Border security, VA among chief concerns at Harris Salisbury townhall

It was a fairly packed house at the Veterans of Foreign Wars Post 194 in Salisbury as Congressman Andy Harris held the second of four proposed town hall meetings in the district. After speaking in Easton on Wednesday, many of those same topics came up last night.

But the first order of business was recognition. After pointing out that unemployment among veterans was higher than the average – “I can’t figure that out,” Harris said – Andy presented a Congressional Citation to Chris Eccleston, who operates Delmarva Veteran Builders, a local construction firm which specializes in giving veterans job opportunities upon return to civilian life.

Once that presentation was out of the way, Harris introduced his “three things of great concern.”

As opposed to past negativity about the situation, Andy considered the declining deficit as a piece of good news, noting that federal spending had been fairly level for the last three years. The annual deficit is down $550 billion from its peak, although the aim of the House is to eventually bring the budget back to balance. Andy, however, conceded that the “House’s goal is to balance the budget in ten years.” So while it was still important, Andy wasn’t as concerned about this as he was the following three.

He also said there was “good news on the energy side,” pointing out we now produce more oil than we import and should be the leading world producer of both oil and natural gas by year’s end. The oil production was helped by technology which allowed what he called secondary and tertiary production from existing wells, as opposed to the primary production from new drilling.

On the other hand, Harris believed that, “in terms of immigration, the system is broken.”

“The border is just not being enforced,” he added, noting that Texas Governor Rick Perry has called out his state’s National Guard to assist with border security. In legislation recently passed by the House, added Harris, funding was included for governors who, like Perry, decide to call up their National Guard to address the situation.

“We can’t afford to have a border that’s not secure,” explained Harris.

The news was equally troubling on the foreign policy front. “The world is more dangerous now than it was six years ago (before Obama took office),” said Harris. It wasn’t just the Middle East, either – Andy touched upon the Chinese carriers now patrolling the South China Sea, well outside their territorial waters.

And while we were reaping the effects of our decrease in defense spending, Andy continued, we were also suffering from a lack of trust. Our allies could now doubt our sincerity based on recent actions.

After expressing his main concerns, Andy took questions from the audience. As my editorial license, I’m going to cluster them into areas of concern – on top of the list was our most recent crisis.

Immigration. Many of the questions dealt with various aspects and concerns from those attending about the situation on our southern border and the resettlement of “unaccompanied children.”

Much of the problem could be traced to the passage of a 2008 bill intended to counter human trafficking. Andy noted that the law as written provided the assumption that children from certain Central American countries were being brought for the sex trade, which was a problem at the time. It was estimated that perhaps 2,000 children a year would be affected, with the idea being that these children would get a hearing to ascertain their status.

Unfortunately, the crush of those claiming status under this law and the DACA order signed by Barack Obama in 2012 means that the waiting period for these hearings is anywhere from 18-60 months – and only 46% of those called show up, Andy said. One third of them are “granted status,” he added.

“We should close the loophole,” said Harris. “I don’t see how you get out of the problem without changing the law.” We also needed more judges on a temporary basis to expedite the hearing schedule.

A solution the House could offer to rescind Obama’s order would be that of defunding the executive action, for which there was a bill. And while some were pessimistic about such action given the Senate, Harris stated that the Senate could agree to “a compromise deal over a much larger package.” My concern would be what we would have to trade away.

Andy also pointed out that the resettlement of these children was more or less being done without telling local officials, noting when the Westminster facility was being considered the word came down late on a Thursday afternoon in a week the House wasn’t in session on Friday. It eventually led to the question about those being placed in Maryland.

When asked how many were in the First District, Harris conceded he had “no idea…nobody’s telling us.”  But he continued by saying, “your school system will be affected,” adding that many of these children can’t read or write in Spanish, let alone English.

And the fact that these children aren’t necessarily being screened, vaccinated, or quarantined if necessary was also troubling to Harris. “The CDC is cognizant of it,” said Harris, who had spoken himself with the CDC head. Of course, the children are but a small portion of those crossing – perhaps 10 percent, said Harris.

“The real solution is you have to secure the American border,” concluded Harris. Rapid hearing and swift repatriation would send the message to parents in the host countries that it’s not worth the expense and risk to send children northward to America.

The VA situation. Given that the town hall meeting was being held in a VFW hall, there were concerns aplenty about the state of the Veterans Administration and its health care.

As part of a VA reform bill which recently passed and the VA has 90 days to implement, veterans who live over 40 miles from a VA facility are supposed to have the option of a private physician to address their needs. But Harris pointed out there was some interpretation involved based on whether the VA would extend that standard to an appropriate facility for the type of care needed – for example, something only handled in Baltimore. Harris hoped the interpretation would allow veterans on the Lower Shore to use closer local facilities, for which our local regional medical center could be a substitute provider, rather than make them travel to Baltimore because there was a VA clinic inside the 40-mile range but it couldn’t address the need. “They regulate, and we have to watch them,” said Andy.

The ultimate goal was “to make the VA system compete,” said Harris.

Entitlements. On a related note, one questioner asked about protecting Social Security and Medicare.

Andy believed that “you can’t change the law retroactively,” meaning that the status quo should prevail for those 55 and older. On the other hand, those in the younger generation “don’t expect all of it,” so the time was now to begin the discussion on preserving what benefits we can. The question was no longer if we got to zero in Social Security and Medicare, but when – Social Security tax receipts peaked two years ago and were now slowly declining . “We know the figures,” added Andy.

The system is “not sustainable…shame on us” in Congress for not addressing it.

Foreign policy. There were a couple questions which dealt with this topic, one on Ukraine and one on defunding Hamas.

Regarding Ukraine, one piece of “bad news” which could affect us locally was Russia’s decision to halt chicken imports from America. Their preference for dark meat nicely complemented our love of white meat, so while it wasn’t a large market it was an important one.

But in the geopolitical sense, Harris was relatively blunt. “We let it all go too far (and) should have put a stop to this in Crimea.” Andy pointed out that Ukraine gave up its nuclear weapons in the Budapest Memorandum, which we were a party to along with Great Britain, Russia, and Ukraine. As expected, Russia violated its end of the deal, but Harris noted “I don’t know where it ends.”

As for defunding Hamas, the House did so in its FY2015 budget. In it is a provision that states if Hamas is included in a Palestinian Authority government, we would withhold funding from them.

Andy added that he was “disappointed” in the administration’s lack of Israel support, and blasted Hamas for “purposefully aiming (their rockets) into civilian areas – that’s terrorism.” He added, “The war was started by Hamas…Israel has to end it.”

Impeachment/lawsuit vs. Obama. It actually started as a comment from the audience while Harris was explaining his answer to the immigration issue and Westminster situation.

“I think Obama is an enemy of the country,” it was said. And when Andy pointed out he was duly elected as President, stating, “nobody is claiming (Obama) wasn’t elected fair and square,” the audible murmur in the audience indicated otherwise.

But Andy believed suing Obama over his lack of adherence to the Constitution was the best choice. “Let the Supreme Court decide,” he said, as the proper procedure for changing law was supposed to lead through Congress. He would not vote for impeachment, but would rather the lawsuit run its course. I don’t think that was the popular sentiment of those assembled.

Term limits. This was actually the first question out of the chute, and Andy was clear about the questioner’s desire to see them enacted: “I couldn’t agree with you more,” said Harris. He bemoaned the lack of co-sponsors to a Joint Resolution he introduced last year holding both Senators and members of Congress to 12-year limits. “Part of the problem is that people view it as a lifetime job,” said Andy. Most agree term limits are necessary, so Andy held out hope that the 2014 campaign will bring out a new “Contract With America” promising a vote on the issue.

Common Core: It was actually asked as an awareness question regarding the new AP history framework, to which Harris could only promise to “look into this.” But there was language being considered for the appropriations bills which stated the federal government couldn’t provide incentives to adopt Common Core, as they did for Race to the Top federal funding.

Transportation/energy. Answering a question about bringing light rail to this area, Harris opined it was “some of the least efficient ways to transport people.”  He preferred a surface transportation system, such as busses, because they’re more flexible – if the development doesn’t follow the rail system, there’s no chance of adjusting it to suit.

On the related subject of energy, Harris believed it was easier to produce fossil fuels while researching the next generation of energy harnessing, such as fusion or hydrogen cells. At this point, “fossil fuels are the coin of the realm,” Harris said.

Maximizing our resources also provides us an opportunity to counter Russia’s “ability to use energy for bad ends.” He also warned that Canada would either send its crude to us through the Keystone XL pipeline or ship it to China.

Manufacturing. Finally, we’ll get to the question I asked about making things in Maryland and America.

Andy began his answer by referring to the practice of tax inversion, which has made news lately. He blamed our “horrendous” corporate tax rates for being an incentive for companies to stray offshore, or even just across the border to Canada (which has a 15% corporate tax rate compared to our 35%.) “We live in a global environment,” said Andy, so the obvious solution was to cut our corporate tax rates.

Rather, Washington was thinking about trying to make the practice more difficult. Harris feared it would encourage more inversions.

Other steps to getting things made in America were to continue promoting cheap energy – as methane is the basis for many plastic products, having an abundant supply would be crucial in that area of production. We could also work on scrapping some of the over-regulation plaguing our job creators.

After the hourlong forum, Andy stayed around for more questions and answers. I thought the give-and-take was excellent, and it’s a shame more local media wasn’t there.

A look ahead: 2014 on the national front

This will be, by far, the trickiest of these columns I’ve taken the last three days to write. There are so many unknowns that even the “known unknowns” pale in comparison. But as the conservative, pro-liberty movement stands currently there are a number of items for which we can reasonably be certain 2014 will bring some kind of resolution.

First and foremost among them is that the goalposts will continue to be moved for Obamacare. As originally envisioned, we would all begin feeling its full effects tomorrow, but self-imposed – and I mean self-imposed, because few of these changes went through the legislative branch – changes have pushed back the deadline for many later into 2014 or even 2015. At this point, the strategy seems to be that everything bad about Obamacare gets blamed on Republicans who were really pretty powerless to stop its enactment in the first place – remember, Democrats had a clear majority in the House and a filibuster-proof majority in the Senate from January 2009 to February 2010 when Scott Brown was sworn in – and those few popular items are all due to the Affordable Care Act. That seems to be the preferred, focus group-tested name now because Obamacare has a bad connotation.

Meanwhile, we are supposed to be beyond the prospect of a government shutdown (really a slowdown) which Republicans were deathly afraid of for some reason. I don’t recall any hardships in October, do you? My life seemed to be unaffected. Nevertheless, the GOP seems to be afraid of its own shadow so when Democrats threaten to shut down the government the GOP snaps to. It’s sickening.

By that same token, the ball is supposedly being teed up for immigration reform (read: amnesty) over the summer, once GOP Senate incumbents know their filing deadline has passed. There’s no question a schism over immigration is developing in the Republican Party just as Obamacare is splintering off those Senate Democrats who face re-election in states Mitt Romney carried in 2012. I say primary ’em all with conservatives so that maybe the incumbents will be scared straight.

Those are some of the key domestic issues we’ll be facing. I can guess two or three which won’t come up as well.

We will see absolutely zero effort to reform entitlements, whether Medicare, Medicaid, or Social Security. This will be another year they hurtle toward insolvency, probably going splat just in time for Generation X to reach retirement age in about 15 years. (That would be me – I’m on the cusp between Gen X and Boomer.)

Nor do I care how many articles of impeachment are drawn up: the House leadership doesn’t have the courage to pursue it, nor would they ever get the votes in the Senate to convict. They could find Barack Obama in bed with a dead girl, live boy, a bloody knife in his right hand and a signed confession in his left and the Democrats would swear the boy set him up and the girl stabbed herself thirteen times – in the back – and not convict him.

It doesn’t matter how poor the economy is, either. The government won’t dare stop priming the pump to the tune of a trillion dollars a year in debt, parceling out $80 billion or so of “quantitative easing” monthly. When the Dow and its record highs are the one factor of success apologists for Obama can point to, anything which maintains that facade will be continued despite the possibility of long-term inflationary catastrophe – again, probably in time for Generation X to retire.

Just as ineffective is our foreign policy, which has been a muddled mess as old friends are ignored and longtime enemies coddled. We may have an idea of what the hotspots may be, but events have a way of occurring at the most inopportune times and places for American interests.

All this points toward the midterm elections this coming November. While Democrats are talking up their chances of regaining the House, the odds are better that Republicans will instead take the Senate. The sixth year election in a President’s term is traditionally a bloodbath for his party, although the one exception over the last century was during the term of the last Democratic president, Bill Clinton in 1998. At that time, though, the economy was in pretty good shape and the modest gains by the Democrats in the House weren’t enough to swing control back to them. (The Senate stayed in GOP hands, with no change in the 55-45 GOP majority.)

Looking briefly at the Maryland delegation, all indications are that all of our eight-person Congressional delegation will seek another term, although only Fifth District representative Steny Hoyer and Seventh District Congressman Elijah Cummings have filed so far. The most spirited race may be the Sixth District, where 2012 U.S. Senate candidate Dan Bongino is expected to take on freshman Democrat John Delaney.

But there’s still time left for the 113th Congress, which will have to deal with the mercurial Barack Obama for another year before we enter the home stretch of what seems like a couple decades of the Obama regime. There’s little doubt that conventional wisdom will be set on its head again and again over the next year, a real-life version of trying to predict the upsets we all know will occur during March Madness. It’s all about who comes out on top, but my bet is that it won’t be the American people.

Odds and ends number 52

As usual, the collection of oddities and things I run across which merit a paragraph, two, or three. Once I figure I’m up to 600 words or so I decide it’s time to add another chapter to this long-running series.

So let me begin with the shrill diatribes of one Pat McDonough. I’m going to pick out two paragraphs from a release he put out today.

The President’s fiat providing amnesty rights to illegal aliens by allowing them to acquire work permits circumvents the Congress and violates the Constitution and the Federal Immigration Act.  This political stunt initiated in an election year cries out for immediate impeachment hearings and a preventive federal lawsuit. Congressman Steven King of Iowa, the Chairman of the Immigration Reform Committee, has announced that he will launch a federal lawsuit to stop Obama’s reckless executive order.

From a practical point of view, the President’s actions will seriously hurt American workers. Twenty-four million people are underemployed in this nation and 43% of the unemployed have been collecting benefits for more than 6 months.  With a stroke of a pen, Mr. Obama has generated 1.5 million new work permits to people who are in our country without lawful presence.  The result is 1.5 million jobs will be stolen from Americans.  This illegal action is designed to promote his re-election at a time when we are suffering a “jobs depression” which he has been unable to resolve are unbelievable.

Pat is mostly correct in what he says, but it seems to me the message needs to come from other venues as well. After all, when the first thing out of Pat’s mouth in the wake of Obama’s Friday announcement was a call for his impeachment – a wish that stands less than zero chance of happening in this political climate – it makes McDonough look too much like an opportunist. Never mind he’s toyed with the idea of running for several offices before keeping the one he has.

On the other hand, I get more of a impression of sanity with Larry Hogan and Change Maryland. Referring to budget trends among the states based on data from the National Governor’s Association, he also managed a swipe at the outgoing incumbent:

“What happens when you increase spending by more than most other states and you pass 24 tax and fee hikes? You end up having the biggest job loss in the nation,” said Change Maryland Chairman Larry Hogan, referring to the latest U.S. Department of Labor report which showed Maryland leading the nation in lost jobs.

Now I will grant that Hogan was also in and out of a electoral race, bowing out midstream in favor of Bob Ehrlich in the 2010 gubernatorial race, but he’s not cultivated a reputation for bombast like McDonough has. There are ways of selling one’s self which are more effective than others and Hogan seems to have that knack.

Turning to other state events, Senate Minority Leader E.J. Pipkin blasted the secrecy of expanding gambling in Maryland.

“The (Workgroup to Consider Gaming Expansion) is operating in the privacy of a windowless, third floor conference room in the Lowe House Office Building without a single member of the public present. If this isn’t a sad example of the proverbial ‘smoky back room,’ I don’t know what is.” said Pipkin. Earlier Monday morning, a Pipkin staffer was barred from the Workgroup’s meeting.

“Behind closed doors, and out public sight, this group is crafting policy,” said Pipkin. “Maryland’s emerging casino gaming industry will soon be pumping millions into the state’s coffers, and now the workgroup is cutting deals in private. Members of the public who wish to attend these meetings should not be barred. Obviously the O’Malley administration has no interest in a transparent process or open governance.”

“They are pulling every political trick of the trade to ram through a sixth casino location in Prince George’s county and table games at all six casinos.  The Governor’s staff operates like a crew of barroom bouncers guarding the door and refusing public access to these secret meetings.”

Bear in mind that the eleven-member group was selected by three politicians: Governor O’Malley, Senate President Thomas V. Mike Miller Jr., and House Speaker Michael Busch, all Democrats. So imagine if a Republican had such secretive meetings – it would set off a firestorm of withering criticism from the press. Instead, it’s left to Pipkin to make his statement while the workgroup hammers out a bill for a July Special Session.

If you’ve been following the Dan Bongino campaign as I have, you probably know he did a money bomb last week, raising  nearly $15,000 according to this Gazette article. While the paper correctly notes that Ben Cardin has a huge cash advantage at this date, it’s also worth stating that Bongino’s $60 or so average contribution is peanuts compared to the thousands of special interest dollars Cardin seems to have at his beck and call. Just as one example, it’s interesting how much attention has been paid to our Eastern Shore postal distribution center since the letter carriers’ union and postmasters forked over $10,000 to “our friend Ben’s” campaign coffers – and that’s just since the beginning of 2011.

I have no problem with money in politics, but it’s amazing to me where all Ben’s money comes from.

Speaking of money, the Worcester County Republicans raised enough, through a number of means, to at least make one of their planned two billboards a reality. I’m told by Don Stifler, who sent along this photo to me, that the sign is located just north of the Virginia line along U.S. 13, so I’ll have to look for it in my upcoming travels down that way.

Honestly, though, I’m not sure the sign isn’t too clever by half in its reference. There’s no question we need to get rid of Obama, but I think there could have been a better message. Regardless, the sign is what it is and I’m sure some people will tell me that it’s a perfect analogy – to each his or her own, I guess.

I’m going to close with a riddle – what do Afghanistan and Mexico have in common?

You probably know from a previous article that my blogging friend Bob McCarty is trying to raise funds to help him launch his upcoming book. But he raises some good questions about the similarities between events in Mexico and “green on blue” attacks in Afghanistan that bear closer examination – not that much of it is forthcoming from those who can address the issue. And in both cases, people are winding up dead.

Meanwhile, Bob is about 1/6 of the way to his goal. No doubt a lot of people want money these days, but if the subject seems interesting perhaps you can help Bob out. (You can even rattle my tip jar, too.)

So there you have it, as I actually went way beyond my 600-word barrier, even though I counted the blockquotes. I wrote a lot nonetheless, so I hope you learned at least as much as I did.

Impeachment bid spurs full-fledged protest

While the impeachment of state Attorney General Doug Gansler by Delegate Don Dwyer of Anne Arundel County is widely expected to be considered out of order by House leadership, this effort has sparked a protest which will occur tomorrow morning in Lawyers Mall.

Billed as a “Constitutional Freedom Rally,” supporters urge that a message be sent to Maryland elected officials that the public will not tolerate lawlessness nor will Constitutional violations be unchallenged. Organizers expect hundreds of people to rally beginning tomorrow morning at 9 a.m.

The Maryland marriage controversy

When Maryland Attorney General Doug Gansler opined that Maryland should recognize the same-sex marriages of couples wed in the District of Columbia, he overturned precedent set in 2004 by former AG Joseph Curran and ignored a 1973 state law recognizing marriage solely between one man and one woman. Delegate Don Dwyer quickly denounced Gansler’s ruling and announced a bid to impeach the Attorney General.

While Dwyer is no stranger to impeachment proceedings over same-sex marriage, attempting to remove Baltimore City Circuit Court Judge M. Brooke Murdock for her ruling declaring the state law unconstitutional, he’s noncommittal thus far on whether he’ll include Governor O’Malley in his impeachment crusade as O’Malley publicly backed Gansler Wednesday.

An impeachable offense?

The argument over same-sex marriage continues, but has drawn a companion sidebar regarding Maryland Attorney General Doug Gansler’s interpretation of his job vs. existing laws. Cue House of Delegates member and same-sex marriage foe Don Dwyer:

On March 31, I will be bringing Articles of Impeachment against Maryland’s Attorney General Doug Gansler at approximately 10am on the Floor of the House of Delegates. Please read further as to why I feel that I must take this action.

If you support me, please consider coming to Annapolis in a public show of support for upholding the Constitution.

Maryland recently recognized same sex marriages for the purpose of marital benefits. The recognition of same sex marriages performed in other states was not enacted by the Maryland legislature nor was it mandated by Maryland courts; rather it was the independent decision of Maryland’s Attorney General Douglas Gansler, released on February 24, 2010.

Because this was a blatant attack on Maryland’s current law that states: “Only a marriage between a man and a woman is valid in this state” and because this action is clearly a violation of the separation of powers related to the three branches of government, the Attorney General was put on public notice that impeachment charges were being drafted.

As if the Attorney General was not in enough hot water, on March 1, 2010 HE DECLARED HIMSELF UNIMPEACHABLE in an attempt to thwart any attempt by the legislature to hold him accountable for usurping their authority. Unbelievably, the Attorney General went to a subordinate member of his staff, Mr. Dan Friedman to write the letter addressed to Maryland’s Speaker of the House, stating that the Attorney General could not be removed by impeachment.

Mr. Gansler’s actions have put Maryland in a constitutional crisis. The highest law officer in the state who is an elected member of the executive branch of government has violated his Oath of Office and has revealed his incompetence, and his willful neglect of duty. As a constitutional officer, he must ensure that the provisions of the State and U.S. Constitutions are upheld in all cases, including a constitutional charge against him.

Attorney General Gansler testified in his official capacity two years ago in support of a gay marriage bill. He said that iit (sic) would be hard to not try to correct an injustice in the law. His testimony publicly revealed his partial and prejudiced position on the subject of same sex marriage. Mr. Gansler violated his oath of office in which he swore to perform his duties in an impartial and unprejudiced manner.

After revealing his bias on the issue, he was asked by a member of the Senate to advise on the legality of Maryland recognizing same sex marriage contracted in other states. Despite the fact that the Office of the Attorney General addressed that very same question in 2004, and despite the fact that no court ruling, or legislation has overturned that 2004 opinion, Mr. Gansler released a “new” opinion in which he “interprets” the law as supporting the legality of recognizing out of state same sex marriages.

In short, the Attorney General decided that a standing Maryland law is an “injustice” and subsequently misused the authority of his office to effectively change the law without having gone through the legislative process defined in the Maryland constitution.

If this goes unchallenged, the next Attorney General is likely to follow this precedent and usurp the authority of the legislature based on his personal bias. As result, citizens will no longer have the representation that is provided them under the Constitution.

The stage is now set in Maryland for a Constitutional show down. On March 31st a charge of impeachment will be brought before the Maryland House of Delegates at roughly 10:05 am. The House Speaker has publicly stated that he will rule the charge out of order citing the opinion that the Attorney General cannot be impeached as the authority for the out of order ruling.

Regardless of your personal view on same sex marriage, the recent activities of the Maryland Attorney General should give us reason to pause. Again, the Maryland Attorney General has taken for himself; the powers vested in the legislature and declared himself unimpeachable and unaccountable to the citizens of Maryland?

In case you’re wondering, I am pondering making this into an Examiner story closer to time but want to do a little bit of research and ask questions first. But in the meantime, I believe Dwyer has a case – at the current time Maryland law indeed states that marriage is between one man and one woman (and has said so since the early 1970’s.) If the General Assembly wants to have that fight, that’s one thing (and this may be considered after the safety of re-election next year) but for the moment that prospect is a no-go.

On the other hand, while Dwyer has a case, the actual prospects of getting Gansler out of office reside between slim and none, with slim having just vacated the premises. It would be a much better move to find a strong Republican candidate to oppose Gansler and perhaps make this election a referendum by proxy on the subject at hand. If Gansler isn’t Attorney General he’s free to make all the erroneous judgments of law he wishes, since it will no longer be as a representative of the state of Maryland.
