Campaign finance, Salisbury style

With just a week to go before the election, we finally learned who was giving and receiving the most money of the dozen-plus candidates running for office in the city of Salisbury. (Thanks to the Salisbury Independent for sharing the city’s information in their summary.)

After reading through the various reports, one thing is clear: Jake Day is great at raising money. Despite the fact we learned weeks ago he would be unopposed, contributors have still dropped nearly $25,000 in his campaign coffers. (As I recall, there are options to wind down a campaign account once the cycle is through, so Day may have the opportunity to select from a number of willing groups and share the wealth.)

Last time around in the former District 1, Shanie Shields outraised and outspent her two opponents, one of which was the current office seeker April Jackson. The same is holding true this time, as Shields holds a roughly 3-to-1 fundraising advantage over her two opponents combined. Newcomer Sarah Halcott is the third person in the race.

The advantage is even more pronounced in District 2, with Muir Boda miles ahead of his three opponents. Before I go on, I will disclose that I am a recipient of advertising money from Boda, but two things jumped out at me from his opposition.

First, Keyvan Aarabi only lists $200 in contributions but nearly $900 in spending, so the question is whether they failed to report candidate loans. (Perhaps they made that oversight.) But that’s better than not reporting at all, which Marvin Ames failed to do. The third aspirant, Justin Gregoli, reported his activity did not meet the threshold for itemizing.

In District 3, where two incumbents are battling it out, Jack Heath has raised money while Tim Spies is funding his own efforts, vowing to return contributions. Compared to Heath, newcomer Kevin Lindsay barely registers, having raised just $370 for his bid.

After I disclose that District 4’s Roger Mazzullo is also an advertiser, let me point out that he is by far the most successful political newcomer when it comes to fundraising, raising $3,450 so far compared to outgoing Mayor Jim Ireton’s $870. (In an effort to portray himself as the little guy, Ireton is limiting contributions to $20 – of course, he has the advantage of name recognition that Mazzullo has to spend money to build.)

Finally, since Laura Mitchell is unopposed in District 5 she filed the report stating she had raised and spent less than $600. Given that District 5 voters have no choices on the ballot I would be surprised if more than 100 show up. Turnout in city elections is already abysmal, so 200 to 250 votes in any district may be plenty.

(A total of 2,775 voters participated in the 2013 election, which was citywide and had all contested races. With the lack of a mayor’s race and no contest in one district, I think we’ll be hard-pressed to see 2,000 votes total. Hope they surprise me.)

As we enter the home stretch, we will see what the candidates do to maximize their positions. If money equals votes, City Council could be very receptive to the pro-business side of Jake Day’s agenda.

Rent stabilization shot down in flames

Well, that went over like a lead balloon.

Susan Canfora at the Salisbury Independent did a nice job wrapping up what seems like a one-sided hearing on the rent stabilization matter.

But the question from Councilman Tim Spies deserves an answer – why did this come up weeks before the election? I have a couple theories on this, one involving the immediate future election and one three years hence.

In the immediate election, he needs to make sure he has turnout among his base. A significant portion of Ireton’s district is either in minority areas or lives in rental housing so he has an issue he can bring up on the campaign trail.

But the real payoff, I feel, is in 2018. Jim needs to stand behind a progressive agenda to contrast him with his likely opponent, Delegate Carl Anderton. I’m not saying the agenda has to be enacted, just proposed.

And Jim’s now in a good position to blame failures on someone else while taking credit for successes. For example, if downtown revitalization continues under the Day administration, he’ll be quick to say he got the ball rolling but if things go south Jim can toss the new mayor under the bus. (This also holds true if Jim decides to square off with County Executive Bob Culver, but I think Delegate is the more likely play.) I think this is the best explanation why Jim didn’t seek another mayoral term – if he thought he had the record to beat Jake Day he would have.

There were a lot of holes in Ireton’s rental plan; for starters it only affected single dwelling units and not multi-family complexes. It would also put landlords in the perverse position of arguing for a higher assessment in order to be able to charge more rent.

So now this goes on the “mayor’s list.” That is interesting because that’s Ireton’s list for another few weeks before Day gets it. I’m not sure how long of a list he has, but let’s not cross that one off as an accomplishment anytime soon.

Is the rent really too damn high in Salisbury?

Facing his final few months as Salisbury’s mayor, Jim Ireton decided to be Santa Claus. You know the old adage about a democracy lasting until the people figuring out how they can vote themselves a piece of the treasury? This is really a proposal for the 2018 Ireton campaign.

In a Facebook posting, the mayor explained his reasoning.

Today I announced that I will forward to the City Council a Rent Stabilization Initiative aimed at bringing rents in Salisbury into line with national averages. This is a common sense step which will have very real results for residents who find themselves living paycheck-to-paycheck, struggling to make unnecessarily exorbitant rent payments. I was asked by someone earlier today “Why now?”

Here’s why:

  • 59% of renting households are cost burdened, and 36% of households are severely cost burdened, i.e. paying 50% or more. This means that over 1,600 Salisbury households are paying between 30% and 50% of their income for rental housing costs, and an additional 2,700 households are paying over 50% of their income for rental costs.
  • The lack of affordable housing in Salisbury has a quantifiable negative impact on our local economy. High cost burden means households are spending less on food, transportation, health care, and apparel, while accruing little-to-no wealth. If housing was affordable for all renting households, an additional eight million dollars a year would make its way back into the local economy.
  • From 2000-2008 rents rose dramatically, over taking the national average, as a result of increased energy costs and a doubling of the average home price.

If we want and expect to do better for the people in this City who are hurting the most, then we cannot shrink from this tough discussion -and I can tell you that I won’t. Our residents pay far too much for the quality of the rentals that they live in, and far too many of them are severely cost-burdened. In the end, renters know when they are paying too much in rent; it’s when there’s no money left on the 2nd of the month. We have tried endlessly for 30 years to address the problem of the greed of the rental industry in Salisbury. This Rent Stabilization Program is good for our residents, good for the local economy, and will allow the City to get a return on the investment it makes in its citizens.

It’s small wonder that there’s a chorus of renters who agree. They think they are getting something for nothing but what they will get are fewer choices or more substandard dwellings.

But let’s look at some of these claims. Ireton says that a large percentage of renting households are overburdened. However, his proposal only addresses individual houses, not multi-family dwellings, so only some portion of the population would benefit. We aren’t given the number who would actually be affected.

And I still can’t quite wrap my head around how additional money makes it into the local economy, because it’s not really additional money. The renters aren’t making any additional money on the deal. Granted, they may gain some choice on where to spend it but this is pretty much a zero-sum game.

Ireton is playing the old class envy card here, pitting poor, struggling renters against a class of businesses his allies derisively refer to as “slumlords.” It’s a convenient target to evoke sympathy, but one tends to forget that these businesses and individual homeowners are also investors in the community. The $8 million the renters save isn’t just sitting in their pockets – they are paying workers to oversee their properties, spending money on upkeep, or, as individual homeowners who depend on rental income, they buy food, transportation, health care, and apparel too.

Let’s imagine for a moment that this initiative passes – and given the current composition of City Council I could see three votes to make it happen. What incentive is there for people to invest in housing if the return is arbitrarily limited by the assessed value of the house, something that’s determined on a triennial basis? Once a house is maxed out on rent, in effect the price is frozen for the remainder of the three years unless the city benevolently changes the formula.

In the meantime, the decrease in money coming in makes investment less worthwhile, so housing prices will sag. Arguably that’s good for renters who may want to purchase a house, but the house they get may not be in as good of repair as it could have been because less money came in to make repairs, just the essentials to keep it up to code. It’s the small mom-and-pop investor businesses which would be hurt the most by this law because the rental companies can increase the rent on those dwellings they own outside the city limits.

The solution for homeowners may be that of subdividing larger houses into apartments where possible. Certainly that’s not an elegant solution and I suspect the various housing boards may look a lot more severely at these efforts because it’s a way of skirting a bad law.

It’s just the latest chapter in the Ireton war on landlords. He may think he can bring Salisbury up from poverty but instead it will just change the distribution of wealth slightly, eventually make affordable housing more scarce, and discourage investment – or, as Ireton calls it, “greed.”

My friend Muir Boda has his own thoughts on the process, and notes that College Park dropped its program a couple years ago. I agree with his main point, though: instead of using government to bring one class down in the attempt to raise another, why not try to add value by attracting the kind of economic development which can make fewer households “cost burdened.”

Perhaps that should have been Ireton’s plan all along.

Tales of a community barbecue

Yesterday was a pleasant day for a barbecue, and as it turned out City Council candidate Muir Boda had one. In the space of a half-hour Doverdale Park went from abandoned to buzzing with activity – and I’m not just talking about other candidates who dropped by to engage with that working-class neighborhood. Once the DJ got going, people began to show.

Boda is running in City Council District 2, but as the map is drawn many areas are a short walk from the adjacent District 4. It is the district where outgoing Mayor Jim Ireton is running for City Council, but opponent Roger Mazzullo was there meeting and greeting voters. Doverdale Park is actually in that district, with Boda’s on the other side of Decatur Street.

Mazzullo had a table full of items with his name on them, but very little further information. This display was there for the cuteness factor.

In talking to Roger, I gathered his concern was economic development and jobs, as both he and his wife operate businesses. Ironically, both do most of their business outside Salisbury on a regional and national level.

As the event went on, I noticed there were three types of people. Some came for the free food and left, while the kids naturally ate and drank while playing basketball or riding their bikes. But a select few stayed and chatted with others there in the park’s modest picnic pavilion.

Those who did stick around found a number of fellow City Council candidates and others who wanted to hear this neighborhood’s concerns. Boda and Muzzullo stuck around for the whole thing, but Delegate Carl Anderton was there as were April Jackson from District 1 and Laura Mitchell from District 5. Barring a write-in campaign, she is unopposed for re-election but was there for a good hour or so hearing from folks.

I’m not a great judge of crowds, but I would guess 75 to 100 people came by. Of course, not all of them were voters – and in hindsight, speaking as a Central Committee member, there should have been someone to register voters there – but it created a good impression and Boda has to because he lives just down the street from there. So those are his neighbors he hosted.

While we contemplate how many billions – yes, billions with a “b” – the Presidential candidates will spend on mass media, it’s nice to get a reminder that Tip O’Neill’s adage that “all politics is local” still rings true.

An anticlimactic November

One reason the Salisbury city elections were changed beginning this year was the abysmal turnout they usually had in the spring. Sadly, turnout will likely be lower still thanks to the lack of a mayor’s race. The deadline came and went today and Jake Day is the only candidate who filed for mayor.

Voters in District 5, on the city’s far east side, will have even less reason to show up because incumbent Council member Laura Mitchell was the only one bothering to run in her district.

On the other hand, there are old-fashioned shootouts in the other four Council districts. Two incumbents lumped together in District 3 will tangle as both Tim Spies, who won in his second try in 2011, and 2014 appointee Jack Heath will both battle for that seat along with Kevin Lindsay, who was one of 11 unsuccessful applicants to succeed Terry Cohen when she resigned last year – it was the seat Heath won appointment to. It’s a district that takes in the Camden neighborhood by Salisbury University and hops across the Wicomico River to take in areas along Pemberton Drive.

There are two others who tried for the Cohen chair that are running for election this year: Sarah Halcott in District 1 and Muir Boda in District 2. Halcott faces two foes who are familiar with each other: incumbent Shanie Shields and 2013 opponent April Jackson in this inner-city and near west side district. Boda, who is in a district with no incumbent, has three fellow challengers in Keyvan Aarabi, Marvin Ames, and Justin Gregoli. Ames ran for the District 1 County Council seat last year but lost in the Democratic primary. District 2 covers the close-in neighborhoods on the north and east sides of Salisbury (and is my home district.)

Instead of running again for mayor, Jim Ireton opted to run for City Council in District 4. He will face two others vying for the seat: Kenneth Vickers III and Roger Mazzullo. That district is perhaps the largest in geography as it takes in most of the commercial center along the northern fringes of town before veering toward downtown Salisbury.

And downtown will have a friend in Day, who has to be pinching himself and wondering how he was fortunate enough not to have an opponent in his run for mayor. It’s very possible, though, that he may just switch roles with Ireton as he would likely seek to be Council president after being put on the Council as Day did after the 2013 election. (Ireton has served on City Council before, though. He was on it for about a year before leaving – as the story goes it was to take a job out of town.)

With no incumbent in District 2, that will be an interesting race as the victor may be the only newcomer to city government. Boda has run for City Council twice before, losing to incumbent Debbie Campbell in 2009 and finishing fourth behind Mitchell, Cohen, and Spies in 2011.

Out of the 16 total candidates, there are six incumbents (one by appointment), four who have sought election at least once before and lost (including the appointee), four who tried for appointment (one apiece being also in the previous two categories), and five who are apparently political neophytes. Some have steeper learning curves than others.

Interestingly to me, the lack of a primary election means financial disclosure statements will not be due until a week before the election – so no one will know just how the money supply is for candidates until the last minute. (Had the primary remained in place, it would have been held in early September for voters in all but District 5 as the three or four candidates otherwise would have been whittled down to two in each race.) One can ask the legitimate question of who, if anyone, Jake Day will ask his donors to give to now that he is in the clear. (They can also ask about Laura Mitchell.) As two incumbents who got a free ride, their backing could make a difference.

So the first hurdle is crossed, eleven weeks before we actually vote. For a candidate, 77 days can seem like an eternity until they get to mid-October and wonder how they will get through the next few weeks with all they need to do. I look forward to hearing some new and good ideas for the city of Salisbury from this group.

A new Day in Salisbury?

It was apparent from the start that Jake Day was a guy in a hurry. Not content to learn the ropes as a member of Salisbury City Council, he ascended directly to its leadership. So I’m not really surprised that he made his expected run for mayor of Salisbury official earlier tonight at Headquarters Live.

Yet there are some things which stick out about Day’s agenda and record which I find to be of concern. It’s possible he may have addressed these in his remarks, since I was not at the event, and he may certainly feel free to comment here. But I would like to know first of all what he plans to do to keep up Salisbury’s neighborhoods and not create a city full of red-headed stepchildren to the spoiled brat of downtown. Certainly downtown development has a place in the city’s renewal but there are other avenues worth considering too.

Granted, downtown revitalization was Pillar 1, Strategy 1 of his original vision for Salisbury from two years ago but there are about 95% or more of the city’s residents who live in the rest of the city so their needs have to be kept in mind as well.

Another question I have is what will become of the “rain tax” he and most of the rest of City Council (save District 3’s Jack Heath) voted for last year. What specific projects will the money go to, and is there a point when the job will be completed, negating its need? I understand he has a multi-decade goal in mind, but there are a lot of blanks instead of answers on how to get from point A to point B.

One thing the Daily Times story alludes to is the possibility of a race between Day and current Mayor Jim Ireton; however, I don’t see that happening. The simple reason is that if Ireton wanted to secure another term he would have made his intentions known already. I know we have more than a month before the filing deadline but the word on the street is that Ireton wants to switch jobs with Day and run for a County Council seat in his District 4.

If it’s a race between Ireton and Day for mayor, certainly the city would be better off with the more even-keeled Day at the helm. Ireton’s bullying style is wearing thin.

But I want to keep my powder dry for the time being and see if a more conservative, business-minded candidate emerges. So don’t include me in the hoopla surrounding Day just yet.

 

 

The next big thing in Salisbury

Rumor has it that he’s going out the door by not standing for re-election as mayor, but if this is so Salisbury Mayor Jim Ireton is declaring war on private property as his swan song.

On Monday, according to a press release from his office, Ireton will set the wheels in motion to eliminate the non-conforming “4 to 3” or “4 to 4” properties in the city, with the stated goal that all housing units in the city will either have no more than two non-related occupants or be single-family housing. Approximately 400 households in the city would be affected.

Ireton is also looking to hire a Community Development Specialist, with the stated goal for this new position being “someone who can identify funding sources, and coordinate with the various agencies involved to shepherd properties through the tax sale process.” That last part is interesting because it brings me to my main point: it looks to me like the city wants to become a much larger landowner. To wit:

According to Salisbury’s Vacant Building Registry, there are 187 vacant and/or abandoned houses within City limits. The effect of these properties on their surrounding communities is demonstrably negative, causing losses in neighborhood property values, increases in crime and vagrancy, and public health concerns. The proposed budget amendment would set aside $45,000 for a fund which the City would use expressly to purchase vacant and abandoned homes at tax sale. Starting in FY2016, an additional $500,000 in bonded debt would be earmarked for acquisition, rehabilitation, repurposing, demolition, and legal fees. Homes bought by the City would be determined to be either eligible for donation to Habitat for Humanity or Salisbury Neighborhood Housing Service, or unfit for rehabilitation and demolished.

Imagine if you will an entrepreneur suddenly deciding to go out a purchase a whole bunch of houses at a tax sale, and the hoops this owner would have to jump through to secure all the permits, inspections, and other hassles a prospective investor would endure because the wheels of city government move so slowly. It’s a climate that discourages investment, so oftentimes properties sit vacant or abandoned. Factor in the difficult economic times of the last several years and there’s no question that too many people believe investing in Salisbury would be a losing cause.

So instead of addressing the situation of why investment is such a risk, the city will go into the business of home ownership. Not only that, they plan on running up plenty of debt to get themselves into a position to decide whether to renovate or tear down these dwellings.

It seems to me the better use of tax dollars would be to take care of what they do own. For example, I live across from a city park that is essentially an empty, semi-wooded lot with one lonely basketball hoop in the middle of it. For a few thousand dollars they could perhaps install a walking path, nice flower beds, and perhaps a couple trash receptacles. It’s not a large space, but it is a focal point of this little neighborhood.

If you believe the rumors that Jim is going to try and trade places with Jake Day, this isn’t the way to do it. Six years ago, we were promised that “help is on the way” but this isn’t going to be much help in making Salisbury an attractive place in which to invest. Why take a chance on buying a house when your next door neighbor could be a property owned by the city?

The noisy, tiny minority wins again

It’s concession time in Annapolis: for another year, the will of Wicomico County voters will be thwarted by a group refusing to accept that the answer to the elected school board question should be decided by the voters, not a small group who’s worried that their power base may be threatened.

Today I received a press release from my Delegate, Carl Anderton, admitting the bill is defeated for the session. In it, Anderton noted that:

This delay affords us the opportunity to have an inclusive year-long dialogue about the issue. It will give everyone more time to weigh in and reassure anyone with concerns that next year’s bill is reflective of community input.

Yet if the “dialogue” is in the tone and tenor of the testimony offered by Jim Ireton, there’s no use in conducting the discussion. In fact, he said at the hearing, “I think the discussion should end now.” After all, according to Jim, an elected school board would “debilitate our public schools.”

And if there are public hearing with a number of proponents speaking, I’m sure Ireton would echo his charge about a “sparsely attended public hearing” attended by only proponents. It’s the “small band of supporters” who also gerrymandered the county, placed us under a “crippling revenue cap” and “refuses to be responsible.” These are all quotes from his testimony before the Senate Education, Health, and Environmental Affairs Committee. (He comes on at the 4:00 mark.)

Here is the dirty little secret Carl will eventually learn – there is no amount of dialogue which will satisfy them. For whatever reason, the appointed status quo satisfies their desire to have a malleable board that has generally been selected with the approval of the teachers’ union. Since the Democrats have occupied the governor’s office for much of the last forty years, the appointments were made with that interest group in mind. The only accountability was to the sponsors who backed them, and as long as a couple of those “yes-men” were from a minority group, all was peachy keen in their world.

To them, an elected school board is scary because accountability may be introduced. Again, consider what Ireton thought about the voters of the county which chose to install a revenue cap and would prefer an elected school board.

They are scared. But we’ll give them the public hearings, and for that I better damn well see Jim Mathias as a co-sponsor. I honestly think his not sponsoring the bill is what prevented it from going forward.

As the old Brooklyn Dodgers fans used to say, “wait ’til next year.” No more excuses.

An open letter to opponents of an elected Board of Education for Wicomico County

It was enlightening to see the main points you brought up in testimony regarding our county’s expressed desire to convert from a fully-appointed Board of Education to a “hybrid” elected and appointed body. In reading the summary presented by Phil Davis in the Daily Times, I seized upon several arguments made against the concept and I’d like to address them here.

The first was the financial argument presented by Senator Montgomery in her line of questioning. Indeed, the county receives a large amount of money from the state for its Board of Education, in part because it’s one of those eight counties (plus Baltimore City) which has “less than 80 percent of the statewide average wealth per pupil” and also has a disproportionate share of those students who must learn English as a second language. Senator Eckardt brought up the difficult economic times the region has seen over the last several years, but that’s not necessarily the correct argument to counter this point.

Rather, one must examine the root of all government money: the taxpayer. Perhaps Senator Montgomery, being from a county chock full of those who work for the federal government, is assuming that everyone has the means and willingness to give government whatever it wants. Instead, we as concerned Wicomico County residents come from that seemingly quaint and disappearing class of people who actually demand accountability for the taxpayer dollars we provide. While the financial books may show that the majority of our school funding comes from the state, it’s worth making the point that we taxpayers are the ones providing the money. Because all state money comes from the labor and toil provided by those who pay taxes at some level, including to the federal government, it follows that we want to keep a relatively close eye on it.

As for the question of community input, it’s worth reminding Mayor Ireton, Mrs. Ashanti, and other opponents that this is not the first time the subject of an elected Board of Education has come up. It’s been a topic of discussion for decades, and the previous edition of County Council resolved to ask Annapolis for a simple straw ballot to determine interest in further legislation only to be thwarted by opponents who charged that the system as proposed did not properly address the concerns of the minority community. To me, that’s a tacit admission that the community interest was there but as proposed an elected Board of Education did not meet with the political desires of the opponents, who generally subscribed to the philosophy of the party holding the governor’s office at the time.

And elections do matter. While the main issues of last fall’s election were the sentiment that the state and local economy was not improving at a satisfactory pace, and that government overall was not being careful with the increasing amount of money they were taking out of our pockets, there was an underlying sentiment that our educational system also needed improvement and accountability. Thus, two key opponents of an elected Board of Education were voted out of office and two proponents were voted in.

Yet the new county government listened to one key demand of the opponents and compromised. Personally, I was not happy that the fully-elected Board of Education was replaced by a version with two appointed members and five elected – our version of a “hybrid” model counties who have recently shifted from a fully appointed board have used – but I understand the politics behind the move, and that time was of the essence to bring the proposal before the current session of the General Assembly. Yet my suspicion is that the opponents know what the public input will be, and that’s a resounding approval of this proposal when placed before the voters.

Next is the interesting point brought up by Mr. Johnson of the WCEA regarding the County Executive’s influence on the board and the school’s budget. It’s interesting because he’s fretting over two members of a seven-member board, members who will have no greater voting power than any other member. If the two members appointed by the County Executive disagree with the position of the other five elected members, their opposition will simply amount to the losing end of a 5-2 vote if they can’t convince the other members to adopt their viewpoint.

But I want to conclude with the sentiment expressed by Mayor Ireton and Mrs. Ashanti that, “it was a select few who made the call for an elected school board.” My argument is that it’s a select few who participate in the process now.

For eight years I was a voting member of the Wicomico County Republican Central Committee. As such, one of our tasks was to assist in the appointment of the three Republican members of the Board of Education (at the time; with the election of Governor Hogan the GOP ranks were allowed to expand to four.) Presumably the Democratic Central Committee does the same with their appointees, although I confess that I have a lack of knowledge about their process as I can speak to ours.

Yet despite our vetting of candidates, more often than not the appointee would be determined by the input of others who had interests that were more political in nature. The final say actually comes down to one person: the state’s Secretary of Appointments, who in turn is appointed by the governor. In the case of the most recent previous governor, he was elected despite our county’s support for his opponent. Where was our public input then?

Over the last two weeks, the Republican Central Committee dutifully interviewed prospective members and submitted names to the Secretary of Appointments to fill two vacancies on the Wicomico County Board of Education. We submitted the names of all those who interviewed, expressing only our order of preference, in a process agreed on by the Central Committee.

But because some members of the body aspired to be on the Board of Education and another was absent from the final meeting, it was a bare quorum of five members who decided the order of preference. Five people submitted names to one person to make this decision, and yet this is considered superior to a process where thousands of people would be able to decide those they would like to place in charge of millions of taxpayer dollars?

In November, we elected a County Council and County Executive who will be charged with an annual operating budget of roughly $130 million. Yet the appointed Board of Education is submitting an overall budget for FY2016 in excess of $190 million, of which they are asking the county for $39 million. Once again, let me reiterate that a small group of perhaps fewer than two dozen people at the local and state level had input on who was chosen to oversee that Board of Education budget, a budget nearly 50 percent larger than the county’s operating budget as a whole.

When it comes to maximizing accountability and local control, the verdict is simple: an elected school board – even in this “hybrid” form – is the proper way to proceed. Opponents who wish to maintain the status quo are hiding behind a series of smokescreens to obscure their real issue: the loss of their political influence over who gets to operate Wicomico County’s school system.

A tone-deaf city government

It took several months longer than anticipated – and we don’t yet know exactly what the toll will be – but last night 80 percent of Salisbury City Council gave 100 percent of local property owners another tax to pay by approving a stormwater utility on a 4-0 vote, with newly-appointed Jack Heath being absent.

Council President Jake Day “doesn’t expect” the fee to be more than $20 a year for homeowners, and expects to raise $1.25 million annually from the “rain tax” – and yes, I think the moniker is appropriate given the business fee will be determined by the amount of runoff they produce. According to the latest Census data, though, there are 13,401 housing units in Salisbury so my public school math tells me that businesses are going to pay almost 80% of the total, to the tune of almost $1 million annually.

Interestingly enough, I was quoted in the Daily Times story from last Thursday from a post I wrote in February when the idea came up, and I think the point is still valid: we don’t know what impact there will be from this tax hike on the overall health of the Chesapeake Bay. It seems to me that the timing isn’t very good on this one, particularly as the state and county are working to make these entities more business-friendly and new taxes tend to work in the opposite direction.

I was curious about something, so I took a look at the city’s latest budget that was adopted in May. In it, Mayor Jim Ireton points out that “(t)his budget shows levels of monetary surplus at incredibly healthy levels for both the City’s General Fund and the City’s Water and Sewer Utility.” But it also is using some of the proceeds from the wastewater treatment plant settlement on sewer infrastructure, so why do they need this new tax now? Granted, it’s also stated in the budget that ratepayers get a 2.5% break on water and sewer rates this year, but the extra $20 fee will likely eat that savings up and then some.

The budget also makes the case that the $100 a month, give or take, that a residential property owner pays in property taxes provides a cornucopia of services, a palette which includes stormwater management. So we’re already paying for the service with our property taxes, but instead of adding the penny or two that would cover the additional services the city wants to create a new special fund. Currently the Water and Sewer Fund comprises roughly 1/3 of a city budget which runs about $50 million, with property taxes chipping in about $22 million toward the General Fund. With the city of Salisbury increasing the tax rate regularly, it’s doubtful we’ll see a corresponding decrease in property taxes to offset the new fee.

And while I’m not an expert on the city charter by any means, my question is why can’t the purview of the Water and Sewer Utility (which has a large surplus) be simply expanded to stormwater? Generally infrastructure improvements to the stormwater system involve changes to the remaining utilities as well, so the same work may well come out of two (or three) different funds given the city’s idea. It may be more efficient and less taxing on the city’s residents to amend the charter to add stormwater to the existing water and sewer utility.

So let’s review: the fee would cover something which is already supposed to be paid for, in an amount we haven’t quite determined yet, to achieve projects for which we don’t know the scope but are supposed to address a problem Salisbury contributes little to and is only compelled to deal with because the state refuses to stick up for itself and tell the EPA and Chesapeake Bay Foundation to go pound sand. What could go wrong?

Just remember all this come Election Day next year.

Update 11/26: I actually stumbled upon this as I was researching some items for my next post today, but it’s worth pointing out that Salisbury has justified its adoption of a stormwater utility by saying the town of Berlin has one in place.

The same group, called the Environmental Finance Center – which is part of the University of Maryland but serves as a regional hub for an existing EPA program – did studies to justify the need for Berlin (2012) and Salisbury (2013). The results were pretty much the same, although the suggested fee was higher in Berlin than it was in Salisbury, where they recommended a $40 annual fee for homeowners. Notably, the Salisbury report also recommends fee increases after a period of years – see the chart on page 15. So the problem won’t ever be solved and the program will run an annual surplus that likely won’t be rebated to taxpayers. Moreover, unlike a property tax from which religious-based entities have traditionally been exempt, they have to pay the fee as well.

Also, the fingerprints of the notoriously Radical Green folks of the Town Creek Foundation are on these reports. It’s a group which believes:

We think that true sustainability and resilience – in an increasingly unstable, crisis-prone world – will depend on fundamental transformations of the systems (including the value systems) by which everyday life is organized. These include the systems by which we make and consume energy, food, and materials, and the systems by which we make and enforce social decisions.

We’ve already seen the results of a national “fundamental transformation” over the last six years, and many millions would like to transform back to where we were. But a tone-deaf government just wants to take more out of our pockets rather than prioritize existing resources.

Troubling ethics charges in county race

This letter was sent to me by incoming Central Committee member Dr. Greg Belcher. His concern was an e-mail sent out by Tamara Lee-Brooks, the county’s Public Information Officer, to her county e-mail address list.

Wicomico County residents should be informed about recent events involving the County Executive and his staff.

It has come to my attention that on October 17 the Wicomico County Public Information Officer sent an e-mail message to various persons announcing a joint press conference to be held by Anthony Brown, Rick Pollitt (Brown’s local campaign manager), and the mayor of Salisbury to criticize Brown’s opponent, Larry Hogan. In her e-mail Ms. Lee-Brooks stated that she “was asked to forward” the announcement but did not identify by whom. However, Mr. Pollitt is her superior, in essence if not directly.

It is my understanding that such a communication is a clear violation of the County’s ethics law by Ms. Lee-Brooks, and more significantly the supervisor who ordered it, reasonably assumed to be Mr. Pollitt or another member of his staff. Using public resources (and personnel) for partisan political purposes is strictly prohibited by the law.

Other conduct by Mr. Pollitt and/or members of his staff deserves the voters’ consideration, as well. It has been reported that County vehicles are being used for personal matters, including visiting a local bar and grill. And – in response to Freedom of Information requests – it has been disclosed that Mr. Pollitt has used his County credit card to buy personal groceries on more than one occasion and pay for meals at restaurants. Such conduct is unacceptable, even if Mr. Pollitt promptly reimbursed the County. This, too, is a likely violation of the County’s ethics law.

A complaint is being filed with the County’s Ethics Commission asking for appropriate sanction for matters discussed above. That body should investigate the charges and act appropriately in advance of November 4.

Upper Marlboro, MD – On Friday at 11:00 a.m., Lt. Governor Anthony Brown, Wicomico County Executive Rick Pollitt, and Salisbury Mayor Jim Ireton will hold a press conference to discuss the harm that Republican Larry Hogan’s $450 million cut to school construction would have on the Eastern Shore.

These cuts are contained in Hogan’s so-called savings plan — a plan whose numbers the Baltimore Sun noted “don’t add up.”

Hogan’s proposed $450 million cut to school construction could put projects like the construction of Bennett Middle School out of reach for many communities along the Eastern Shore. For the next four years, counties across the Eastern Shore have requested millions in state funding for repairs and renovations in order to modernize their classrooms and deal with overcrowding. But school construction cuts could put all of these local projects at risk.

It’s worth pointing out that the State Ethics Commission has already deemed this letter improper, but for some strange reason none of the local media is very interested in that fact.

In response, county Republican Party Chairman Dave Parker has today asked the county attorney to investigate:

I am deeply concerned that recent actions by elected and appointed Wicomico County officials were in direct violation of §37, the Wicomico County Ethics Law – and likely also the Maryland Ethics law.

The Brown/Ulman gubernatorial campaign recently scheduled a “press conference” in Salisbury claiming “to discuss” Hogan’s alleged plan to make a $450 million cut to school construction on the Eastern Shore. That alleged cut is clearly part of the political dialog which typically occurs during campaigns for office, and as such is clearly more a scare tactic than a reliable statement of fact. At best it is a partisan political disagreement.

However, as the attached email indicates, Tamara Lee-Brooks, the Wicomico Public Information Officer, honored a request (from an unnamed source) to forward the announcement of Brown’s press conference, and Matt Creamer, the Wicomico County Council Administrator, further forwarded this request (as a media advisory). Members of the media consequently reported this so-called press conference, apparently actually attended by Brown. Regardless of the number of individuals to whom this request was forwarded, the County time and other County resources consumed are what are what I believe were unethical.

As I understand the law, because these were obviously partisan political actions in support of the Brown/Ulman campaign, using County Offices, County email, and County employee time to forward Brown’s announcement were are all violations of ethics laws. Because County Executive Rick Pollitt is not only ultimately responsible for supervising Tamara Lee-Brooks but because he also serves as Brown’s local campaign manager, an investigation will likely identify others who used County resources to promote the Brown/Ulman campaign.

Accordingly, with this letter I am, in accordance with instructions I received from your office by telephone, herewith submitting to you a formal ethics complaint for you to deliver to the Wicomico County Ethics Commission for their action. Moreover, I’m requesting that the Commission first thoroughly investigate, then determine and publicly identify and announce both what ethical violations have taken place (and by whom) and what corrective measures will be taken to prevent similar violations in the future.

On the other hand, if overt partisan political activity using County time and resources is not a violation of law, then please so inform me, in writing, that this is the case, citing the appropriate legal authorities.

It’s highly unlikely at this late date that any resolution will occur before Tuesday, but this is just another example of shoddy ethics in Wicomico County government.

Yet these scare tactics from local and state Democrats – in lieu of a record of success from nominee and Lt. Gov. Anthony Brown – are par for the course. Sensible voters know Bennett Middle School will be finished and other projects will probably get their funding. It’s worth pointing out as well that there may be some cost savings on individual projects which could make a big difference that Larry Hogan could – and should – get behind, such as eliminating the need to comply with LEED Silver standards and prevailing wage for school construction (as Ohio did some years ago.)

Of course, the real change which should be made in Maryland education creates a prospect that scares the living bejeezus out of Maryland Democrats and their wholly owned subsidiary, the Maryland State Education Association. That would be a program of money following the child regardless of schooling situation, forcing public schools to compete on a level playing field with charter, for-profit, and faith-based educational institutions as well as making homeschooling more affordable.

So it’s not a surprise that Democrats circle the wagons around school construction because it’s not the buildings that are being threatened, it’s the power structure.

Cohen out, so who will be in?

It came as a surprise to many that Salisbury City Council member Terry Cohen resigned with a little over a year left on her term. Citing her family’s “major life changes” she’s resigning as of August 8.

Cohen was originally elected as part of a reform-minded slate in 2007, and found a natural ally in then-Council member Debbie Campbell. And while those who advocated for reform eventually turned on Louise Smith, who was one of the two new Council members elected in 2007, the real change in Salisbury came when current Mayor Jim Ireton was elected in 2009. Campbell and Cohen became more reviled as the obstacles to Ireton’s agenda, eventually leading to Campbell’s defeat by Jake Day in 2013 as well as Cohen’s removal as City Council president, where she served from 2011-13, to be replaced by the newcomer Day.

Of course, the blogs which focus more on local politics are already aflame with comments and suggestions for a replacement for Cohen, with the situation further complicated by Day’s required military reserve service occurring this week – however, they have until September 5 to name a replacement and they’ll begin accepting applications Monday. That replacement will have just 15 months to serve out Cohen’s term before he or she stands for election, if desired.

Two of the names most bandied about to fill Cohen’s seat are Josh Hastings and Muir Boda. As most locals know, Hastings is already running for a County Council District 3 seat as the Democratic nominee while Boda ran at-large and finished third in the Republican primary behind Matt Holloway and John Cannon – respectively, present and former County Council members. There are others who are being mentioned, mainly on the Democratic side, so the obvious question is whether the Democratic-dominated City Council will stay loyal to party or not.

Yet what do I always hear from Democrats when the Republicans are in charge – we need to have bipartisan consensus, they say. Well, here’s an opportunity to put their money where their mouth is and select the best candidate out there. (Worth noting: the city elections are non-partisan.)

I believe in having everyone at the table.  All are stakeholders in this city whether you are a homeowner or business owner, landlord or renter, employer or employee, you have a right to be heard.  We all have a stake in this community and passing it on to the next generation better than we received it is not just the right thing to do, it is our duty.

Join me as we bring forth a positive message of healing, reaching out to our neighborhoods that are disenfranchised and opening up our doors for business.  We have so much work to do and it is going to take all of us putting aside our differences to do what is best for Salisbury.

These were Muir Boda’s words in 2011, just before the general election where he finished fourth – it was the same election where Terry Cohen retained the seat she’s vacating, along with Laura Mitchell and Tim Spies. For the most part, the message rings true still today.

As the city moves into a phase where the downtown may be revitalized, I want to make sure that’s not at the expense of the neighborhoods. As a homeowner in one of the city’s most transient neighborhoods – most homes on his block are rentals – Muir has an interest in maintaining the sometimes-neglected corners of the city. I think he would be a fine choice for this sudden vacancy.
