mitzi Perdue as the speaker.
Joe Ollinger and John Palmer gave us some news about the Wicomico Board of Education, which was getting deeper into its superintendent search. They should be close to selecting the next time we meet, said Ollinger. Various focus groups comprised of about 75 people total were considering the applicants, added Palmer. John also said we were “on track” to getting Board of Education meetings on PAC14.
Nate Sansom updated us on the Teenage Republicans, which would have their first meeting March 4 at the Centre of Salisbury library branch. This led to Patty Miller being asked to fill us in on the SU College Republicans, which are having a fundraiser at the Greene Turtle March 21 and are “working on some big things.”
Matt Maciarello updated us briefly on legislation he was interested in, adding the Eastern Shore delegation is “working so hard” on these items. Included in his assessment was the bomb threat prosecution bill sponsored by Mary Beth Carozza as well as a bill dealing with sex offenders.
As you can tell, it was a meeting full of information that we somehow crammed into about 90 minutes. Our next gathering will be March 28, with U.S. Senate candidate Dave Wallace the first statewide candidate to stop by one of our meetings since 2013.
Surely you follow my site and know that each year, once the General Assembly session is over, I compile the monoblogue Accountability Project. Last year I believe I mentioned that some of the bills that I tracked were vetoed by Larry Hogan but would likely be revisited by this year’s group – sure enough, the “travel tax” was passed for a second time despite the efforts of every Republican who stood behind his or her governor. Even Senator Addie Eckardt, who co-sponsored the original bill, voted to sustain the veto.
That was one of the two bills I used for last year’s mAP. The other bill, which allows felons to vote before completing their sentences (as parole and probation are part of the sentence) has not received a veto vote yet. According to the Maryland House Republican Caucus, the reason why is that Mike Miller is one vote short and waiting for an appointee to replace former Senator Karen Montgomery, who resigned effective January 1. Given the fact Democrats hold a 32-14 edge and will get the 33rd vote when Montgomery is replaced, it appears four Democrats are feeling the pressure to stand with the governor. (If I were to guess I would say three of those four are John Astle, Jim Brochin, and Jim Mathias. They tend to be the most willing to cross the aisle in the Senate and represent conservative districts.)
Assuming the Senate gets that vote – and it won’t happen if Miller can’t rustle up the votes – that will be 2 of my 25 votes. I’m debating whether to eliminate one committee vote and one floor vote or two floor votes to accommodate these veto votes – it may depend on what else shakes out.
The felon voting override was particularly galling because it made it by one vote, and the one member of the Eastern Shore delegation who voted to override should have known better. Perhaps a “soft on crime” label will come in handy in four years because Delegate Sheree Sample-Hughes won’t have an incumbent to protect her next time. It was an office that should never have received the free ride she got in 2014.
Next week’s assignment will be to get testimony in favor of our elected school board bill. Those of us who do honest work for a living can’t drop everything and go to Annapolis, but I will make it a point to write up my own statement of support. The hope is that the bill emerges unmolested and we get to decide how we want our school board to be come November.
At 12:01 on Tuesday morning, the Maryland Democratic Party probably had a collective conniption when they found out how much damage they would have to do to Larry Hogan over the next three years in order to get “their” governor’s chair back.
That was the moment that the latest Gonzales Research Maryland Poll came off its embargo and revealed two key points that probably keep whoever is in charge of that party awake at night. In a state which features voter registration numbers 2-to-1 in their favor, even a plurality of Democrats think Republican Larry Hogan is doing a good job. (If five more Democrats had stated in the affirmative there would have a majority – as it was, 48% is a good number.) Meanwhile, 52% of those same Democrats think the state is heading in the right direction.
Overall, a whopping 67 percent of respondents approved either somewhat or strongly the job Larry Hogan is doing as governor, with a paltry 19 percent disapproving. While the margin is only 48-31 as far as Democrats are concerned, it’s that same coalition that propelled him to the governorship.
Yet the Democrats have played with fire a little bit by overriding several of Governor Hogan’s vetoes. It seems to be their priority to make life more difficult (and taxing) for travel agents and allowing felons to vote prior to completing their sentences. The ball will now be in Hogan’s court for his legislative agenda, which didn’t really fare all that well last year.
It’s obvious people like the job Larry is doing, so maybe he needs to get a little more of a bully pulpit. Imagine what his approval could reach if he got a little more Reaganesque with his tax cut proposals. Let’s make Mike and Mike (Busch and Miller) look like the obstructionists they are. I don’t want to predict we can bury the Democrats face down come 2018, but they do deserve a few shovelfuls of dirt for the damage they did to the state over the term of the guy who gets a pathetic 4.5% of the Maryland Democratic presidential primary vote.
Several months ago I told you about the “travel tax,” which has come up in the news again because Mike Miller believes he has the Senate votes to overturn Governor Hogan’s veto and the Maryland Chamber of Commerce is behind it. Indeed, there’s a post on what’s billed as Maryland’s premier conservative website regarding this but I was stymied in reading it by some scam invitation to get a free iPhone 6 – and probably all the malware I can unknowingly download. I’ll come back to that in due course; in the meantime I will fill you in on what is really happening.
My local Delegates are telling me they predict a bumper crop of legislation, and they may be correct – as of this afternoon, 180 bills had already been pre-filed, with 114 Senate bills complementing 66 in the House. (My, my, those Senators are busy beavers.) One bill I did not see among them was the Wicomico elected school board bill, which I would have liked to see pre-filed. Unfortunately, I think that time has passed.
Even with all that work stacking up it’s likely the first things the body will take up are overriding vetoes, with my interest coming from two bills I used for the 2015 monoblogue Accountability Project: SB340 (voting rights for felons) and SB190, the travel tax. Both passed with veto-proof margins in the Senate but neither had a comfortable enough House win – for an override the felon bill would need to pick up three votes and the travel tax one.
That one vote for the travel tax may come down to newly-minted Delegate Elizabeth Proctor, whose late husband James died in office earlier this year. James Proctor was the lone absent Delegate when the travel tax passed 84-56. Another new Delegate, Carlo Sanchez, replaced former Delegate Will Campos, who resigned after being a “yes” vote on both bills in question. As for felon voting, Proctor was absent while Delegates Michael Jackson and C.T. Wilson ducked the vote. In both cases, should opponents hold all their votes and pick up one the vetoes will stand. (Out of our local delegation it was the only Democrat delegate, Sheree Sample-Hughes, who predictably voted in favor of both.)
You’ll notice I basically ignored the Senate in both cases because all they need is the same vote they had the first time to override both vetoes – for the record, both our local Senators voted against felon voting but both favored the travel tax. So it wasn’t really news that Miller had his votes, nor was it groundbreaking to see the state Chamber of Commerce side with big business over entrepreneurs. It’s akin to the struggle between Uber and local taxi companies; oftentimes the Chamber backs the rent-seekers.
Now about that other website: it’s so funny because I used them as an example the other day. Apparently they have chosen to cast their lot with the clickbaiters of the world in the quest for advertising dollars. Self-promotion is one thing - and Lord knows all of us would like advertisers – but the ad was such that I literally could not close it, for a site which had all the red flags of being a virus-laden website. I have to question the integrity and wisdom of a site which uses those techniques.
Perhaps I’m not the biggest or best site around, nor is it lucrative for me in a monetary sense. But just remember – I’m not the one knocking you over the head with the annoying pop-up ads. All I have is a little tip jar and an Amazon affiliation, so if you get an Amazon gift card Friday hook yourself up through me.
More importantly, after the holidays it may be a good idea to ask your legislators where they stand on the travel tax (as well as felon voting.) Contrary to popular belief, it hasn’t been all fee and toll decreases since Hogan took office – if he were a purist he would have vetoed two other House bills which increased certain court fees. But encouraging entrepreneurship and making sure felons pay their entire debt to society before regaining their franchise should be no-brainers, shouldn’t they? There’s a reason a governor has a veto pen, so let him be the check and balance to an overreaching General Assembly.
So now that you know where I was on Election Night (thanks to Muir Boda) let me shine some light on our party. I’m the guy in the McDermott shirt; hopefully it wasn’t a jinx.
Unlike a lot of elections past, I did not work a poll. My outside job had tasks which a) had to be covered Tuesday and b) were up in Dover. I didn’t even get home until almost 8:00; fortunately knowing this a couple weeks in advance I could hold my nose and vote early.
Since I wanted a table to write notes on I sat next to Dr. Rene Desmarais, who has admirably remained in the fray despite his primary election loss. I hope the Hogan administration can use his health care expertise. He’s the guy at the laptop in the checkered shirt.
Taking my seat for a few minutes was Mike McDermott, who was anxiously looking at results and drawing attention.
Mike didn’t stay all that long. I figure he went home to see his supporters and share the bad news with them, since it was obvious from the get-go he wasn’t doing all that well. It turned out that Wicomico was the only one of the three counties Mike won, and it’s a margin which is pending absentees. The difference between Michael James in 2010 and Mike in 2014 seems to be that McDermott did poorly in Somerset County, which James carried but Mike lost by almost 700 votes.
Obviously there were a lot of people who craved information. Bob Culver (center, in white) and Joe Holloway (right) were awaiting results.
As it turned out, Culver erased a slight early voting disadvantage to rout incumbent County Executive Rick Pollitt by almost 3,000 votes, with just under 56% all told. Holloway had much less to worry about as his Democratic opponent withdrew after the primary and was not replaced by the local party.
The two pictured there were the conservative backbone of the local County Council, and hopefully two newcomers are going to maintain the proper direction.
Larry Dodd (in the arm sling) and Marc Kilmer are two of the three “new” Republican members of County Council, although Dodd represented District 5 for 4 years before Joe Holloway defeated him in the 2006 primary. Similarly, John Cannon left County Council after one term in 2010 to run unsuccessfully for a seat in the House of Delegates before winning again last night. Thus, Marc Kilmer is one of just two “new” County Council members; the other being lone Democrat Ernest Davis, who was unopposed for the District 1 seat.
As it turned out, County Council maintained its 6-1 Republican edge. But there are definite things to look out for, as two of those Republicans openly backed Rick Pollitt for County Executive.
I don’t think Matt Holloway or John Hall will be opposed to the elected school board Republicans in Wicomico County have sought for years, only to be thwarted by Rick Pollitt and (especially) Norm Conway. Both those obstacles are no more; to his credit Jim Mathias has been supportive of the idea in the past and a Senate bill for the elected school board passed there in 2011. (Conway sponsored a House bill that passed in 2011, but did not in 2012 – nor did a Senate bill that year. No action was taken in 2013 or 2014.)
But Pollitt was quick to point out in debates and forums that four of the six Republicans voted for his latest budget. Two of them, Gail Bartkovich and Stevie Prettyman, did not seek another term, but Matt Holloway and John Hall were the other two. Beginning with the FY2016 budget, it may be a battle to get four votes on County Council if Matt Holloway and Hall maintain their big-spending ways.
I would also love to see the county’s speed cameras become a thing of the past, as Culver was the lone voice of reason to vote against their adoption. It’s called excising that line item from the budget.
The party itself was relatively well-attended, although I’m certain some candidates had their own gatherings. At its peak there were probably 50-60 people in the house.
But while the news was good on the county front, there’s no doubt the star of the show was one Carl Anderton, Jr.
At 9:45 Bunky Luffman, Anderton’s campaign manager, sidled up to me and predicted, “I think we’ve got it.” He explained a particular precinct where they were hoping to get 30% of the vote came in down by just 89 votes.
Anderton’s win, though, was just the tip of the iceberg. A lot of Titanic Democrats went down last night (with lifetime monoblogue Accountability Project scores shown):
- After six terms, longtime Blue Dog Democrat Delegate Kevin Kelly in District 1B (mAP = 40) lost to Jason Buckel.
- Delegate John Donoghue (mAP = 9), also a 24-year veteran, was ousted in District 2B by Brett Wilson.
- In District 6, 9-year incumbent Delegate John Olszewski, Jr. (mAP = 16) lost his bid for the Senate seat held for 48 years by Norman Stone, Jr. (mAP = 28). Three-term Delegate Michael Weir, Jr. (mAP = 28) was also knocked off.
- Longtime District 29 Senator (and onetime Congressman) Roy Dyson (mAP = 26) lost his bid for a sixth term to Steve Waugh. In that same district, 15-year veteran John Bohanon (mAP = 6) trails Deb Rey by 115 votes with absentees to count.
- District 34′s Senate seat stayed in GOP hands as Bob Cassilly defeated Delegate Mary-Dulany James (mAP =14), who leaves after 16 years.
- In District 35A, 20-year incumbent David Rudolph (mAP = 17) lost to Kevin Hornberger.
- And we know about 28-year incumbent and committee Chair Norm Conway (mAP = 6) who lost to Anderton.
Most of the damage, though, came from the ranks of “moderate” Democrats. According to the monoblogue Accountability Project, these were the top 10 Democrats and here’s how they did.
- Delegate John Wood, Jr. – retired, endorsed Larry Hogan.
- Delegate Kevin Kelly – lost re-election.
- Delegate Joseph “Sonny” Minnick – retired.
- Senator Norman Stone – retired.
- Delegate Michael Weir, Jr. – lost re-election.
- Senator James DeGrange – won with 59% of vote.
- Senator Jim Mathias – won with 52% of vote.
- Senator Roy Dyson – lost re-election.
- Senator John Astle – won with 51% of the vote.
- Senator James Brochin – won with 52% of the vote.
Six out of the 10 won’t be back and only one of the remaining four won convincingly. Not knowing how most of those who defeated these incumbents will vote, the chances are the divide between the two parties will become more pronounced. Only a couple hardline Democrats (those 10 or less on the mAP) were losers last night, while McDermott was the only Republican to lose in the general election. In the respect that Democrats managed to get rid of two perpetual thorns in their side through redistricting (Mike McDermott and Don Dwyer) it was a success, but the GOP still picked up more seats than they did before the new districts were drawn in 2010.
So the stage is set for what should be a very intriguing (and hopefully, prosperous for this county and state) four-year term.
Finally, I want to go through a little of my thinking on these races. I was perhaps less optimistic than most about the outcomes because I figured Democratic turnout would be about where it was four years ago. But as it happens, turnout is going to be about 46%, which is a significant decline from the 54% posted in 2010. If the Democratic turnout followed that pattern it was about 10% less than I figured it would be, and those that were passionate enough to show up may likely have cast a number of votes for the GOP.
Simply put, the Democratic base didn’t show up. Whether it was disillusionment with the candidates or just a general apathy, it looks like the GOP filled the void, to the benefit of the state.
After it was all over, I spoke a little bit with David Warren, who came down here to run the Eastern Shore Victory Headquarters.
He pointed out two key factors that led to Hogan’s win: money from the RNC and Republican Governor’s Association, and the help – both financially and in volunteers – from the College Republicans, from the national level to all the phone calls made by the local Salisbury University CRs. “Teenagers and college kids get it,” said Warren.
David also praised the work of state party Chair Diana Waterman and Executive Director Joe Cluster, saying “what they did was phenomenal.” Similar praise was heaped by Warren onto Andy Harris, who put a lot of money into these local races and helped level the playing field.
Finally, I have one more statement. Eight years ago, it was said that:
(GOP leaders are) “going to be flying high, but we’re going to get together and we’re going to shoot them down. We’re going to bury them face down in the ground, and it’ll be 10 years before they crawl out again.”
I think we’re two years early, Mike Miller. Suck on that.
I’ve been seeing some comment about a blog post recently penned by outgoing Delegate Michael Smigiel regarding the Maryland GOP not assisting Mike McDermott in his Maryland Senate run against Jim Mathias. There are two damning allegations therein, so I’ll speak to both.
First, we have the financial angle:
The Republican Party found it possible just two years ago to support three Republicans running for local county council seats to the tune of $40,000 in a Cecil County race! Now in a pivotal State Senate Race they can not offer the same support? Correct that, they can not offer any support? Even if the party claims financial inability, where are the dollars from Congressman Harris who two years ago gave $40,000 to the party to help those local candidates? Where is the help from the State Senators who have no challengers in their races but have tens of thousands of dollars in their war chests?
I know Smigiel has some sour grapes against certain Cecil County Republicans, but a quick check of campaign finance records finds only a few thousand dollars in contributions to these candidates from the local Republican club and Central Committee – nowhere near $40,000.
As for Andy Harris, he’s already assisted Delegate candidate Carl Anderton (as have others) and it may be he’s going to chip into McDermott’s cause as well.
But the last sentence of Smigiel’s is a valid question, particularly in light of his next paragraphs.
Republican State Senators have been told by the Democrat Senate President, “If you get in the McDermott v. Mathias race, you will be punished.” So Republican Senators with the ability and the desire to help are not helping because of a concern over their own political comfort. Shame on any Senator in a position to help who fails to help out of fear they may be punished by the Democrat Senate President.
I call it Political cowardice to kowtow to the Democrat leadership on the decision of whom the Republicans should support for election to State wide office.
The Party and individual members of the Senate need to stand up to Democrat leadership and show they will not be intimidated into allowing the Democrat leadership to keep the growth of the Republican party stifled. Rhetoric about freedom and liberty rings hollow when you fail to stand up to tyranny when confronted with it in government. Republican Senators need to stand up and be counted. If you have no opponent and have tens of thousands of dollars in the bank you need to donate to and assist in every way possible in elected fellow Republicans. If you are threatened with loss of your committee seat or any other punishment by the Senate President, then make it public and double your efforts on behalf of the Republican candidate.
So is this a Senate or a fiefdom? Bear in mind that Senate President Mike Miller (Maryland’s version of Harry Reid) has a Republican opponent himself, Jesse Peed. Those of you reading this in District 27 should note accordingly.
I did take a peek at Smigiel’s last filing, which was the May filing, and it showed he had about $21,000 remaining in his account (with loans outstanding.) Obviously we have nothing newer to go by, but I haven’t seen any transfers out from his account yet.
Now I don’t know anything about the inner workings of the Maryland General Assembly but I do know bullshit when I smell it. Simply put, the way those bodies are conducted during the 90 days of terror we endure each year reeks to high heaven. Bills which would do a lot of good are stashed in the desk drawers of committee heads, arms are twisted in grotesque ways to get other less palatable bills to pass, and the public’s voice is often ignored.
Thus, it doesn’t really surprise me that such a punishment threat as Smigiel alleges might exist, but we need someone to stand up and say so. There are some who are no longer in office who could verify such statements because I’m sure these threats aren’t new. Maybe Senator Simonaire would have something to say since he was the lone voice of opposition to Miller’s re-election as Senate President.
As for the would-be Senator McDermott, he’s come out with some interesting items of his own lately. I had intended to take a look at them, but there’s one thing I need to put it all together so it can wait a few days. It’s all good.
It’s not quite to the level of Senate President Mike Miller’s 2006 comments about burying Republicans upside down, but Anthony Brown showed the arrogance of the current state regime recently in a Washington Post story by John Wagner:
Brown told the crowd Thursday that he considers the primary “the bigger objective” in a state in which registered Democrats outnumber Republicans more than 2 to 1.
“We take that hill, and then we’ve got a little bit of a mole hill to take in November,” Brown said.
Larry Hogan has been trying to make fundraising hay out of Brown’s remarks:
We’ve seen a wave of support in the last 48 hours, further solidifying what we’ve known for a long time: Marylanders are sick and tired of arrogant career politicians like Brown who are more concerned with their own political goals than the wellbeing of average families and job creators. We are ready for honest leadership that is focused on the serious problems facing our state.
It’s clear that despite what he may think, Marylanders do not believe that Anthony Brown deserves a promotion to be the next governor of our great state.
Granted, it’s a little harder to define Brown as arrogant or say anything else negative about him without being possibly defined as racist or even anti-veteran since Brown served in the Army, including a stint in Iraq as a legal consultant. (The subject of the Wagner article was a new veterans’ support group backing Brown.) Given that a persistent problem facing returning veterans is finding work in the civilian workforce, one would think they would refrain from supporting a candidate who saw so many jobs and so much wealth leave the state, doing little to stop either from happening. Yet, despite that fact, many Marylanders don’t care until it affects them and if you live in the I-95 corridor the chances are pretty good that it doesn’t – or at least not enough to get riled up and vote for the opposition party.
But I contend there is a formula for success in this state, and it involves some bold new initiatives. For example, eliminating the income tax is one piece of the puzzle, but it presents a chicken-and-egg question: assuming a Republican win shows there’s a mandate for the change, one has to show there’s the prospect for a Republican win that’s broad enough to scrape off about 20-25 Democrats in the House and 8-10 in the Senate to create a workable coalition. I’ve run the numbers: splitting all the contested General Assembly races 50-50 leaves Republicans with deficits of 50-91 and 18-29 in the House of Delegates and Senate, respectively. We would have to win a vast majority of contested races to secure even a bare majority. (That can be a project for 2022, once we re-elect a governor who will draw fair districts.) In the TEA Party election of 2010, the Democrats won 62 of 101 contested House races and 20 of 28 for Senate, so 50/50 would be a huge win.
The other day I gave some turnout statistics, and they showed that gubernatorial election turnout is trending downward among all parties. As uninspiring as the current crop of Democrats appears to be, there’s somewhat of a chance that turnout among Democrats will fail to make 50% – it was under 55% in 2010 and has slipped downward for several cycles in a row. (Note also that a certain percentage of Democrats cross over in top-ticket races.) If Republicans can be excited enough to bring turnout to a level achieved in Presidential years (roughly 80%) they have a great chance of success. It’s that simple, because all the polls in the world are done based on what the pollsters believe the turnout will be on Election Day. If they assume 60% of Republicans turn out and we get 80%, that will shock the world because that predicted double-digit defeat will become a whisker-close win. And make no mistake: the media will be polling to favor their editorial slant and dispirit the opposition.
So if you couple the bold new initiatives with the explanation of why they will succeed in making the average Marylander’s life better, victory can be achieved. I’d like to come out of the ground a couple years early and see that shovel shoved right back into Mike Miller’s face. Let’s show the arrogant bastards that we can win this state, and leave that little molehill as the pile of dirt we displaced in our resurrection.
As I begin to write this, we have about an hour and ten minutes remaining in the 90 days of terror that is the annual Maryland General Assembly session. And because of the Maryland Legislative Watch website, the process of completing my annual monoblogue Accountability Project will be a snap – they’re kind enough to align all the votes taken during session by individual legislator.
So the process of weeding out what I’ll be focusing on has been my task over the last couple weeks. Since I cover 25 different votes, with three of them being committee votes for practically all the legislators (there are three exceptions: Speaker of the House Michael Busch, Senate President Mike Miller, and Delegate Don Dwyer, who was stripped of a committee assignment as punishment for his misdemeanor conviction last year) having them already arranged by legislator is a HUGE help.
Sadly to me, out of the hundreds of votes the General Assembly takes each year, the vast majority are unanimous or have very limited opposition. While there have been occasions I’ve used such exercises in futility for the minority, generally I like to find bills which have a significant number of votes on both sides. Unfortunately, this has eliminated a number of good bills I would have used via what I call the “gutless Senate syndrome” – a bill which may be 96-38 in the House passes 46-0 in the Senate. For example, did you know the state was soon to ban “vaportinis”? (Interesting, since they’re decriminalizing pot in the same session.) It would have been a good vote to use, but our gutless Senate passed it with no opposition. The same went for bills designating new wildlands, financial assistance for so-called “food desert” areas (not “desserts,” by the way), mandating balcony inspections, and several others.
All told, I will probably have 25 to 30 candidates to distill into the final 22 votes – there were a few bills which may have received a vote in their opposite chamber tonight. The “automatics” in this term will be the budget bills, the “bathroom bill”, minimum wage, and the “fix” for individuals who were hosed out of health insurance because the state screwed up. Those were always going to make the cut, even though the Senate vote on the capital budget was 46-0. Talk about gutless!
So when can you look for the monoblogue Accountability Report? I figure it could be done by month’s end.
One change I’ve made from previous editions is that legislators will be arranged into groups based on whether they are retiring, running for higher (or different) office, or trying for another term. Of course, I will still have the Legislative All-Stars and my usual rewards and criticism as well.
The process can go full throttle in less than a half-hour.
As I often do, here’s a collection of little items which grow to become one BIG item. And I have a LOT of them – so read fast.
For example, I learned the other day that Richard Rothschild, who spoke so passionately about private property rights (and the Constitution in general) will be back in our area Saturday, March 2nd as the speaker for Dorchester County’s Lincoln Day Dinner. That’s being held at the Elks Lodge outside Cambridge beginning at 3 p.m. Tickets, which are just $30, are available through the county party.
While Rothschild is the featured speaker, you shouldn’t miss some of the others scheduled to grace the podium, particularly gubernatorial candidates Charles Lollar and Blaine Young as well as Congressman Andy Harris. For a small county like Dorchester, that’s quite a lineup!
The controversy over the Septic Bill is far from the only item liberty-minded Marylanders have to worry about. Over the last few weeks, I’ve been bombarded with notices over a number of issues.
For example, after what State Senator E.J. Pipkin termed as a “structural failure” regarding hearing testimony on Senate Bill 281 (the gun-grabber bill) he offered an amendment to the Senate rules to handle these cases. However, I could not find a follow-up to that bill.
What I could find, though, was Pipkin’s statement that the state was making citizens into criminals, stating “The penalties embedded within the Governor’s Gun Control bill are extreme; they would criminalize paperwork errors in ways that destroy careers, lives, and families.” And he’s absolutely correct.
“This bill does not address the issue of gun violence in Maryland. The real issue is illegal firearms in Maryland, something the Governor’s bill does not target,” Pipkin concluded.
But guns aren’t the only problem. Unfortunately, we are one step closer to an offshore wind boondoggle in Maryland despite the best efforts of those who deal in the realm of reality to stop it. One bastion of sanity in Maryland is Change Maryland, whose Chair Larry Hogan expressed the following regarding offshore wind:
It seems Martin O’Malley’s priority is to make electricity and gas more expensive. He is pushing an increase in the gas tax and pushing a wind energy policy that is not cost effective and guarantees that electricity will be more expensive for rate payers.
At the close of the last session, the governor ignored the budgeting process which resulted in a train wreck. Instead he was out on the steps of the capital, leading wind energy activists in chant that said ‘all we re saying is give wind a chance.’
There are no assurances that this offshore wind proposal will not devolve into crony-capitalism that reward friends of the governor and political donors.
Actually, Hogan slightly misses the point because true capitalism would occur when the market continues to shun the expense and non-reliability of offshore wind. I guarantee that if this project goes through it will cost those of us who use electricity in Maryland a LOT more than $1.50 a month – subsidies can always change, just like tax rates on casinos.
The aforementioned Pipkin also weighed in on offshore wind:
This legislation may represent a shift in how private business is done in and regulated by the state.
This bill requires the Public Service Commission (PSC) to weigh new criteria in approving private development contracts to build off-shore wind turbines. The Commission will now consider prevailing wage and Minority Business Enterprise (MBE) participation as criteria in its contract award.
This could set new precedent. In the future, we could see every business now regulated by a state agency subject to prevailing wage and MBE requirements.
You think? Our Big Labor-friendly governor stops at nothing – nothing – to grease the skids for his union cronies. And surely this will extend to whatever road work is performed once the gas tax is increased by O’Malley and General Assembly Democrats. Wait, did I say road work? Hogan and Change Maryland question that assumption, too:
Change Maryland Chairman Larry Hogan backed transportation reform which has emerged as a key issue this legislative session after several years of being relegated to the back burner. Specifically, key members of the Maryland House of Delegates are advocating guiding principles to ensure much-needed investments are made in infrastructure and fundamental reforms made to transportation policy.
“Previous attempts to improve our transportation network in Maryland have been an abject failure. Our top elected officials are saying roads and bridges are crumbling, but what they won’t tell you is they are the ones who caused the problem in the first place,” said Hogan. ”Another myth that is being foisted upon us is that there is an urgent need to raise the gasoline tax, and that is simply not true.”
Hogan joins Del. Susan Krebs and other House members in instilling common-sense policy solutions to making transportation policy. These include protecting the transportation trust fund with a constitutional amendment, realigning infrastructure investments to reflect how Marylanders actually travel and restoring funds for transportation. (Emphasis mine.)
I highlighted the above phrase as a way to say, “bingo!” That, folks, is the problem in a nutshell.
This is a state which jacked up the tolls on the Bay Bridge to create a cash cow for other projects which don’t pay their own way, like the Inter-County Connector outside Washington. O’Malley’s gas tax is really intended to build rail lines most of us will never ride rather than build projects we could use, like perhaps a limited-access Easton bypass for U.S. 50, widening Maryland Route 90 into Ocean City, or building an interchange at the dangerous U.S. 113 – Maryland Route 12 intersection in Worcester County.
The gas tax proposal has led to acrimony in Annapolis, as Delegate Kathy Szeliga points out:
(Senate President Mike) Miller called House Republicans who oppose his gas tax proposal, “Neanderthals,” and “obstructionists.” In response to his comments, Delegate Szeliga tweeted, “Yabba-dabba-do, Mr. Miller,” further commenting that she hopes to obstruct and stop this massive 70% increase in the gas tax and government expansion. In response to Senator Miller’s jabs at Republicans, Delegate Herb McMillan added, “Even a caveman can see that it’s stupid to raise gas taxes when there’s no guarantee they’ll be used for roads.”
Kidding aside, you can call me a “total obstructionist” as well, Senator Miller. On the road to serfdom someone has to stand in the way, and I’m one of those someones.
Notice that I haven’t even talked about the federal government yet. One sure sign of a new year, though, is the ubiquitous Congressional scorecard. Two organizations which have released theirs recently are Americans for Prosperity and Heritage Action for America.
Not surprisingly, Harris scored a 95% grade from AFP, leading the Maryland delegation – former Congressman Roscoe Bartlett had the second highest grade at 91%. As for the rest, well, their COMBINED score was 50 percent. Heritage Action, however, graded Andy more harshly with an 81% grade (Bartlett scored 67%.) Once again, the remainder of Maryland’s delegation scored anywhere from a lackluster 17% to a pathetic 4 percent.
We’re also talking about immigration reform more these days. I happen to lean somewhat on the hawkish side, so I believe these reports from the Center for Immigration Studies are worth discussing. In one, former Congressman Virgil Goode of Virginia looks at what happened the last time we went down this road insofar as collecting back taxes from illegal aliens – a key part of the compromise provision – was handled after the 1986 reform.
The second CIS report looks at recommendations the bipartisan Jordan Commission made in 1997, after the 1986 immigration amnesty program failed. This middle ground made five recommendations:
- Integrate the immigrants now in the United States more thoroughly;
- Reduce the total number of legal immigrants to about 550,000 a year;
- Rationalize the nonimmigrant visa programs and regulate them;
- Enforce the immigration law vigorously with no further amnesties; and
- Re-organize the management of the immigration processes within the government.
That seems like a pretty good starting point to work from, particularly the first recommendation.
Another study worth reading is this one from Competitive Enterprise Institute called “The Wages of Sin Taxes.” In it, author Chris Snowden takes an unflinching look at who really pays for these tolls. As CEI states in their summary:
Most remarkably, Snowdon, a fellow at the Adam Smith Institute in London, demonstrates that financial burden supposedly placed on society through the consumption of alcohol, tobacco, high-calorie foods, has little basis in reality. The myth that these “sinners” cost the rest of us money is perpetuated in large part because “government has no incentive to tell the public that these groups are being exploited, and the affected industries dare not advertise the savings that come from lives being cut short by excessive use of their products.” This type of tax is actually a regressive “stealth tax” that allows lawmakers to take money from their constituents with the lowest incomes without the pushback an upfront tax would provoke.
I would put that in the category of “duh.” Ask yourself: how much state-sanctioned money and effort do you see given by government to prevent drinking, smoking, and gambling? Yet they rake their cut off the top in each of these three vices, which are only legal because government and society have compromised on these issues.
On the other hand, those who grow or smoke marijuana or do other illegal drugs are considered criminals and tossed in jail or fined. The same is true with prostitutes in most locales. If there were tax money to be made, though, and societal mores shifted ever-so-slightly toward a more libertarian viewpoint with regards to these self-inflicted actions, they would be legal – but you’d certainly still see the public service announcements about “just say no” or the dangers of selling one’s body. (Oddly enough, I doubt we buy time around the world to warn about the dangers of illegally immigrating to the United States. Why do you think that is?)
And I don’t think items like this upcoming movie will help the libertarian cause – not because of the message per se, but the poor quality of the animation. It reminds me of those cheesy Xtranormal movies people make, sorry to say.
I also have a couple items – as I get closer to wrapping this up – that I think are worth reading. Paul Jacobs is on Townhall giving our state a little tough love regarding the drive to tighten petition rules (in a state where it’s already very difficult to succeed) while Mike Shedlock is there making a point I’ve made for several years – my daughter’s generation is being hosed.
While he’s a little bit older than the Millennial Generation, I think Dan Bongino can relate. This video is now going viral on Youtube, in part thanks to the Blaze.
Finally, I think it’s worth alerting my readers that this may be the last edition of odds and ends for awhile. No, I’m not going anywhere but in the interest of bringing more readership I’m in the process of exploring the concept of a quicker posting tempo which may or may not feature shorter posts.
I’ve always felt the ideal post was somewhere between 500 and 1,000 words, but these odds and ends posts can run 2,000 words or more. Maybe it’s better for both readers and this writer to space things out and perhaps devote 200-300 words to an item rather than wait and collect a bunch of items which could get stale after a week or two. I can’t always control the length of my Ten Question Tuesday posts or ones where I report on an event, but I can work with items like these and see what’s truly worth writing about.
As the political world and internet evolve, I think the time is right to change up the mix and tempo here just a little bit. Certainly I won’t get to a point where I’m simply rehashing press releases but I think it’s a better use of my time to shorten the average post I write.
So there you have it: another post which weighs in at 2,000 words, exactly.

After seeing several of their other pet issues derailed for months due to spirited referendum efforts by opponents, those who wish to rescind the death penalty in Maryland are trying to take advantage of a provision in the Maryland Constitution to protect a bill to repeal the state’s little-used death penalty from having its fate decided by voters. Polling numbers suggest they have cause to be worried: last month’s Maryland Poll by Gonzales Research pegged support for the death penalty from 49% of those polled, with 44% in opposition.
Yet Article XVI of the Maryland Constitution exempts bills with an appropriation from the referendum process, and a small portion of the crossfiled measures House Bill 295 and Senate Bill 276 both state that:
For Fiscal Year 2015 and each Fiscal Year thereafter, the Governor shall include in the annual budget submission $500,000 for the (State Victims of Crime) Fund, redirected from General Fund savings resulting from the repeal of the death penalty.
That provision would amount to less than 1/1000 of 1% of the overall state budget, but in a strict reading of Article XVI of the state Constitution this clause would seem to preclude any effort for repealing the death penalty in Maryland from being acted upon by the voters in 2014. Passage of the bill is nearly a certainty given the Senate and House versions of the bill respectively have 21 and 67 co-sponsors – 24 Senate and 71 House votes are needed for passage.
