Can things really be changed with a Convention of States?

It’s a funny thing: when I last broached this subject I noted that the momentum toward a Convention of States had stalled out as no state had passed a call for an Article V Constitutional convention in nearly three years. Apparently, though, getting past the CCP virus has popped the cork on the movement because in the nearly three months since I last wrote on the subject the CoS effort has gained the support of Wisconsin, Nebraska, West Virginia, and most recently South Carolina, bringing the total to 19. They’ve also come closer to melting away opposition in Iowa, Kansas, and South Dakota and there was even testimony on a CoS bill in Maryland – yes, Maryland.

Granted, the Maryland bill didn’t get beyond the hearing stage – and it will probably never get beyond that unless there is a sea change in their General Assembly beginning this fall – but the fact that nearly half of their Republican delegation co-sponsored the measure is encouraging, especially since the 2021 version only had a sole sponsor. (What is not encouraging is the lack of interest from the lower Eastern Shore delegation, from which only Delegates Johnny Mautz and Charles Otto were co-sponsors. That leaves Delegates Chris Adams, Carl Anderton, and Wayne Hartman along with both lower Shore Senators, Addie Eckardt and Mary Beth Carozza out of the picture. It goes without saying that Delegate Sheree Sample-Hughes wouldn’t be a backer; after all, she just voted for allowing easier access to baby murder.) On the other hand, a Democrat-sponsored Article V resolution to protect “voting rights” was not introduced this session after failing to advance in a two-year run in the MGA from 2020 to 2021.

Shamefully, Delaware is one of those states where a CoS resolution hasn’t been introduced in recent years (more on that in a bit.)

One thing the CoS has been circulating of late is an endorsement of sorts from radio host Glenn Beck, who basically told his audience that, “a convention of states is the best thing we can do” to rein in government. Beck explained that the process would not be open to making other changes in the Constitution besides those which are spelled out, which is why the Democrats in Maryland had to create their own proposal rather than just jumping on board the Republican Article V resolution figuring they could take it over.

I noted back in January why I’ve begun to feel this is the better solution to our longstanding issues with government, but let me give you another analogy: if you are related to an alcoholic, do you just let them continue down their self-destructive path or do you get together with caring friends and family to do an intervention? Government will not fix itself because there are too many in it for themselves and their little fiefdoms of power, so someone else has to come along to starve that beast.

I’ve been in politics long enough to see what normally happens with “reformers” when they are first elected to office. They promise the moon but once they get there the excuses begin and the reform becomes going along to get along. The people the TEA Party sent to Congress in 2010 first said they couldn’t do anything because they only had half of Congress. In 2014, once they got a Senate majority, they bemoaned the fact that Obama was still in office, and promised action once a Republican was elected President.

In 2016, we got the ultimate reformer in Donald Trump and what did Congress do? Well, maybe it’s better to to say what they didn’t do: after six years of promising to repeal Obamacare, when they had the opportunity they didn’t do a thing – not even the damned “repeal and replace.” We got a temporary tax cut that the Democrats are already trying to dismantle, and government is bigger than ever because, as fast as President Trump was undoing regulation, the Biden regime is working triple-time to replace it, and then some. For having the barest of Congressional majorities, the Democrats are doing more to pursue their regressive agenda than those who promised the TEA Party the swamp would be drained ever did.

We could elect 60 new conservative House members this fall and somehow get to a filibuster-proof Republican majority in the Senate, while overcoming the Democrats’ best effort to swipe the election in 2024 with Trump, DeSantis, or whoever but there would still be excuses. Perhaps an external intervention is in order here?

Obviously there is risk in “imposing fiscal restraints on the federal government, limiting the power and jurisdiction of the federal government, and limiting the terms for office for its officials and members of Congress.” Balancing the budget may mean significant new taxes, the Swamp can figure out workarounds on limits to power and jurisdiction, and term limits don’t apply to entrenched bureaucrats that are much of the problem. But if we can get the momentum in putting together a Constitutional convention, perhaps we can work at the problem in a new manner. If the regressives are against it, claiming, “The constitutional convention idea is a special interest-funded, anti-democratic endeavor that will almost certainly strip power from the American people, while leaving our cherished constitutional rights up for grabs,” then maybe it’s not such a bad idea. That’s pretty much how they play, isn’t it?

In looking up the author of that op-ed, Claire Snyder-Hall, I found out she is the executive director for Common Cause Delaware, a self-described “nonpartisan citizens lobby, dedicated to fostering open, honest and accountable government at every level.” You would think they would be for a more limited government because there’s less incentive to be secretive, dishonest, and unaccountable when the honey pot is smaller, but no. One of their “accomplishments” is that they:

Vote on House Concurrent Resolution 60 – Rescinding the Article V Call for a Constitutional Convention. 

Delaware rescinded all calls for a Constitutional Convention. House and Senate leaders joined with Common Cause Delaware to pass HCR 60 and stopped Delaware from going down a dangerous path. Common Cause made a difference by educating and opposing the convening of a Constitutional Convention.

If you recall from January, that HCR60 vote was one featured on that year’s monoblogue Accountability Project. A vote against HCR60 was a proper vote. But the first part of that blockquote was why I changed the paragraph above: it turns out there was legislation introduced in 2015 to join the call for convention, which unfortunately was stricken in 2016. I’d love to have any of the Senators involved (Dave Lawson, who was the sponsor, Gerald Hocker, or Colin Bonini) explain why it was stricken. (I presume it means the same as withdrawn, which is a term I’m more familiar with because Maryland uses it.) I wish there was some sort of voting record on it as there was with HCR60, but maybe we can get some insight from the trio.

So there is precedent in this state, and maybe this idea is something we can keep in our back pocket for this fall’s campaign. It’s time to get the First State to be on this list with nineteen or more of its brethren. What do we have to lose?

Coattails tucked into his pants

So let’s talk about Larry Hogan, shall we?

I’m going to start way back in 2009. People tend to forget Larry actually had his eye on running for Governor back then and was briefly in the running until he deferred to his old boss and allowed him to get his doors blown off by Martin O’Malley. (Of course, I chose better in that primary, too.)

After the 2010 Ehrlich debacle – an election where the TEA Party wave somehow missed all of Maryland except for the Eastern Shore – you just had to know that Hogan, a vocal critic of Martin O’Malley during his brief time in the race, would figure out some way to stay in the headlines; thus, Change Maryland was born. I thought it was a great idea.

But when Hogan actually completed the fait accompli of getting into the 2014 open seat Governor’s race, I found he was great at articulating what he was against but not so much what he was for. Given a good field to choose from and one where all the contenders (save Hogan) spelled out their agenda, I supported someone else in the Republican primary but we got Larry. Of course, the rest is history.

I’m going to talk about two memories of Hogan from the campaign and how those issues were resolved.

As the O’Malley administration was heading out of town, one last-minute priority of theirs was an attempt to saddle our farmers with new phosphorus management rules that were basically written by the environmentalist wackos of the state. Hours after being sworn in, Hogan beat a deadline and pulled the regs – much to the chagrin of Radical Green.

But barely a month later, Hogan basically put the same thing into effect with a little bit of window dressing. I will grant that it was in the face of a bill with those same regulations in them but it also put the General Assembly on notice that Hogan could be rolled. And boy, was he ever when he reneged on a promise to eliminate the MOM-imposed moratorium on fracking in Maryland and sold the panhandle of the state down the river by endorsing a ban.

Aside from eliminating some tolls and reallocating money that could have been needlessly wasted on a light-rail boondoggle in Baltimore known as the Red Line, it’s really hard to compile a list of quantifiable, significant Hogan accomplishments but easy to find where he capitulated. We still have to pay for the Purple Line (not to mention a huge subsidy for the D.C. Metro), the “rain tax” repeal really wasn’t one, we got stuck with competing versions of paid sick leave (from a supposedly “business-friendly” governor) and on and on. Even at the end of this term, when he was free to use his veto pen because the terms of legislators were ending and there would be no override votes, he still let a lot of bad stuff through.

But I was still planning on holding my nose really, really tight and voting for Hogan, until he sold Tony Campbell out. That was the last straw. So I looked into Shawn Quinn. Lord knows there is a lot of his platform I didn’t agree with, but there is one key philosophy where Quinn and I are in complete agreement: when it comes to education, money should follow the child.

So thanks to all the betrayals and broken promises, Larry Hogan managed to lose my vote and Shawn Quinn received it – a little bit of unexpected help. No doubt Larry doesn’t really care because he won and now he’s a lame duck until he decides to run for something else (U.S. Senate in 2022?) but look at what he lost. He may blame Donald Trump, but I think Hogan’s reliance on Democrat votes bit him in the behind when it came to downballot races like the ballyhooed “Drive for Five” with state senators. Cases in point:

In District 3B, Bill Folden won with 7,522 votes in 2014 but lost with 8,775 votes this time.

In District 9B, Bob Flanagan won with 8,202 votes in 2014 but lost with 8,311 votes this time.

District 29B’s Deb Rey won last time with 5,334 votes but this time had 6,281 and still lost. That one sucked because Deb was always in the running to be one of my monoblogue Accountability Project Legislative All-Stars and achieved that goal twice, 2016 and 2017.

Glen Glass led all of District 34A with 10,779 votes in 2014 and may lose as the third-place finisher with 11.564 this time. He’s 19 votes out of second.

Glass was a Legislative All-Star way back in 2012 but was more comfortably average of late – still, a significant loss. Senate seat loser Gail Bates was also an All-Star as a Delegate in 2011 – I lost a total of three. One piece of great news, though: two-time mAP Legislator of the Year Joseph Boteler is back in the fold as he was one of three winners in District 8 (and the lone Republican, a net loss of one from the three-seat district), squeezing out Cluster.

Meanwhile, Hogan ran ahead of his 2014 pace in every county. Ironically, Anthony Brown would have killed for the 917,484 votes received by Ben Jealous, as that total would have won it for him four years ago – instead Jealous lost by over 300,000 votes.

But if you do a top 6/bottom 6 list of Hogan gains, it’s rather telling about the electorate.

Top 6 gainers:

  1. Prince George’s – up 13.3 percentage points
  2. Baltimore City – up 10.0 percentage points
  3. Kent – up 9.1 percentage points
  4. Talbot – up 8.0 percentage points
  5. Allegany – up 7.9 percentage points
  6. Montgomery – up 7.9 percentage points

Out of all those counties, though, there was not one Republican gain in the General Assembly because among these are the three most dominant Democrat counties in Maryland – only Allegany, Kent, and Talbot had GOP representatives prior to 2018 and all were re-elected.

Bottom 6 gainers:

  1. Cecil – up 0.4 percentage points
  2. Harford – up 0.9 percentage points
  3. Carroll – up 1.4 percentage points
  4. Baltimore – up 2.7 percentage points
  5. Charles – up 2.9 percentage points
  6. Anne Arundel – up 3.0 percentage points

In those six counties, the GOP lost Delegate seats in several districts: 8 (appointee Joe Cluster lost his election bid), 30A (Herb McMillan retired), 34A (Glen Glass lost his re-election), and 42B (Susan Aumann retired). St. Mary’s County (Delegate Deb Rey, District 29B) fell just outside this bottom 6 list and she paid the price, too. Also losing: Frederick County’s Bill Folden (District 3B) and Bob Flanagan from Howard County (District 9B) – epitomes of suburbia.

The GOP did grab Jim Brochin’s old Senate District 42 seat in Baltimore County as Delegate Chris West vacated a District 42B seat to move up, but that was tempered by the loss of the Senate District 9 seat held by Gail Bates, who was defeated in Howard County. That seat also has a small portion of Carroll County, one of my bottom 6. And of course everyone knows that MBC won in District 38, which I will get to in due course.

As more proof that Larry Hogan was the most popular Democrat in the race, let’s compare federal offices from 2014 to 2018:

  • Andy Harris (District 1, Maryland’s only GOP representative) fell from 70.4% of the vote in 2014 to just 60.3% this year. On the other hand:
  • Dutch Ruppersberger (District 2) gained from 61.3% to 65.7%, a 4.4 point increase.
  • John Sarbanes (District 3) gained from 59.5% to 68.6%, a 9.1 point increase.
  • Steny Hoyer (District 5) gained from 64% to 69.9%, a 5.9 point increase.
  • Elijah Cummings (District 7) gained from 69.9% to 76.1%, a 6.2 point increase.

In the apples to oranges category as there was a change in the office between 2014 and 2018:

  • District 4: Donna Edwards had 70.2% four years ago, Anthony Brown (running for re-election) got 77.6%.
  • District 6: John Delaney had 49.7% four years ago, but this time David Trone was elected with 57.6%. Republican Amie Hoeber lost to Delaney with 40.1% in the Presidential year of 2016 (typically high turnout) and only had 39.4% for an open seat this time.
  • District 8: Chris Van Hollen had 60.7% in 2014, Jamie Raskin (running for re-election) got 66.8%.

We always knew a Republican needed Democrat votes to survive statewide in Maryland, but the lack of coattails Larry Hogan had for his titular party was more than ridiculous. Their only two wins were in districts that were already primed for the GOP – District 42 had 2 of 3 GOP Delegates and a moderate Democrat Senator, while District 38 was all Republican aside from the Democrat Jim Mathias, who succeeded a longtime Republican Senator. I’m sure local Democrats are kicking themselves for not challenging Carl Anderton because they may well have won the seat back in this climate.

Indeed, the victory of MBC and the fact our other state legislative incumbents were unopposed or drew token, underfunded opposition was perhaps the only thing local Wicomico County Republicans could cheer about. Out of all the Delegate races locally, the only semi-constant was District 38A’s Charles Otto. While he had more votes this time around, he lost 1 percentage point and fell below 60 percent. Despite the fact his district no longer includes Wicomico, he is often present at local party events.

Looking at District 38, Jim Mathias actually drew more votes than he had in 2014 overall, although it appears he will be right about even in Somerset County. (As of this writing, Jim is 71 votes shy of his 2014 total there.) MBC playing Mathias nearly even (six votes’ difference) there in Somerset was one key, and her domination in Worcester County was the other. Compared to his 2014 race against former Delegate Mike McDermott, Mathias lost 1.6 percentage points in Wicomico, but plummeted 6.3 points in Worcester and 5.8 points in Somerset.

Locally, perhaps the biggest mistake Democrats made was not convincing Jack Heath to run in their primary. For all the angst about his independent bid, you have to call it a failure when Heath outspent his Democrat opponent by a margin of $20,556.63 to $1,266.66. (Bob Culver spent $21,616.99 through the final reporting cycle so financially the race was even between Heath and Culver.) Yet the race wasn’t even close between Culver and Democrat John Hamilton, as Bob won by 19 points with Heath barely breaking into the twenties with 21% – 28 points behind Culver. In other words, Democrats were so determined to elect their own they didn’t inform themselves about qualifications or readiness for office – they just saw the word “Democrat” and filled in the oval. Had he run as a Democrat, Jack could have won (or come much closer) since I suspect he split the Democrat vote.

Yet the GOP has to take some blame locally, too. I’m not sure their candidate recruitment was up to par this time around: two of their primary candidates had scrapes with the law, and while one of them was defeated in the primary the other was unopposed. I know that party preference is to avoid primaries, but I don’t think voters were served well when Julie Brewington didn’t withdraw prior to the primary, allowing the Central Committee to select a candidate with less baggage. She was one I withheld my vote from; instead I wrote in my friend Cathy Keim – who should have been on County Council in 2011 to succeed the late Bob Caldwell because all of us on the Central Committee except the one also running for the job, who recused herself, voted for Cathy. That was a County Council seat needlessly lost, and they were already looking at a tough district race in a heavily D district that, predictably, went for the Democrat. (And a loony-tunes lefty he is, too – grab a hold tight to your wallet and private property rights.) So the previous 6-1 margin for Republicans is now a scant 4-3, with one less-than-trustworthy vote on the R side and a Board of Education lackey there to boot, too. The only two R’s I can trust to generally look out for my interests now are Marc Kilmer and Joe Holloway. (Funny, but things never change.)

Then we had another candidate who refused to knock on doors, and I told him that’s how you win votes. (Ask Carl Anderton or MBC.) Great guy, very qualified for what is essentially an administrative post, but lost by about 2,300 votes (or doors he didn’t knock on.) Now that his opponent is in, good luck winning that office until he retires, just like Mike Lewis or Karen Lemon are lifers where they are at.

And for all that work we did to have an elected school board, I can’t say I’m pleased with the results. Out of seven spots, the two at-large winners were the ones on the teacher union’s “apple ballot” – an automatic vote for their opponents in my book – and we also got a longtime board member when the Republican who was on that ballot could no longer campaign because she took a county job. So right there are three votes for the status quo – or worse. I believe, however, that Gene Malone was the last Republican BoE appointee and, having served with both John Palmer and Ann Suthowski on the Central Committee I think they will be relatively conservative (although Ann may be a squish on the wasteful mandatory pre-K idea.)

The fate of the school board, then, is coming down to District 3. David Goslee, Sr. (who I also know from serving with him on the WCRCC) is literally hanging on by the skin of his teeth – 9 votes separate him and his opponent, who is another mandatory pre-K supporter. I’m putting out the bat-signal to my friend and cohort Cathy Keim – watch that race like a hawk, I don’t want them to “find” another box of provisional votes someplace.

That pretty much covers my ballot. It wasn’t a straight R ticket, since there were a couple Democrats who were unopposed that were worth my vote to retain. (Same for the unopposed Republicans, by the way.) I just wish the person at the top would not have broken the little trust I had in him.

Two more quick thoughts: for all we heard about the “progressive” movement locally, they mainly got spanked at the ballot box. But it could be worse: they could be Republicans in Delaware – who now have literally no statewide offices after the lost the couple they had and saw their deficit in both House and Senate increase by one seat, a casualty list that included both their Minority Whips. Hey, maybe Larry Hogan can move there in time for 2020 and that election.

The story on early voting

From its institution (against my better judgment) for the 2010 election, early voting has become more and more of a portion of total turnout here in Maryland.

In 2010, when it was first adopted, only 11.77% of those who actually voted used the option, with 13.07% of Democrats and 10.13% of Republicans partaking, That number increased to 15.75% of voters in 2012 (18.44% of Democrats, 11.98% Republicans), and – once early voting was expanded from six to eight days – to 17.66% of those who voted in 2014, with 19.86% of Democrats and 15.61% of Republicans using the option.

In the last go-round in 2016, however, early voting came into its own: a full 36.02% of Democrat turnout came during early voting, while 24.76% of Republicans who voted used the option. All told, an astounding 31.23% of those who voted did so early.

So it was no shock that Democrats “won” early voting once again: according to the Maryland Board of Elections, 16.72% of eligible voters came out for the eight days of early voting. (19.08% were Democrats, 15.44% were from the GOP.) While this is less than the 22.48% that came out in 2016, bear in mind turnout isn’t nearly as good in a midterm election. The all-important question, though, is what percentage of overall turnout is represented by early voting. In 2014 just under 50% of Republicans waited until Election Day to vote (49.6% to be exact) but only 37.5% of Democrats voted on Election Day.

If the 2014 numbers hold true, though, turnout for Democrats will be over 10% better than the last gubernatorial election, which was for an open seat, as former Governor Martin O’Malley was term-limited, but the GOP will counter much of that increase with a stratospheric 65% turnout of their own. The question, therefore, is whether those extra 10% of Democrats are going to be loyal to Democrat gubernatorial candidate Ben Jealous or not – he basically needs them all to be to drive incumbent Larry Hogan’s numbers among Democrats down to the 20% or so he needs in order to defeat Hogan – despite polls that have had Jealous down double-digits all summer.

As evidence of just how early voting may affect the races, I put together a series of charts. The first one is a straight comparison of raw vote totals from the 2016 early voting and the 2018 version, divided by county and by party. It wasn’t worth comparing to 2014 because its totals were blown away just a few days into early voting and the 2016 election provides a better guide for both turnout and proportion of early voters.

The number at the bottom is a comparison of percentages of voters – Democrats were 26.13% off their 2016 totals, while Republicans were only 19.2% off and all the others were 32.55% off. In no instance did the 2018 total surpass a 2016 total, as can be expected – however, Somerset County Republicans finished just 7 voters short of matching 2016 turnout. That’s most likely good news for incumbent Delegate Charles Otto.

So then I broke it down by county. Rather than do all the counties, I’m just doing top and bottom 6 in terms of how they matched up 2018 vs. 2016. The higher the number (the proportion of turnout in 2018 vs. that of 2016), the more excited the electorate is.

As you can see, there are some counties where turnout looks to be really, really good and others where it may be so-so – in particular, the Capital Region seems to be taking a beating while the Eastern Shore looked like they were ready from the word go. It’s telling to me, though, that traditionally Republican counties are leading the way for the Democrats while their strongholds lag behind – perhaps it’s the way for the minority to express a message?

But in those same Democratic strongholds Republicans aren’t coming out, either. Could they be believing the re-election of Hogan is a fait accompli  and don’t see the purpose of voting in down-ticket races, or are they simply being traditional Republicans who wait until Election Day?

You may notice some counties have more on the Democrat side and others are looking good for the GOP. I tabulated these differences as well as the decline when it came to independents and unaffiliated voters, which have the steepest dropoff from 2016. The color on the right-hand chart is that of the party which led the county in percentage, as shown in the left-hand chart. So on blue counties it’s the difference between Republicans and the “others” and on red ones it’s Democrats vs. the unaffiliated and minor parties voters.

Independent and unaffiliated voters were mixed in turnout: those representing “other” parties (holdovers from the previously-recognized Reform and Constitution parties, for example) led with 12.25% of 32,885 voters, but only 9.06% of the 9,164 Greens and 7.73% of the 21,713 Libertarians made it out. There were 10.66% of the 708,012 voters who list as unaffiliated at early voting, and they make up the bulk of the statistics.

I know it’s a lot of charts, but we can read a couple things into these, anyway.

For one thing, it does not appear that the feared malaise from constant chatter about a “blue wave” worked to dissuade overall GOP turnout. Granted, the Democrats might come fairly close on numbers, but the GOP should maintain its turnout lead they’ve had almost every election in the last 12 years, the lone exception being the Obama wave of 2008. This should enable Larry Hogan to stay in office, but it makes me question whether he will have coattails enough to get Craig Wolf – the GOP candidate for Attorney General – and the five new GOP State Senators he’s seeking into office. (High GOP intensity, though, is a good sign for the District 38 race – especially when two of the three GOP Delegates or primary winners for the post are unchallenged, save for a “sore loser” write-in effort in District 38C by perennial candidate Ed Tinus, a primary loser on the GOP side despite running for other offices as a Democrat.)

The other key point is that Republican voters outside the scope of the state’s two largest media markets (Baltimore and Washington, D.C.) seem to see this election as once again “the most important of their lives” and they are coming out accordingly. They are also reacting to downballot races – note the top three GOP counties (and two of the Democrats’ top six) are embroiled in perhaps the most heated State Senate race in Maryland, as I have frequently documented. On the other hand, lower turnout and enthusiasm in Democrat areas has to be worrisome to the state party, which has essentially abandoned its nominee Ben Jealous and appears to be concentrating on maintaining its hold on a State Senate majority that can override Larry Hogan’s vetoes. Their advantage in their regard is that none of their targeted State Senators are in traditional Democratic areas – in fact, ten of their number received free rides this year so they need only win half of the others plus one to maintain their vetoproof hold. Republicans also have a couple vulnerable seats they have to work hard to keep thanks to unaffiliated challengers and primary upsets.

But the real fun begins Tuesday. Those who voted early may be pleased to know that the forecast is for rain for most of the state, with the potential for severe weather. (Locally we are looking at just warm but cloudy.) Regardless, grab your umbrella and head out to the polls if you haven’t already.

Is it really that hard to file paperwork?

As I promised in last night’s post, I looked up some of the many campaign finance accounts that were opened for this year’s election, including older accounts that have been around for years. My focus was on those who are on the November ballot in Wicomico County, although I also looked at candidates who failed to advance beyond the June 26 primary.

This post was inspired by the long-standing deficiency of Kirkland Hall, who went several months overdue without filing the required campaign finance paperwork with the state Board of Elections. However, as I found out in looking at the 64 candidates who are/were on the Wicomico County ballot, it must be a mean feat for some people to do this.

(Hall and opponent Delegate Charles Otto are not actually on the Wicomico County ballot, but they are part of our District 38 nonetheless. Otto was first elected in part with Wicomico County votes in 2010, before District 38A was gerrymandered to place Otto and former Delegate Mike McDermott in the same district by shifting it eastward into the southern end of Worcester County.)

I’m going to reach back into my memory bank for this, because one needed change for 2018 was a revision to campaign finance laws to make them easier on party office candidates (as I was.) Prior to that, I ran for office three times in 2006, 2010, and 2014.

The first time I had a treasurer who took care of the modest amount of paperwork for what they called a Personal Treasurer Account (PTA), with the biggest (only) contribution I had being the $100 I donated to my campaign, the in-kind donation that I was advised to consider my website as, and the two expenditures my filing fee and the $58 or so I used to buy palm cards to distribute among my close neighborhoods. At that time, you could have a non-continuing account so after that campaign it went away, with the proceeds donated to our Central Committee.

But the second time in 2010, they eliminated the PTA option so I had to keep my account open for the four years between the 2010 and 2014 elections, which meant I had to file all the 2010 reports, the annuals for 2011-14, and all the 2014 reports until after my primary when I formally closed the account since I didn’t intend to run again. During that time, my treasurer/(then) fiance and I missed the 2013 Annual Report by five days, so we had to pay a $20 fine. Honestly, I don’t remember seeing the little green reminder card so I think it went to our previous address – the 2012 one came right at the end of our forwarding order. But I should have known it was time.

So I have some empathy for those who miss the deadline by a few days, especially in a small-scale campaign like most of those at the county level. However, it turns out that group was the minority as out of 64 candidates I checked – the majority were in complete compliance:

  • 36 of 64 had no violations.
  • 15 of the remaining 28 had just one violation, with fines ranging from $10 to $250 – these two gentlemen on the extremes both missed the 2012 Annual Report, but Senator Jim Mathias was a day late and County Executive Bob Culver was almost a year late. Neither have missed another deadline in the last six years, though.
  • 4 of the remaining 13 had two violations: County Council at-large candidates Julie Brewington and Jamaad Gould, Senator (but at the time of the violations, Delegate) Addie Eckardt, and perennial primary and write-in candidate Ed Tinus. All have racked up over $200 apiece in fines.

And then you have the serious scofflaws. All of these nine have three or more violations; however, since Christopher Adams has only generated $40 in fines for three offenses, his reports are only a day or two late at most. It’s the rest who seem to have some issues. This is done in order of fine, smallest to largest:

  1. Delegate Christopher Adams, District 37B: 2014 Pre-General 1, 2017 Annual, 2018 Annual – $40 in fines
  2. William Turner, candidate, Wicomico County BOE District 3: 2018 Spring, 2018 Pre-Primary 2, 2018 Pre-General 1 – $90 in fines
  3. Michelle Bradley, candidate, Wicomico County BOE District 1: 2018 Spring, 2018 Pre-Primary 2, 2018 Pre-General 1 – $220 in fines
  4. Larry Dodd, Wicomico County Councilman (District 3): 2016 Annual, 2018 Annual, 2018 Pre-Primary 2, 2018 Pre-General 1 – $490 in fines
  5. Kirkland Hall, candidate, District 38A Delegate: 2018 Annual, 2018 Pre-Primary 2, 2018 Pre-General 1 – $1,340 in fines
  6. Mimi Gedamu, candidate, District 37B Delegate: 2018 Pre-Primary 1, 2018 Pre-Primary 2, 2018 Pre-General 1 – $1,390 in fines
  7. Ernest Davis, Wicomico County Councilman (District 1): 4 in 2010, 2011 Annual, 2015 Annual – $1,530 in fines
  8. Marvin Ames, candidate, Wicomico County Council (District 1): no filings since inception in February 2018 – $1,890 in fines
  9. Jim Shaffer, candidate, District 38C Delegate: no filings since inception in February 2018 – $1,890 in fines

Yes, Ames and Shaffer have never filed a single report. Since both lost in the primary, their campaigns are finished but they cannot close their accounts until the fines are waived or (more likely) paid. Honestly, I think they have more in fines than they raised for the campaigns!

In case you wanted to use this as evidence that one party or the other is worse about the situation, be advised that of the highest nine there are two in a non-partisan race, four Republicans, and three Democrats. Ironically, none of the top 4 face a November race as Ames, Shaffer, and Gedamu lost in the primary and Davis (who, admittedly, seems to have put these issues in the past since he’s been “clean” for almost three years) is unopposed.

I may take a look at the situation again when the last pre-general reports come out later this month but I suspect most of the campaigns will be careful to file coming into the election. No need for an October surprise on that front.

District 38: a closer look at finances

Having looked at the races in District 37 yesterday, I know you’re waiting with bated breath for the really important one here in District 38 which will come at the end. (Always leave them wanting more.)

As opposed to the competition going on in its western neighbor, many District 38 denizens have their Delegates already all but selected. Barring a successful write-in campaign, both Delegate Carl Anderton, Jr. and Wayne Hartman will be representing their districts in January.

So let me review the parameters: I have pored over the campaign finance reports from each candidate submitted to the state Board of Elections beginning with the 2017 annual that covers from January of 2016. From there I subdivided contributions into five loose categories:

  • Donations from individuals within the area. For this exercise, the “area” is defined for both local districts as an address with a 216xx or 218xx zip code. Yes, the 216xx zip area is well outside the 38th District but it allows me apples-to-apples comparison with District 37 hopefuls – and there really aren’t a significant number of them, anyway.
  • Donations from individuals outside the 216xx and 218xx zip code area.
  • Donations from businesses within the area. Included in the definition of businesses are LLCs, LPs, and PAs.
  • Donations from businesses outside the area.
  • Donations from PACs. As a way of simplifying this, this also includes transfers from other campaign accounts, and (at my discretion) certain entities that were recognizable as similar to a political action committee, including larger businesses, unions, and governmental entities.

Having these all categorized and built into a spreadsheet, I can figure out several things: proportion of donations coming from each group, proportion of donations inside/outside the area, and an average donation. In many cases, I can compare and contrast candidates – but not always. Read on and you’ll find out why.

House District 38A:

Incumbent Republican (since 2010) Charles Otto vs. Democrat Kirkland Hall, Sr.

For Charles Otto:

  • 2 donations from individuals in area for $525
  • 1 donation from an individual outside of area for $250
  • 2 donations from businesses in area for $450
  • No donations from businesses outside of area
  • 6 donations from PACs and other committees for $4,600
  • Average donation: $529.55
  • Cash on hand (bank account balance) – $15,361.57

Because of one huge PAC donation of $2,500 skewing the results, just 16.7% of Otto’s money came from inside the area, with only 4.3% coming from outside the area and a whopping 79% from PACs and other committees. Out of the 21% coming from individuals and businesses, 13.3% was out of individual pockets and 7.7% was from local businesses.

Since 2010 Charles has had an outstanding loan to his campaign for $22,500. But as you can see, Otto doesn’t make a great effort to supplement his campaign with fundraising – it’s almost like an accident when someone sends him a check given that he’s only had 11 in over 2 1/2 years. Being his treasurer is almost as easy as being mine was.

Having said that, though, Otto is far more circumspect than his opponent.

This is what I found for Kirkland Hall. The first link is a screenshot taken of his most current campaign finance entity, taken yesterday on the Maryland SBE site. The second link is a different screenshot of another open – but considered inactive – campaign finance account for Kirkland Hall. This would appear to be a successful run for the Somerset County Democrat Central Committee. Unlike what I did for my three runs, apparently the account was never officially closed.

Hall has sent in ALCEs for 2 of the reporting periods, so we don’t have financial details of his campaign. But here’s the important issue – Hall is now overdue on his campaign finance reports for two consecutive reporting periods, the latest expiring in August. Enough days have elapsed since the first one was due to incur the maximum $500 fine, and he’s $180 and counting for this most recent period.

Note he was also a scofflaw on the 2018 Annual Report before fimally filing, with another $500 fine that was paid. And it’s not like he wasn’t warned about the May report. Yet the Hall campaign has been actively seeking financing during the time they were delinquent:

And as I can attest, his opponent doesn’t have “big money” flowing into his campaign – unless you count one $2,500 donation that came from the Maryland Farm Bureau PAC. But we don’t know how much Kirkland has because they’re not being forthcoming with their information. Could this be an intentional oversight as this is his campaign’s third offense?

On the other hand, the situation is much calmer in the other two District 38 subdistricts.

House District 38B:

Incumbent Republican Carl Anderton, Jr (since 2014) is unopposed.

For Carl Anderton:

  • 98 donations from individuals inside the area for $9,318
  • 12 donations from individuals outside the area for $2,350
  • 13 donations from businesses in area for $3,750
  • 4 donations from businesses outside the area for $1,500
  • 15 donations from PACs and other committees for $5,250
  • Average donation: $156.11
  • Cash on hand (bank account balance) – $21,048.02

58.9% of his money came from inside the area, with 17.4% coming from outside the area and 23.7% from PACs and other committees. Out of the 76.3% coming from individuals and businesses, 52.6% was out of individual pockets and 23.7% came from businesses.

However, once it became obvious that Carl would not have an opponent his fundraising has all but ceased – since the 2018 report came due in January he’s only picked up a total of $1,850.

House District 38C:

Incumbent Republican Mary Beth Carozza opted to run for Senate, leaving an open seat. Wayne Hartman won the June 26 primary and is only opposed in the General Election by write-in candidate Ed Tinus – one of those Hartman defeated in the primary.

For Wayne Hartman:

  • 83 donations from individuals inside the area for $31,255
  • 16 donations from individuals outside the area for $5,920
  • 45 donations from businesses in area for $29,208
  • 5 donations from businesses outside the area for $2,329
  • 1 donation from PACs and other committees for $1,000
  • Average donation: $464.75
  • Cash on hand (bank account balance) – $3,477.58

86.7% of Wayne’s money came from inside the area, with 11.8% coming from outside the region and 1.4% coming from a different committee. Out of the non-PAC money, 53.3% of his funding came from individuals and 45.2% from businesses. (Those numbers again fall short of rounding correctly.)

Much like Carl Anderton, Wayne all but ceased active fundraising after the primary. Unlike Carl, though, he still got some big checks – only 7 donations netted Hartman $5,550 – which has kept him in the black for his future plans.

Write-in Ed Tinus has mainly filed ALCEs since he began his campaign account in 2014; however, Ed stepped up his game to file a formal Pre-Primary 2 report that showed he contributed $40 to himself but spent $2,605 to leave himself a negative balance of $2,565.

So the undercard is complete – now comes what you’ve all been waiting for:

Senate District 38:

Republican Delegate Mary Beth Carozza (since 2014) is challenging Democrat Senator (since 2010, Delegate from 2006-2010) Jim Mathias.

For Mary Beth Carozza:

  • 518 donations from individuals inside the area for $112,287
  • 122 donations from individuals outside the area for $23,366.06
  • 79 donations from businesses in area for $44,589.38
  • 18 donations from businesses outside the area for $11,305
  • 45 donations from PACs and other committees for $30,288
  • Average donation: $251.51
  • Cash on hand (bank account balance) – $140,987.98

For Mary Beth, 70.7% of her money came from inside the area, with 15.6% coming from outside the area and 13.7% from PACs and other committees. Out of the 86.3% coming from individuals and businesses, 61.2% was out of individual pockets and 25.2% came from businesses. (It rounds off wrong again.)

This is a sea change from her initial campaign, which saw Mary Beth receive a great deal of money from outside the district from her erstwhile cohorts in Washington, D.C. In the 2014 campaign I wrote:

In her first report that covered the inception of her campaign to the initial days of 2014, over 70% of her funding came from out-of-state, mainly from the Washington, D.C. area and Ohio. Those Ohio connections, as well as work for Maine Sen. Susan Collins, proved valuable in the category of federal committees, as Mary Beth received money from the Buckeye Patriot PAC, Dirigo PAC, and Promoting Our Republican Team PAC, as well as the campaigns of Mike DeWine, Steve Stivers, and Pat Tiberi. DeWine is a former Senator from Ohio who is now the state’s Attorney General, while Stivers and Tiberi currently serve in Congress representing parts of the state.

It appears that Mary Beth has since established the local connections to compete in this race against perhaps the most well-funded incumbent in this portion of the state.

For Jim Mathias:

  • 469 donations from individuals inside the area for $91,115
  • 178 donations from individuals outside the area for $43,127
  • 157 donations from businesses in area for $82,339
  • 106 donations from businesses outside the area for $34,914
  • 301 donations from PACs and other committees for $124,610
  • Average donation: $310.57
  • Cash on hand (bank account balance) – $273,873.43

Jim collected 46.1% of his money from inside the area and 20.7% of his funding from outside this region. More importantly, Mathias collected 33.1% of his donation total from PACs and other committees, including a number of his General Assembly cohorts. (Rounding is off again.) Out of the non-PAC money, Mathias picked up 35.7% from individuals and 31.2% from businesses. It’s perhaps the most well-rounded report of any I’ve done in terms of equality of sources between individuals, businesses, and PACs.

With the exception of the brief Pre-Primary 2 period, though, Carozza has outraised Mathias among local individuals in each reporting period. On the other hand, among individual donors from outside the district Mathias has outgunned Mary Beth almost 2-to-1 with a significant amount from connections from the area surrounding his hometown of Baltimore.

From a business standpoint, Carozza has ate into Jim’s longstanding advantage and outraised him among local businesses in the last reporting period. She’s also negated his advantage among out-of-district businesses over the last three periods.

The biggest fundraising advantage Mathias enjoys, then, is the many thousands of dollars he has received from PACs over the last 2 1/2 years. It’s not that Carozza hasn’t received PAC money, but dozens of PACs in and out of the state have been handing over checks to Jim for several years, building up an intimidating war chest. (One interesting donation: ask the progressives if they appreciate Jim getting a check from the NRA. He did – $500 on January 3, 2018. Or ask the NRA if they really want to give money to someone with Jim’s overall voting record.) But Carozza, unlike Jim’s previous opponent Mike McDermott, has the money to compete in what may be the most-watched race in this part of the state.

Considering that Mathias has more in his bank account than the total of all the other candidates in both District 37 and 38 outside the 38th Senate race, and Carozza isn’t far behind (you would have to exclude Johnny Mautz and his $96k war chest to make it about even) and you can see where the focus will be.

Update 9-28-2018: This week Kirkland Hall – after I gave a gentle reminder to some of his supporters – finally filed a portion of his campaign finance:

For the period from August 30, 2017 to June 10, 2018 (the Pre-Primary 2 report) this is what Hall reported:

  • 9 donations from individuals in area for $737
  • 2 donations from individuals outside of county for $300
  • No donations from a business in area
  • No donations from businesses outside of area
  • 1 donations from a PAC or other committee for $500
  • Average donation: $128.08
  • Cash on hand (bank account balance) – $291.56

Hall has already filed his ALCEs for the two Pre-General cycles; however, there is still a balance of $840 in fines as of this date.

The deal with ‘misinformation’

Over the last week or so we’ve been treated to some of the most furious backpedaling we’ve ever seen. I don’t know if it’s the same elsewhere in the state, but the Eastern Shore delegation has been taking an earful from constituents about a bill with the innocuous title “Public Safety – Extreme Risk Prevention Orders.” But that’s not the bill’s original title: as first introduced it was “Seizure of Lethal Weapons – Lethal Violence Protective Order.” Unfortunately, the bill still deals with seizure and arguably does little to promote the safety of the public.

Arguing there “has been some misinformation” about this bill, three members of our local delegation (Chris Adams, Carl Anderton, and Mary Beth Carozza) issued a joint statement vowing that if certain defects aren’t fixed, they won’t back the bill when it comes back from the Senate. Of course, that makes the assumption that the majority in the Senate won’t just pass this unmolested and dare Governor Hogan to veto a bill many in his party detest. (Hint: he won’t. It may not be graced with his signature, but he won’t veto it.)

We’ll come back to Hogan in a moment, but in the last few days since the vote we have heard many excuses from the GOP, most of whom voted for the bill. It doesn’t take the cake of Delegate Barrie Ciliberti co-sponsoring the bill then changing his vote to be against it (unless that change is made for some arcane parliamentary maneuver) but much of the blame has come from being “misinformed” or being “led to believe” Second Amendment groups were behind this. There is an argument to be made that there is so much information being thrown at these elected officials (with this year’s docket exceeding 3,000 bills to be considered over a 90-day period) that mistakes can be made, but then one has to ask: what else are they missing? “You know, the bill sounds good, and it IS public safety…”

It should be noted, though, that the Judiciary Committee in the House did a complete bait-and-switch on this one, perhaps seizing on the hot-button topic of the Parkland shooting. HB1302 was completely gutted and replaced by the Judiciary Committee that the original sponsor (Democrat Geraldine Valentino-Smith) doesn’t sit on. That event happened between the initial introduction and the House hearing, but the bill was marked up in committee on March 12. It passed by a 12-4 vote, and notably several Republicans did not vote on the bill in committee: Delegates Susan McComas, Neil Parrott, and Deb Rey were excused, and Delegate Trent Kittleman abstained. The other four (Joe Cluster, Paul Corderman, Glen Glass, and Michael Malone) voted against it; however, Cluster and Glass were absent from the third reading vote and Malone voted in favor of the bill. Of those on the Judiciary Committee, only Corderman and Parrott voted no.

It’s patently obvious to me that the House Republicans were trying to appeal to the so-called popular opinion that everything gun-related is bad. They read the tea leaves and newspapers and everywhere you turn you’re being assaulted with anti-Second Amendment propaganda. Yet out of our local District 37 and 38 delegation, the only Republican with a really difficult race is Mary Beth Carozza and that’s because she’s opted to try and advance to the Senate. (Valid question: will this vote tip the scale to another NRA endorsement for Democrat Jim Mathias? Ask the liberals in District 38 how they like his receipt of NRA money.) The other Republicans either voted no on HB1302 (Charles Otto) or have stiffer opposition in the primary than they do for the general election – Adams and Mautz have two primary opponents but only one Democrat is in the race.)

Yet this brings up another point about the top of the ticket. Last night I did a bit of research and remembered the 2014 election – you know, that one Larry Hogan shocked the state and won? Well, a significant part of the reason was carrying the suburban counties like Anne Arundel, Baltimore County, and Frederick with over 60% of the vote (collectively, since he was 59% in Baltimore County) and blowing out Anthony Brown in the rural areas with anywhere from 65 to 82 percent of the vote. That made up for soft numbers in the D.C. region and Baltimore City.

The problem Larry Hogan has this time around is twofold, and has a little bit of irony to it: for a Republican to succeed nationally in the cause of limiting government he has to put a chill in Maryland’s economy. Thanks in no small part to the Trump administration, Larry Hogan will be lucky to get 35% in Montgomery County – compared to 36.7% last time. That may not seem like a lot, but out of 300,000 votes losing a 2% share is 6,000 votes.

You can argue, that’s fine, he won by 65,000 the first time. But what if his reversal on the fracking ban costs him 10% of his vote in Western Maryland? The three westernmost counties combined for about 70,000 votes last time and were a significant portion of his victory margin. That could be another 7,000 votes. Taking a similar share from an Eastern Shore upset at his Second Amendment stance and early cave on phosphorous regulations could be another 10,000 votes lost. Without touching the suburban counties, we’ve eroded 1/3 of his victory margin and the rest may come from Democrats who decide to stay loyal and vote for their candidate. (Fortunately for Hogan, the Democratic field seems to all be trying to leapfrog left of each other so turnout may not be as great as the Democrats think they will get. The biggest break Hogan has received in this cycle was not having to contend with either John Delaney or Peter Franchot, either of whom would probably have easily won the nomination against this field.)

Simply put, there are a lot of people who held their nose and voted for Larry Hogan the first time in the hopes he would govern as a conservative. Well, they were surely disappointed and the fear is that they just stay home this time around: why bother voting when you have the same results regardless of which party is in charge, they say. Perhaps it’s an information silo I reside in, but I often see people claiming they won’t vote for Hogan this time (meaning they’ll likely stay home or skip the race) but I never hear of a Democrat who voted for Brown being convinced the Republican is doing the job and will get his or her support. Most Democrats I hear from already voted for Hogan last time.

So this gun bill has really exposed some fissures in the state GOP, and the party brass has to hope their electoral hopes don’t fall through the cracks.

The sidebar sidestory

While I haven’t been hanging around here as much as I used to with this book I’m writing and all, a service I’ve always provided here is being a one-stop shop to link to political candidates in season. And seeing that the season is fast-approaching – the filing deadline is barely a month away – I suppose it’s time to build out the 2018 version of my widget.

One change I think I’m going to make from previous years is to not just link their websites, but their social media as well. It seems now that most of the action on the political position front comes from those sites because they are interactive by nature. So I’ll figure out a way to integrate them into the links.

In looking at some of the local races, the most statewide attention seems to be on the State Senate race between incumbent Jim Mathias and current Delegate Mary Beth Carozza, who’s trying to move up after just one term in the House. If that seems opportunistic, bear in mind that Mathias also moved up after one term and about six months of change (he was appointed Delegate after the incumbent died in office.) However, at the time Mathias ran for an open seat thanks to the retirement of longtime GOP State Senator Lowell Stoltzfus. And while Mathias is best known for being the popular mayor of Ocean City, it’s also the area Carozza represents in the House. Her task will be to catch up name recognition in Somerset County, although it’s likely she’ll get the backing from Stoltzfus and current Delegate Charles Otto to help her along there.

With Carozza moving up, the opening for Delegate in District 38C is shaping up to be an interesting GOP primary. (With the political composition of the district, frankly that is the race.) Four contenders are in the running so far, and it wouldn’t surprise me to see one or two more crowd the ballot. While Ed Tinus, a perennial candidate, moved down from the Senate race when Carozza made it official, the others waited to jump in and made it a race. Wayne Hartman is an Ocean City Council member trying to advance, while Joe Schanno is making a second run eight years after his first in what was then a two-Delegate district. (He finished fourth of the four in the GOP primary.)

There’s not nearly as much suspense in the other local districts. The only other one really worth mentioning at this point is District 37B, where a third business person has thrown his hat into the ring in a district already boasting two in Chris Adams and Johnny Mautz. Keith Graffius is running in large part because Dorchester County doesn’t have a native Delegate – an unfortunate reality in that part of the Eastern Shore where two three-person districts span seven of the nine counties of the Eastern Shore – so someone will be left holding the bag and after the last election Dorchester County replaced Caroline County as the state’s red-headed stepchild. (The District 37 Senator, Addie Eckardt, lives in Dorchester County so they are not shut out entirely.)

Here in Wicomico County, the key races are the County Executive race, which thus far pits incumbent Bob Culver against independent Jack Heath, who has to petition his way onto the ballot, and the new school board elections that will fire up for the first time in 2018. So far only three incumbents on County Council have filed (Democrat Ernie Davis and Republicans Larry Dodd and Joe Holloway) and one challenger had popped up for an open seat – Josh Hastings makes his second try after moving from District 3 to District 4.

Something I’ve found interesting is how many people have already filed for Central Committee races. In the three times I ran, I was not one who waited around – I filed several weeks before the deadline and was normally among the first to do so. (The only election I was a dawdler was my first, but I was still 5th of 7 to file. The other two I was 4th of 13.) These candidates are notorious for waiting until the last minute, but this year there are already enough Central Committee hopefuls on the male side of the Democrat Party and they’re only one short among females. On the GOP side we already have five of nine so they may exceed their previous high-water marks of thirteen in the last two elections. I suspect the same may be true for school board as well. And because of school board, for the first time every voter in Wicomico County may have a ballot to vote on come June since school board is a non-partisan race.

So anyway I will have some work to do over the coming days. Fortunately I have an old widget extant so it’s not much of a chore to do.

The right idea but with the wrong approach

I find the controversy over Governor Hogan’s executive order mandating that Maryland public schools begin classes after Labor Day and wrap up by the following June 15 to be a good opportunity for commentary, so I decided to add my couple pennies.

First of all, this isn’t a new idea. In 2015 and 2016 legislation was introduced in the Maryland General Assembly to create a similar mandate. As proof of how Annapolis works, the 2015 versions only got House and Senate hearings but the 2016 versions picked up the remaining local House delegation as sponsors (only Delegates Mary Beth Carozza and Charles Otto were local co-sponsors in 2015) and got a Senate committee vote. (It failed on a 5-5 tie, with one of the Republicans on the committee being excused. The other two voted in favor.) There was a chance this legislation may have made it through in 2017, but apparently Hogan was unwilling to take the risk. He took the opportunity to make a news event at a perfect time – when most local districts were already a week or two into school, Larry announced this from the Ocean City boardwalk on a pleasant beach day – and showed he was willing to stand up for one of his principles, that being improving opportunities for small business. (At a minimum, with Hogan’s edict kids are off for 11 weeks for summer vacation.)

In reality, what Hogan has done is shift the calendar backward by about a week: for example, Wicomico County public school kids had their last day of school June 9 and returned August 29 and 30. But the thought process is that families are more likely to take a vacation in July and August than they are in June, so because Ocean City is a great tourist attraction the state should follow Worcester County’s lead and begin school after Labor Day. (They simply went an extra week into June, concluding on June 17 this year.)

Granted, our family has enjoyed a post-Labor Day start for a number of years since parochial schools have more calendar flexibility: our child began her summer vacation after classes ended June 3 and returns on Tuesday the 6th. Growing up, I seem to recall the city schools I attended began after Labor Day and went into June but the rural school I graduated from began classes in late August and was done by Memorial Day. (We had a longer Labor Day weekend, though, because our county fair runs that weekend and the Tuesday after Labor Day was Junior Fair Day. Thirty-odd years later, it still is.) The point is that each of these localities knows what works best, so I can understand the objection from those who advocate local control of school schedules. And talk about strange bedfellows: I’m sure many of those praising Hogan’s statewide mandate locally are also those who have fought for local control of our Board of Education – after at least ten years of trying, we finally have a chance for local control (as opposed to appointments by the Governor) over our Board of Education through a referendum this November. (I recommend a vote for the fully-elected Option 2 on Question A.)

So I agree with the objections on those grounds, even though I personally think a post-Labor Day start is a good idea based on the school calendar typically used. (If I truly had my way, though, we would adopt a 45-15 style plan so that summer break is somewhat shorter and kids spend less time relearning what they forgot over the break.) What I don’t see as productive are those who whine about how this would affect preparation for particular tests – that shouldn’t be the overall goal of education. Obviously they would be the first to blame the calendar (and by extension, Larry Hogan) if test scores went down. But Hogan’s not alienating a group that was squarely in his corner anyway, as the teachers’ unions almost reflexively endorse Democrats, including his 2014 opponent, and mislead Marylanders about education spending. It’s increased with each Hogan budget – just not enough to fund every desire the teachers have.

Come January, it will be interesting to see if the Democrats attempt to rescind this executive order through legislative means, daring Hogan to veto it so they can override the veto and hand him a political loss a year out from the election. While most Marylanders are fine with the change, the Democrats are beholden to the one political group that seems to object and those special interests tend to call the tune for the General Assembly majority.

Yet the idea that the state feels the need to dictate an opening and closing date to local school districts is just another way they are exerting control over the counties. We object when they tell us how to do our local planning, so perhaps as a makeup for this change our governor needs to rescind the PlanMaryland regime in Annapolis.

40th annual Tawes Crab and Clam Bake in pictures and text

It was awful tempting to jump on into that water, but several thousand people managed to sweat their way through another hot Tawes Crab and Clam Bake. While Republicans tend to have a little more presence in the area, some of the Tawes regulars were absent because the event coincided this year with the Republican National Convention in Cleveland.

That convention minted the GOP Presidential nominee, who seemed to be pretty popular.

That group of signs dwindled little by little, as Trump adorned a number of tents. On the other hand, there were far fewer Hillary signs – but the Democrats also had their crowded space.

Sarah Meyers (in the blue shirt) is a friend of mine, and she was tearing her hair out as the coordinator there because they overbooked the space. (You may see her at the Democratic Convention next week, as she will be there as a page.) By the same token, the Somerset Republicans only went with one tent as well and it was packed, too. So both parties had close quarters.

Yet the businesses seemed to have ample space. I didn’t peek into every tent, but many of them (as well as businesses lining State Route 413 into Crisfield) had a simple message: welcome Governor Hogan.

Even lobbyist Bruce Bereano, who always has the largest space, got into that act.

Yet among those businesses I did pick out I found an odd juxtaposition there, particularly under the auspices of the local economic development commission.

In order, these businesses are Cleanbay Renewables, which is a chicken waste recycling firm, Pinnacle Engineering, which services NASA, the Somers Cove Marina Commission, and Great Bay Solar I. The last is interesting because this project was originally supposed to be wind turbines, but objections to the siting of the turbine towers from the Navy forced the company to go solar, making lemonade out of lemons. With the exception of Pinnacle, the state has sort of forced the market for the other two businesses.

Yet on the other side was a law firm that objects to the approach the state is using to clean Chesapeake Bay through its Clean Chesapeake Coalition. They believe much of the problem comes from the sediment that leaches out from behind Conowingo Dam in severe storms.

I happen to think the CCC has a pretty good case.

Speaking of business, the food business did pretty well there. Almost too well.

According to my cell phone camera, which took all my photos today, I took that picture at 12:01 as I walked over to get in line for food. Here is the end result, 46 minutes and four lines later.

I actually asked for the onion rings as I inched closer to the front of the French fry line. And I certainly don’t fault the crew because they worked hard, even toward the end when I snapped this.

I think the issue is the increasing use of “runners” who get multiple orders of food and slow down the lines. It seemed like every third person in line was one, which meant those who just wanted to fend for themselves had to wait.

The guy who didn’t have to wait in line was Governor Larry Hogan, because I don’t think he ate a bite.

This is a second segment of time lapse. I took this photo above in the area where the food lines were at 1:57 p.m. Now, let me ask you: where’s Hogan?

He’s barely visible in the center of the photo, obscured by Delegate Charles Otto in the pinkish shirt. In 35 minutes he had advanced maybe 80 yards thanks to the crush of well-wishers who wanted to shake his hand, have a photo with him (although he suggested it in a number of cases) and perhaps say their piece. I was in the latter group as I wanted to thank him for his stance on the Presidential election. Larry commented that he had noticed the reception I’ve received on social media a couple times as it echoed a lot of what he had seen on his.

Stay strong, Governor.

The two major-party candidates for U.S. Senator were also there. Now I missed Democrat Chris Van Hollen – perhaps because I didn’t recognize him walking around – but I did get a glimpse of Kathy Szeliga from the GOP.

Of the people I saw and photographed, she was one of the few I didn’t speak to at least a little bit. I don’t blame her – our paths just didn’t cross but once.

Of course, a few locals managed to be in front of my camera, such as Delegate Mary Beth Carozza, who brought her family and a batch of others from Worcester County.

She was speaking to Duane Keenan from Red Maryland.

The other half of Worcester County must have come with Senator Jim Mathias, who had a number of folks with a matching shirt to his. He was a little peaked by the time I took the moment to thank him for his assistance with the school board election bill.

Yet while we had hot and cold running politicians there, we also had a lot of media asking questions. I noted Duane Keenan above, but here’s Ovetta Wiggins of the Washington Post (right) speaking to Jackie Wellfonder. Jackie made the cut in Ovetta’s story.

I also had the pleasure of meeting Mike Bradley, who hosts WGMD’s morning show out of Lewes, Delaware. Since his station covers a fair amount of the lower Shore in its signal, he was interviewing some of the local players. It’s a very good show that I catch once I cross into Delaware on my way to work.

And it could be that the Tawes event is becoming one for the greater Delmarva area. A delegation of elected officials from the First State included Representative Tim Dukes, who covers the Laurel and Delmar areas in his 40th District.

The reason I’m in the photo on the right: it was taken by Dukes’ fellow representative (and Minority Leader in the Delaware House) Danny Short of Seaford. Since we’re neighbors with Delaware it was nice to see some of their elected officials, too.

In that respect, this coverage was a little lacking because I did a lot of walking and talking to a number of nice folks from around the state. I want to say I overheard Jackie Wellfonder say this, but Tawes really is “like a big ‘ol family reunion.” We don’t often see a lot of politicians travel across the bridge but for attending Tawes, so you have to say hello and speak your piece when you can.

WCRC meeting – June 2016

You know what they say about the best-laid plans of mice and men? It applied to last night’s Wicomico County Republican Club meeting, as the expected legislative wrapup from the remaining non-participants in our May meeting were those slated to speak this month. Unfortunately, the MML conference and a Hogan fundraiser took precedence for those candidates, so it actually fell on a somewhat unexpected guest to deliver a few off-the-cuff thoughts on the session: Delegate Charles Otto, who came up from Somerset County to speak with us. As he was originally elected in 2010 in a district that then included a portion of Wicomico County, he’s considered us his constituents despite the fact he was redistricted out for this term.

Thus, once we took care of doing the Lord’s Prayer, Pledge of Allegiance, and treasurer’s report, we heard Otto’s assessment that “we have a challenge this year” in electing our President and U.S. Senator. On the latter race, Otto praised his colleague, saying of Kathy Szeliga that “I can’t think of anyone better to fill that position.”

As for the legislative session, he felt that we had “a lot of threats” in the 90 days, but “I think we fared well.” Efforts to mandate paid leave and a minimum wage increase were rebuffed, and while he termed the Justice Reinvestment Act “a decent bill,” he admitted it was one of the hardest votes for him to consider in his six years on the General Assembly. To a degree, the same was true for the budget, which was more spending growth than he would have likely preferred.

Otto also believed that the transportation bill will be a “big hurdle” to overcome in the coming years, as it favors larger jurisdictions. But local development may be helped by the Triton unmanned aviation program, which is being considered for Wallops Island. Charles noted it has bipartisan support from all three Delmarva governors, who understand the economic impact this could have locally.

But Otto didn’t have an answer regarding a question about the aging school program and $80 million that was supposed to be included. It was a question brought up by John Palmer, who sits on our local school board. I chimed in with a somewhat rhetorical question about the many funding mandates Democrats seem to be adopting to tie Governor Hogan’s hands when it comes to the budget – could we do a reverse BRFA and try to get rid of them? It made for some discussion, and I was thanked later for bringing up the point. (Perhaps I need to save it for a Democratic Club meeting if I ever go to one.)

For being placed on the spot, Delegate Otto did a nice job, so we turned to the Central Committee report from Mark McIver. He noted that the Secretary of Appointments had selected two new Board of Education members who sounded like fine additions, but both of them applied directly to the Governor’s office. None of the five we interviewed, including the incumbent who desired another term, were picked. Yet McIver was “hopeful” about the selections, noting the Appointments office contacted him regularly through the process with questions.

But now it was time to work on the school board referendum, said Mark. It would involve creating a political committee to promote the fully-elected option.

We also learned Mark has tickets to the upcoming Tawes Crab and Clam Bake in Crisfield and our committee’s next meeting would be pushed back until July 11 thanks to the Independence Day holiday.

Jim Jester revealed “we’ve made progress” on the Crab Feast: we have secured the all-important one-day beer license. Now we just have to get approval from the health department, after he found out he filled out the obsolete old form that was online and was given a longer, more complicated new one.

Shawn Bradley updated us on Third Friday, which “was a nice surprise” with plenty of involvement as the Republican Club has tried to maintain a table there each month. This month they had the political realm to themselves as the Democrats apparently weren’t there.

Our next piece of business was a lengthy discussion about where to place a headquarters this year and how to pay for it. It will be a joint effort between the club and Central Committee, with a number of locations under consideration.

A contingent from the Republican Women of Wicomico was present to speak on their annual Constitution Day celebration on September 17 at City Park. Former Delegate Mike McDermott is the featured speaker, and the festivities will begin early: a 10:30 a.m. start is planned since Somerset County will be celebrating their 350th anniversary that day in Westover, as Delegate Otto pointed out. (It was also noted that we were sitting in what once was Somerset County; that is before it was split along Division Street in Salisbury and Fruitland to first create Worcester County to its east. Both then ceded territory in 1867 to create Wicomico County. So I stand corrected since Somerset preceded Worcester.)

We then found out from John Palmer that Wicomico County Board of Education meetings would soon be streamed online thanks to the PAC14 website. The eventual idea is to allow real-time involvement from those watching.

Finally, we were alerted to a townhall meeting Congressman Andy Harris would be holding tonight (June 29) at Black Diamond Catering in Fruitland from 6-7 p,m,

In less than an hour we had taken care of our business and become more informed. Next month we go off the political board a little bit as our speaker will be Mitzi Perdue. That meeting will come July 25.

WCRC meeting – May 2016

The fact that Memorial Day occurs on a somewhat rare fifth Monday of the month this year provided the WCRC with an “extra” meeting this year, and they took advantage by scheduling something that’s becoming a tradition: the annual Legislative Wrapup. All six Republican members of our local delegation (from Districts 37 and 38) were invited – but thanks to a number of calendar conflicts, only two of them came. It was ladies’ night for the delegation as Delegate Mary Beth Carozza and Senator Addie Eckardt gave their accounts of the recently completed session. (Delegate Chris Adams made the attempt to stop by, but came just after we wrapped up.)

So once we did our usual Lord’s Prayer, Pledge of Allegiance, and introduction of distinguished guests, Eckardt got the meeting underway by praising the state’s $42 billion budget, which needed no new taxes for balance. The reason for this was that the Hogan cabinet was finding more efficiencies in their respective departments, enabling the state to become more business-friendly. One way they were doing this was through fee reduction, although Eckardt noted that some Democrats were fretting that fees were getting too low. Yet the budget allowed for a reduction in the structural deficit and did not feature a BRFA, the omnibus bill where spending mandates are often buried. This year’s spending had “full transparency,” said Addie.

But the push to reduce taxation was one goal of the Augustine Commission, explained Addie. Sadly, the broader tax reform package could not pass thanks to the question of passing a package mandating expanded paid sick leave – despite the fact changes to the earned income tax credit would have helped thousands of working Maryland families that I thought the majority party deigned to represent.

On the other side of that Augustine coin, Addie continued, was the idea of being responsive to constituents; to “change the tenor of government.” This went with a drive to bring things to the county level, as Addie noted “local control is important to me.”

One complaint Eckardt had about the session was the “crusade to get the Red Line back.” It led to the passage of what’s known as the “Maryland Open Transportation Investment Decision Act of 2016.” (I call it the “Revenge for Not Funding the Red Line in Baltimore” Act.) While the bill overall is terrible, Eckardt noted it was amended somewhat to give local jurisdictions a little more priority.

And while she was pleased Wicomico County would be receiving an additional $8.7 million from the state for various projects, Addie was more passionate about a series of initiatives to bolster mental health and combat addiction around the state. She was also happy to see the Justice Reinvestment Act pass, which was a bipartisan effort at criminal justice reform. The state was also doing more to address mental and behavioral health, particularly since she claimed later in the evening it took someone who was addicted and incarcerated two years to re-integrate fully. This led to a discussion about what the state and local governments were doing to deal with the issue of homelessness, to which Muir Boda revealed the city of Salisbury would be embarking on a Housing First program modeled after one in the state of Utah.

Between Eckardt’s main presentation and the later discussion about mental and behavioral health issues, we heard Delegate Carozza’s perspective. She began by praising the club for being a group of workers and doers when it came to advocacy, with the optimistic view that “this is our time…Governor Hogan is turning the state around.” But that was a process which would take at least eight years, said Mary Beth. As an aside, she also believed that Kathy Szeliga was “the candidate that can win” the U.S. Senate seat, which would also lay the groundwork for Larry Hogan’s re-election campaign.

Both she and Eckardt, added Carozza, were in the position to support the budget thanks to their respective committees. They could succeed making suggestions for “walling off” funds for supplemental budget proposals, of which there were two or three each year. And while this budget allowed for what Carozza termed “a well-rounded tax package,” only a minor tax break for Northrop Grumman made it through. But the “good news” out of that was that it was making Mike Busch and Mike Miller talk about tax relief, making it a stronger possibility we may see some in 2017.

As for some of her priorities, Carozza was happy to see the bomb threat bill she sponsored make it through the General Assembly in its second try. (A similar proposal was introduced by then-Delegate Mike McDermott in 2013, said Mary Beth.) She commented about how the broad community support, combined with the “sense of urgency” provided by a series of bomb threats making the news earlier this year, allowed the bill to pass easily. Another bill she was happy to shepherd through was the ABLE bill, which allows the disabled to save money for dealing with their medical-related expenses without jeopardizing their means-tested benefits.

She also stressed that killing bad bills was a part of the job as well, citing the defeat of the poultry litter and “farmer’s rights” bills where she praised Delegates Carl Anderton and Charles Otto as they “led the charge” against those measures. Mary Beth also took the unusual step of personally testifying against the assisted suicide bill and worked to amend the sick leave bill to exempt more seasonal employees. On that bill, she predicted “we’re going to see it again next session.”

Even after hearing all that information, we had some business to do, like the treasurer’s report and Central Committee report that Dave Parker delivered. He called the recent state convention the “get over it, people” convention, noting the party seemed pretty well unified afterward. Even local radio host Don Rush had difficulty finding disunity among a group of Republicans who were his guests last Friday, Parker added. On the other hand, “Hillary can’t close the deal” on the Democratic side.

I added my two cents about the convention to his report, pointing out the National Committeeman race was perhaps the biggest bone of contention and that was relatively minor. But the Fall Convention may be interesting because we will be electing a new Chair, and the question is whether it will be someone who will work more for Larry Hogan’s re-election or to bolster the GOP numbers in the General Assembly. A Hogan win, I added, would make redistricting the key focus for the second term – personally, I think we should strive for single-member districts and Eckardt agreed based on its impact to minorities.

Shelli Neal updated us on the Greater Wicomico Republican Women, who would be holding their next meeting June 16 at Adam’s Taphouse. They had two tickets to the Tawes Crab and Clam Bake in Crisfield to raffle off as part of a membership meeting for the newly-christened organization.

Another fairly new creation was the Wicomico Teenage Republicans, which had “a great start of a club” according to Nate Sansom. While their next meeting was slated for this coming Friday, they planned on taking a summer break and reconvening in August once school started back up. With a group of “passionate people, happy to be involved,” Sansom believed his group would focus on statewide campaigns like Kathy Szeliga’s as well as the local We Decide Wicomico campaign for an elected school board.

Representing the statewide College Republicans, their Chair Patty Miller was hoping to reach each county Central Committee at one of their meetings over the next few months and “see what they need from us.” Her first stop will be this week in Calvert County.

Jim Jester reminded us the Crab Feast would be September 10, but stressed the need for more volunteers – particularly to handle admissions and the silent auction.

Shawn Jester pointed out the WCRC Scholarship winners had a brief story in the Daily Times. But, since the subject was volunteering, he was also looking for people to help out at Third Friday, which we missed this month because no one was available. On that note, a signup sheet was passed around. (We will also need help for upcoming events such as the Wicomico County Fair, Good Beer Festival, and Autumn Wine Festival.)

After all that discussion, and seeing that we had a legislative update where the topic wasn’t addressed, I added one thing to the conversation. General Assembly Democrats sponsored a large number of bills this year that mandated spending. To me, this is an effort to handcuff Larry Hogan when it comes to budgeting but also leaves less room for tax reform. Many of these bills may become law without Hogan’s signature, but they will be law just the same. It’s an issue that I think needs a strategy to address, perhaps a reverse BRFA to eliminate mandates.

We are going to try and get the guys who didn’t show up this month to come to our June meeting, so stay tuned. It will be June 27.

Missing in action?

Each day now I receive an e-mail of news clips from Allison Meyers, who is with the Hogan for Governor campaign. I don’t read every one but I peruse a number of them and one of the items the other day was from Calvert County regarding four legislators out of 26 statewide who are being honored by the American Conservative Union at the upcoming CPAC event.

Needless to say, I had to check the list to see who was on it. Unfortunately, none of our local legislators made this list of 26 – they are among the 38 Republicans who did not make the cut of an 80 percent rating. (And you thought I was the only one who rated legislators based on voting record?)

Just to save you some of the agate type, here are the scores our local delegation received, in rank order:

  • Christopher Adams (R – House 37B) 78%
  • Charles Otto (R – House 38A) 78%
  • Johnny Mautz (R – House 37B) 72%
  • Carl Anderton (R – House 38B) 67%
  • Mary Beth Carozza (R – House 38C) 67%
  • Addie Eckardt (R – Senate 37) 50%
  • Jim Mathias (D – Senate 38) 43%
  • Sheree Sample-Hughes (D – House 37A) 33%

Eckardt was the lowest Republican in the entire General Assembly, while Mathias was tied as the top Democrat in the Senate for the second year in a row. [I also found 2014 ratings. Last year Mike McDermott would have received an Award for Conservative Excellence (90% or better) while Jeannie Haddaway-Riccio was due an Award for Conservative Achievement (80%-89%).]

In looking at the ACU list, many of the bills also found their way into the monoblogue Accountability Project; however, my list is a little more broad since I took 22 floor votes and include the budget. But if my memory is correct the ACU and I saw eye to eye on every bill they scored so I would have had a perfect 100. (The only one to do so.)

Normally when Republicans fall down my list it’s for one (or more) of three reasons:

  1. They vote for bloated spending bills. I haven’t liked a budget yet since I began the mAP, so voting in its favor always works against them. I’m leaning against this year’s budget only because I think 5% growth is excessive.
  2. Civil libertarian laws. Two key examples this past year were marijuana and civil forfeiture. I’m for stopping crime but if someone can brew their own beer they should also be able to grow their own marijuana. Regulate it like alcohol. Meanwhile, government greed is leading them to police for profit rather than safety.
  3. Environmental bills. They get too cozy with the Chesapeake Bay Foundation and other backers of Radical Green. Let the regulations in place have a chance to work before dreaming up new stuff.

So I was a little disappointed to see none of the local legislators make the list, although had they had two more bills to score Adams and Otto may have made the 80 percent threshold. But it is tough to score well in any such rating system so hopefully we will see better in the 2016 edition.
